Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with pericardial msothelioma claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma case is the first trial to be held since J&J filed for bankruptcy and spun off its talc division.
Earlier this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs have linked cancer to asbestos found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a deadly type of cancer that affects mesothelium or lining that surrounds organs and body cavities. It is most often found in the lungs, however it can also occur in the abdomen, the heart and chest cavity, as well as the testicles. Asbestos is the sole known mesothelioma-related cause and those who have been exposed to asbestos are at greater chance of developing the disease.
The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional as they heard the plaintiff's story. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial mesothelioma in 2022. He attributed his illness to the use of Johnson & Johnson baby powder. The jury awarded him $26 million.
J&J is accused of hiding asbestos risks from consumers for decades. The company has a long track record of keeping asbestos information from regulators, as well as paying for asbestos tests that produced the results they desired. These lawsuits have identified several of the company's suppliers of talcum powder which include Whittaker Clark & Daniels, Imerys Talc America, and other companies.
Many women who used talcum powder to maintain feminine hygiene in the genital areas or on sanitary napkins or condoms have developed an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could cause ovarian cancer and other illnesses, but failed to warn consumers.
The symptoms of mesothelioma are abdominal pain as well as abdominal swelling, abdominal lumps and a persistent cough. Doctors can detect mesothelioma with physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.
Once a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery, or radiation. Depending on the location of their tumors, surgeons may be able remove the affected tissue. Patients with mesothelioma can be given a life expectancy of less than five years, but aggressive treatments such as extracorporeal Membrane transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong the duration of their survival.
What is the cause of Mesothelioma?
Mesothelioma, as with most cancers, is caused by DNA changes within a cell. These mutations lead to uncontrolled cell growth that causes tumors to form in tissues. Asbestos is a common cause mesothelioma. Asbestos exposure can be found in many different industries including manufacturing, mining, and transportation. Asbestos can be exposed for between 20 and 40 years prior to the onset of symptoms appearing. Men are more likely to develop mesothelioma than females. It is also diagnosed most often in those between the ages 50 and 70. The kind of mesothelioma involving asbestos that a person develops is often determined by the location on their body they were exposed. Most mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Some are diagnosed with peritoneal mesothelioma. This kind of mesothelioma is affecting the abdomen. Some people are diagnosed with pericardial msothelioma. This is an extremely rare type of disease that affects both the lining (pericardium) as well as the organ itself.
Symptoms of mesothelioma include shortness of breath, fatigue and abdominal pain, as well as weight loss. In the last stages of mesothelioma the tumors can spread to other parts that cause severe discomfort and discomfort. Other symptoms of mesothelioma include fluid in the lungs, nausea, difficulty eating and swallowing. Mesothelioma can be fatal.
The talcum powder trial in Oakland involved a man aged 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers argued that the company knew that talc contained asbestos and didn't warn consumers. They also cited a letter in 1998 to an J&J executive which revealed the possibility of asbestos in their products.
This is the latest in a string of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. Last month, another jury in Missouri handed down $55 million in an identical case. In addition, seven cases were added to the powder talcum MDL in the last month which brought the total number of pending lawsuits to 37,522. The majority of these lawsuits concern women who used J&J's Talcum powder for feminine hygiene reasons.
How can I tell whether I have mesothelioma or not?
A diagnosis of mesothelioma is devastating. Patients should always seek out a specialist to get the most accurate diagnosis and to avoid mistakes that could result in unnecessary treatment and spread of cancer.
A physical examination and a blood test could be an excellent way to determine whether mesothelioma has caused symptoms. These tests can be used to look for asbestos fibers in blood, or the health of a patient's internal organs. The most reliable method to diagnose mesothelioma is the procedure of a biopsy. Doctors take tissues or fluids from the affected area and then examine them under a microscope to look for mesothelioma cancerous cells.
The type of mesothelioma a person has also affects his or her prognosis. Pleural mesothelioma, which forms in the thin lining around the lungs, is the frequent form of the disease and accounts for the majority of cases diagnosed. Peritoneal cancer, which forms in the lining of the abdomen, is a less common form. In addition, pericardial mesothelioma which is an uncommon type that develops in the heart's lining is more rare and only represents approximately 1percent of cases.
Some of the earliest symptoms include breathlessness that becomes worse over time and a coughing up of blood. Asbestos sufferers may also experience fluid buildup in the chest cavity, which is known as pleural effusion. This can be drained by inserting a needle in the affected region of the chest cavity. In more serious cases, doctors can undergo a procedure called pleurodesis to close the space to stop the reaccumulation of fluid in the pleura.
A precise mesothelioma diagnosis is the best method to determine the patient's treatment options and the survival rate. Chemotherapy, surgery and radiation are all options. Other options include immunotherapy. hillsboro mesothelioma lawsuit is a kind of treatment that increases the immune system to fight mesothelioma cells, and tumor treating fields, which employ a magnetic field to eliminate cancerous cells.
A specialized mesothelioma specialist can also help patients understand the various mesothelioma types, which determine how aggressive the cancer is and what the patient's prognosis is. Patients should discuss with their doctor their experiences with asbestos exposure to determine whether mesothelioma could be an option and what treatment options are available.

Mesothelioma, a rare and fatal disease caused by asbestos exposure, is a rare condition. Asbestos was a time when it was widely used in a variety of industrial and consumer products, including baby powder. In talcum powder cases, plaintiffs claim that exposure to asbestos through inhalation of the powder led to the development of mesothelioma and other health issues.
J&J did not warn the public about the dangers of asbestos and talcum even though they had been aware of their dangers for decades. Plaintiffs have filed mesothelioma lawsuits against the firm seeking damages for punitive and compensatory. These claims have been combined into federal and state multidistrict litigations, or MDLs.
In 2018, one of the largest Talc trials ended in a $4.7 billion verdict for the plaintiff. The news made headlines across the country and set a tone for the rest of the litigation. In the last month, a judge denied a motion by J&J to dismiss the lawsuits brought by the state of Mississippi.
J&J, however, tried again to halt the litigation. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company incorporated an entity that would take on its liabilities. The bankruptcy stopped thousands of talc suits, however, the 3rd Circuit rejected that strategy.
The lawsuits brought by Mississippi are based on the same allegations as those of the individual lawsuits brought against J&J. They assert that the company acted negligently in failing to warn of the possibility of ovarian cancer from talcum powder and that this was an infraction to the law of the state.
J&J has submitted its motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J can be pursued.
