Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with mesothelioma of the pericardium has claimed that Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma case is the first one to be held since J&J spun off its Talc business and filed for bankruptcy.
In the spring of this year, jury awards in New Jersey and California led to massive settlements in talc lawsuits. Plaintiffs attributed cancer to asbestos that was found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a lethal form of cancer that affects the mesothelium, or the lining surrounding organs and cavities within the body. It is most commonly found in the lungs, but it can also occur in the abdomen, heart, chest cavity and testicles. Asbestos, the sole known cause of this disease is asbestos. People who have been exposed are at risk of developing it.
The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional as they heard the testimony of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial cancer in 2022. The plaintiff attributed his condition to childhood exposure to Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J has been accused of obfuscating asbestos-related risks from consumers for a long time. The company has a long history of keeping asbestos information from regulators, and paying for asbestos tests that did not yield the results they wanted. These lawsuits have identified several of the talcum-powder suppliers for the company such as Whittaker Clark & Daniels, Imerys Talc America, and others.
Many women who used talcum powder for feminine hygiene in the genital area or on sanitary napkins, or condoms have developed cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could cause ovarian cancer and other illnesses, but did not take the time to warn consumers.
Mesothelioma symptoms include breathing problems, chronic coughing and abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can diagnose mesothelioma by an examination and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.
After a mesothelioma is diagnosed patients may undergo surgery, chemotherapy, or radiotherapy. The surgeons are able to remove the affected tissue depending on the location of the tumors. Patients with mesothelioma are sometimes given a life expectancy less than five years. However, aggressive treatments such as extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy can prolong the life expectancy.
What causes Mesothelioma?
Mesothelioma, like most cancers is caused by DNA mutations within a cell. These mutations cause uncontrolled cell growth, which causes tumors to form in tissues. Asbestos is the most common cause mesothelioma. Asbestos exposure is common in many different industries including manufacturing, mining, and transportation. Asbestos exposure is typically seen 20 to 40 years prior to the time symptoms begin to manifest. Mesothelioma affects men more than women, and it is usually diagnosed in people in their 50s and 70s. indio mesothelioma law firm of mesothelioma a person is usually determined by the region of their body in which they were exposed to asbestos. The majority of patients diagnosed with pleural msothelioma, which affects the lung. Others are diagnosed with peritoneal mesothelioma, one type of mesothelioma which affects the abdomen. Some people are diagnosed with pericardial msothelioma. This is an extremely rare form of the disease which affects both the lining (pericardium) as well as the organ itself.
The symptoms of mesothelioma are shortness of breath, fatigue abdominal pain and weight loss. In the final stages of mesothelioma, the tumors can spread to other areas of the body which can cause severe pain and discomfort. Other symptoms of mesothelioma include fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma is a debilitating illness, and it can be fatal.
The talcum powder trial in Oakland involved a man of 24 who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers claimed that J&J knew that talc might contain asbestos and didn't warn consumers. They also cited a 1998 letter to a J&J executive that revealed the possibility of asbestos in their products.
This is the latest in a series of large verdicts against J&J. In March, J&J's Talcum powder caused ovarian mesothelioma in a woman. Last month, another jury in Missouri awarded $55 million in the same case. In addition, seven cases were added to the talcum powder MDL in the last month which brought the number of pending lawsuits to 37,522. The majority of these lawsuits involve women who have used J&J's talcum powder for feminine hygiene reasons.
How do I know If I Have Mesothelioma?
A diagnosis of mesothelioma may be devastating. Patients should consult an expert to obtain the most accurate diagnosis possible and prevent misdiagnosis that could lead to unneeded treatment and allow cancer to spread more.
A physical exam and a blood sample can help to identify mesothelioma signs. These tests can be used to test for asbestos fibers in blood, or the health of the patient's internal organs. The most accurate way to identify mesothelioma is with a biopsy, where doctors remove tissue or fluid from the affected area and then examine the area under a microscope to detect mesothelioma-related cells.
The type of mesothelioma that a person is suffering from also affects the likelihood of a positive outcome. Pleural mesothelioma that develops in the thin lining that surrounds the lungs, is the common form of the disease and makes up the majority of diagnosed cases. Peritoneal cancer, which develops in the lining surrounding the abdomen is a less well-known form. In addition, pericardial mesothelioma which is a rare type of cancer that develops in the lining of the heart, is more rare and only makes up about 1percent of cases.
Some of the first symptoms include shortness of breath that gets worse over time, and then coughing up blood. Asbestos sufferers may also experience fluid accumulation within the chest cavity. This condition is called Pleural effusion. The fluid can be drained from the chest cavity by inserting a needle into the affected area. In more serious cases, doctors can perform a procedure called pleurodesis to close the space to prevent reaccumulation of fluid in the pleura.
Getting an accurate mesothelioma diagnosis is the most reliable way to determine a patient's treatment options and the survival rate. There are many treatments available that include surgery, chemotherapy and radiation. There are also immunotherapy treatments that boosts the immune systems to fight mesothelioma and treatment fields for tumors that utilize a magnetic field in order to kill cancerous cells.
A mesothelioma specialist who is specialized can help patients understand the different mesothelioma cell types, which determine how aggressive the cancer is and what the patient's prognosis is. Patients should discuss with their doctor their experiences with asbestos exposure to determine whether mesothelioma could be an option and what treatment options are available.

The plaintiffs in talcum powder cases claim that inhaling talcum powder caused to their exposure to asbestos which led to mesothelioma as well as other health issues.
J&J did not inform the public about the dangers of asbestos and talcum even though they had been aware of their dangers for decades. Plaintiffs have filed mesothelioma lawsuits against J&J seeking punitive and compensatory damages. The claims have been consolidated into state and federal multidistrict litigations, or MDLs.
In 2018 one of the largest trial involving talc resulted in an $4.7 billion verdict for the plaintiff. This was a major news story and set the precedent for the rest of the year. Last month, a court denied J&J's motion to dismiss the lawsuits brought by the state.
However, in an attempt to stop the litigation, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated an entity to take over its obligations. The bankruptcy ended the filing of thousands of talc lawsuits, but the 3rd Circuit rejected that strategy.
The lawsuits brought by Mississippi are based upon the same allegations as those of the individual lawsuits brought against J&J. They claim that the company was negligent in not warning of the risk of ovarian carcinoma from talcum-powder and that this resulted in a violation of state law.
J&J has submitted its motion to dismiss the lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J can continue.
