Why Mesothelioma Talc Lawsuit Still Matters In 2023
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma case is the first trial that has been held since J&J filed for bankruptcy and spun off its Talc division.

In the first quarter of the year, huge settlements were reached in talc suits in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Shower and Baby Powder products.

What is Mesothelioma?

Mesothelioma, a deadly form of cancer that affects the mesothelium, or the lining surrounding organs and cavities inside the body. mcallen mesothelioma lawsuit is most often found in the lungs but it can also occur in the abdomen, heart, chest cavity and testicles. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed to asbestos are at risk of developing it.

The first trial after J&J declared bankruptcy over its talcum powder division opened in Oakland, California this week. Jurors were moved by the story of the plaintiff. In 2022, the plaintiff who was just 24 years old at the time, old at the time was diagnosed with malignant mesothelioma in the pericardium. He blamed the reason for his illness to his early use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J has been accused of hiding asbestos risks from the public for a number of years. The company has a long tradition of keeping asbestos information from regulators, and paying for asbestos tests that produced the results they desired. Some of the company's Talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Some women who used talcum to provide feminine hygiene on pads or condoms or in the genital area have been diagnosed with mesothelioma and ovarian cancer. The lawsuits assert that J&J was aware for more than forty years that the powder could cause ovarian cancer and other illnesses, but did not take the time to warn consumers.

Mesothelioma symptoms may include breathing problems, chronic coughing abdominal pain, fatigue, and lumps or masses on the abdomen or chest. Doctors can diagnose the disease by a physical examination and imaging scans. These could include CT (computer tomography) scans, MRIs and PET or X-rays.

Once a mesothelioma diagnosis is confirmed, patients can undergo surgery, chemotherapy and/or radiation. The surgeons are able to remove the affected tissue based on the location of the tumors. Patients with mesothelioma are sometimes given a life expectancy less than five years. However, aggressive treatments like extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy may prolong survival.

What causes Mesothelioma?

Mesothelioma is a type of cancer that is caused by DNA changes within a cell. These mutations can cause uncontrolled growth of cells, which causes tumors to form in tissues. Asbestos is a common cause mesothelioma. Asbestos exposure can occur in many different industries including mining, manufacturing and transportation. Asbestos exposure usually occurs between 20 to 40 years prior to the time symptoms begin to manifest. Men are more likely to develop mesothelioma than females. It is also diagnosed most often in those between the ages 50 and 70. The type of mesothelioma a person gets is often determined by the area of their body in which they were exposed to asbestos. Most people with mesothelioma are diagnosed with pleural mesothelioma which affects the lung. Some are diagnosed with peritoneal mesothelioma, one type of mesothelioma which affects the abdomen. Some people are diagnosed with pericardial mesothelioma. This is an extremely rare type of the disease which affects both the inner lining (pericardium) and the organ itself.

Shortness of breath, fatigue, and abdominal pain are all symptoms of mesothelioma. In the later stages of mesothelioma, tumors can spread to other parts which can cause extreme discomfort and pain. Other symptoms of mesothelioma include fluid in the lungs, nausea difficulties eating and swallowing. Mesothelioma can be fatal.

The trial involving talcum powder in Oakland involved a 24-year-old man who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos, but did not warn consumers. They also cited an 1998 letter to an J&J executive revealing the possibility of asbestos in their products.

This is the latest in a string of large verdicts against J&J. In March the jury handed down $18.8 million to a woman who developed mesothelioma ovarian from J&J's talcum powder. Last month the jury in Missouri awarded $55 million in another case involving the same issue. In addition, seven cases were added to the powder's MDL over the last month which brought the number of lawsuits pending to 37,522. The majority of these lawsuits involve women who used J&J's talcum powder for feminine hygiene purposes.

How Can I tell whether I have mesothelioma or not?

The diagnosis of mesothelioma could be devastating. Patients should consult a specialist to get the most accurate information available and avoid misdiagnosis which could result in unneeded treatment and allow cancer to expand further.

A physical exam and a blood test could be an excellent way to determine whether mesothelioma may be causing symptoms. These tests can check for asbestos fibers in blood or to assess the way in which the organs of a patient are functioning. The most precise method of diagnosing mesothelioma is the procedure of a biopsy. Doctors extract tissue or fluids from the affected area and then examine them under a microscope to look for mesothelioma cancer cells.

The type of mesothelioma that a person has can also influence the prognosis of a patient. Pleural mesothelioma, that forms in the thin lining that surrounds the lungs, is the common form of mesothelioma and accounts for the vast majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that forms in the lining of the abdomen is less prevalent. In addition, pericardial mesothelioma is a rare form of cancer that develops in the lining of the heart. It's only 1percent of all cases.

A shortness of breath that becomes worse over time, and a bloody cough are a few of the initial symptoms. Asbestos victims can also experience fluid accumulation in the chest cavity, which is called pleural effusion. It can be removed by inserting a needle in the affected area of the chest cavity. In more serious cases, doctors may opt to perform pleurodesis, an operation which seals the area to stop the accumulation of fluid within the pleura.

A reliable diagnosis of mesothelioma is essential to determining a patient's survival rate and treatment options. There are a variety of treatments available, including surgery, chemotherapy and radiation. There are also immunotherapy treatments that increases the immune system to fight mesothelioma as well as cancer treating fields that employ a magnetic field in order to kill cancerous cells.

A mesothelioma specialist who is specialized can also help patients understand the different mesothelioma cells, which determine how aggressive the cancer is and what the prognosis for the patient is. Patients should discuss their history of asbestos exposure with their doctor to determine if they're mesothelioma-related and learn about the various types of treatment options are available to them.

Mesothelioma is an extremely rare and fatal condition caused by asbestos exposure, is a rare disease. Asbestos was widely used in many industrial and consumer products like baby powder. In talcum-powder lawsuits plaintiffs claim that asbestos exposure from inhaling the powder led to the development of mesothelioma and other health issues.

J&J was allegedly aware of the risk of asbestos and talcum powder for decades, but did not warn consumers. Plaintiffs have filed lawsuits seeking punitive damages as well as compensatory damages against the company. The claims have been consolidated into state and federal multidistrict litigations, or MDLs.

In 2018 one of the first major Talc trials ended in a $4.7 billion verdict for the plaintiff. This was a major news story that set the stage for the rest of the year. In the last month, a judge denied J&J's request to dismiss the lawsuits filed by the state.

In an attempt to stop the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated a new entity to assume its obligations. The bankruptcy stopped thousands of talc suits, however, the 3rd Circuit rejected that strategy.

The lawsuits filed by Mississippi are based on the same allegations as those of the individual lawsuits brought against J&J. They assert that the company acted negligently in failing to warn consumers of the possibility of ovarian cancer from talcum powder and that this resulted in a violation of state law.

J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to move forward. If you or someone you know has been diagnosed with a mesothelioma or other disease that could be caused by talcum powder, you should seek legal assistance immediately.
