8 Tips To Up Your Mesothelioma Talc Lawsuit Game
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is the first one to be held since J&J has dissolved its talc business and filed for bankruptcy.

This year, juries awards in New Jersey and California led to massive settlements in talc-related lawsuits. glendale mesothelioma law firm linked their cancer to asbestos found in J&J's Shower Shower and Baby Powder products.

What is Mesothelioma?

Mesothelioma is a deadly type of cancer that affects the mesothelium or lining that surrounds organs and body cavities. It is most prevalent in the lungs but can also be located in the chest and abdomen cavity. Asbestos, the sole known cause of this illness, is asbestos. People who have been exposed to asbestos are at a higher risk of developing it.

The first trial following J&J declared bankruptcy on its talcum-powder division opened in Oakland, California this week. Jurors were impressed by the story of the plaintiff. In 2022, the plaintiff, who was only 24 years old at the time was diagnosed with malignant mesothelioma in the pericardium. The plaintiff attributed his condition to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J is accused of obfuscating asbestos-related risks from consumers for decades. The company has a long track record of keeping asbestos information from regulators, as well as paying for asbestos tests that gave the results they desired. Some of the company's Talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Women who used talcum for feminine hygiene on pads or condoms, or in the genital area have been diagnosed with mesothelioma and ovarian cancer. The lawsuits assert that J&J knew for more than 40 years that the powder could cause ovarian cancer and mesothelioma, but failed to warn customers of this risk.

Mesothelioma symptoms include abdominal pain, abdominal swelling, abdominal lumps, and persistent coughing. Doctors can diagnose the condition by a physical examination and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.

When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery, or radiation. The surgeons are able to remove the affected tissue depending on the location of the tumors. Patients with mesothelioma are sometimes given an expected life expectancy of less than five years, but aggressive treatments such as extracorporeal membrane transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy may prolong the life expectancy.

What is the cause of Mesothelioma?

Like many cancers, mesothelioma develops by DNA mutations. These mutations lead to uncontrolled cell growth that creates tumors in the tissues. Asbestos is the most common mesothelioma cause. The exposure to asbestos can occur in many different industries, including manufacturing, mining construction, transportation and construction. Asbestos is usually exposed for between 20 and 40 years prior to the onset of symptoms becoming apparent. Men are more likely to develop mesothelioma compared to women. It is also found most often in those between the ages 50 and 70. The type of mesothelioma a sufferer is usually determined by the region of their body where they were exposed to asbestos. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma, which affects the lungs. Some are diagnosed with peritoneal mesothelioma, one type of mesothelioma which affects the abdomen. Finally, some people are diagnosed with pericardial mesothelioma. It is an extremely rare type of the disease that affects the heart's lining (pericardium) and the organ itself.

Symptoms of mesothelioma include fatigue, shortness of breath and abdominal pain, as well as weight loss. In the later stages of mesothelioma, the tumors may spread to other areas of the body, causing extreme pain and discomfort. Other common symptoms of mesothelioma are fluid on the lungs (pleural effusion) loss of appetite, difficulties swallowing and a blockage within the small intestine, referred to as a bowel obstruction. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a person who was 24 who developed pericardial msothelioma following the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos and didn't warn consumers. They also cited a 1998 letter addressed to a J&J executive, revealing the possibility of asbestos being in their products.

This is the latest in a series of high-dollar verdicts against J&J. In March the jury handed down $18.8 million to a woman who contracted mesothelioma ovarian from J&J's talcum powder. Last month, a jury in Missouri awarded $55 million in another case involving the same issue. Seven new cases have been added to the MDL talcum powder over the last month, bringing it to 37,522 the total number of lawsuits pending. Most of these lawsuits were brought by women who have used J&J talcum powder to maintain feminine hygiene.

How can I tell whether I have mesothelioma not?

A diagnosis of mesothelioma is devastating. Patients must always consult a doctor for the most accurate diagnosis and to prevent mistakes that could lead to unnecessary treatment and the spread of cancer.

A physical exam and a blood test can be an effective way to determine whether mesothelioma may be causing symptoms. These tests can be used to test for asbestos fibers in blood or the health of the patient's internal organs. The most precise method to diagnose mesothelioma is by biopsy, which is when doctors remove fluid or tissue from the affected area and examine the area under a microscope to search for mesothelioma cancer cells.

The type of mesothelioma that sufferers have can influence the prognosis of a patient. Pleural mesothelioma, the most common type of the disease, and accounts for the majority of cases that are diagnosed. Peritoneal mesothelioma, a cancer that forms in the lining of the abdomen, is less common. Finally, pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is much less common and makes up around one percent of cases.

The breath is short, and gets worse with time, and a bloody cough are some of the first symptoms. Asbestos patients may also experience fluid buildup in the chest cavity, a condition called pleural effusion. This can be drained by inserting a needle into the affected region of the chest cavity. In more serious cases, doctors can undergo a procedure called pleurodesis, which seals the area to stop the reaccumulation of fluid in the pleura.

Getting an accurate mesothelioma diagnosis is the most reliable way to determine a patient's treatment options and survival rate. Surgery, chemotherapy and radiation are all options. Other options include immunotherapy which increases the immune system to fight mesothelioma as well as tumor treating fields that use magnetic fields to kill cancerous cells.

A mesothelioma specialist may also help patients understand various mesothelioma cell types which determine the extent of the cancer as well as the patient's outlook. Patients should discuss with their physician their experiences with asbestos exposure to determine if mesothelioma is possible and what treatment options are available.

Mesothelioma, a rare and fatal disease caused by asbestos exposure, is a rare disease. Asbestos was widely used in a variety of industrial and consumer products like baby powder. In talcum powder cases, plaintiffs claim that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma and other health issues.

J&J believed to have known about the risk of asbestos and talcum powder for decades, but did not warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against the company. The claims have been combined in state and federal multidistrict lawsuits, or MDLs.

In 2018, one of the largest Talc trials ended in a $4.7 billion settlement for the plaintiff. This made national headlines and set the stage for the rest of the litigation. In the last month, a judge ruled against a motion by J&J to dismiss the lawsuits brought by the state of Mississippi.

However, in an attempt to derail the litigation, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company created an entity to take over its obligations. The bankruptcy stopped the filing of thousands of talc lawsuits, but the 3rd Circuit rejected that strategy.

The lawsuits filed by the state of Mississippi are founded on the same allegations that were a part of the individual lawsuits filed against J&J: that the company's inability to warn of the dangers of ovarian cancer resulting from the talcum powder was negligent and violated the law of the state.

J&J has submitted its motion to dismiss lawsuits before a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to move forward.
