Motor Vehicle Legal Terms
The laws governing motor vehicles differ widely from state to state. In general the law assumes a vehicle is being operated with the permission of the owner.
Laws enhancing penalties that make revocation automatic or targeting social hosts have varying impacts on mortality rates. All of these measures, such as mandatory education, alcohol treatment and interlock devices, have only a little impact.
Legal Definitions
State laws govern the legal definitions of motor vehicles. The federal definitions of national standards for fuel economy and licensing standards for drivers of commercial vehicles are mostly administrative and are not applicable when states determine their own classifications for registration. The classifications of a vehicle determine if a motorist requires an exclusive license to operate certain types vehicles.
The state laws define the terms "automobile," "light truck" and many others. As an example light truck, it is any vehicle with a capacity that is less than 7,500 pounds. This excludes panel delivery trucks and pickup trucks. This includes any vehicle or combination that is designed to carry passengers or property within its own structure. This includes manufactured homes and trailers.
A wheel chair conveyance is a device with wheels. It is typically used by those who, due to physical disability, are unable to move about as pedestrians. A moped is an automobile with no more than three wheels on the ground, and that can travel at the speed of 35 miles per hour.
A pedicab is a vehicle that is driven by an operator who sits on it. A person who holds the legal title to a vehicle is known as its owner.
Traffic Laws
Each state has its own set motor vehicle laws that cover everything from registration procedure to insurance requirements. These laws also address the kinds of vehicles that are protected by law. Some of these laws are identical across states, while other laws differ significantly. There are laws that limit the number of people that can be transported by pedicab. There are laws that ban reckless driving on certain kinds of roads, including parking areas.
If you violate these laws, you could be punished with a fine and/or a penalty. The penalties could vary from having your driver's license suspended or being required to attend the traffic school.
The law governing speed limits on roads is one of the most important laws that states have. In New York for example, the speed limit is the same for commercial vehicles as well as automobiles.
The law also defines the definition of a "motor vehicle." This includes every description of a carriage or other device that is driven by mechanical power and used on a highway to transport people or property or for any other commercial purpose. The law does not include trailers, coaches and semitrailers, all-terrain and snowmobile vehicles, motorized mobility assist devices operated by people with disabilities as well as self-propelled corn and hay harvesting machines.
Insurance
A motor vehicle policy is a contract which protects the insurer against financial losses in the event of bodily injury or death or property damage caused by a third-party that results from the maintaining, operating or use of an insured vehicle. It can also offer protection against physical damage to the covered vehicle itself. It must include the name and address of the named insured as in addition to the coverage offered by the policy. It also contains the amount of premium paid and the time frame for which the policy is in force, and the responsibility limits. It must also contain an agreement or endorsement that insurance is provided thereunder in conformity with the coverage set out in the policy for injuries to the body, property damage or death and is subject to all provisions of this chapter.
The wording in the motor vehicle policy could be confusing for the average person. Duncanville law firms often suggest that individuals read the policy sample to fully know the terms. One of the biggest areas of confusion is the definition of the term "motor vehicle." The phrase appears frequently in statutes governing registration of vehicles as well as financial responsibility laws.
Examples of coverages offered under a motor insurance policy include commercial auto coverage for vehicles used for business, commercial establishments or other activities, employment or occupations that are performed for profit, automobile liability insurance, which includes PIP MP, MP, as well as uninsured and underinsured driver coverage (UM/UIM). Many states require drivers to have this type of insurance.
Permissive Use
If someone other than the named insured or a family member drives your vehicle and gets into an accident, it's important to understand the insurance coverage that is available in these circumstances. motor vehicle accident lawyer flower mound is known as permissive use. The specific terms of your policy could differ but generally, the majority of large car insurance companies offer this type of coverage.
However, it is important to note that the person driving your car must have your permission to be held liable for any damage. Permission may be express or implied, and does not usually need to be in writing.
In determining whether there is implied consent, courts will consider the relationship between the parties, their prior conduct and use of the vehicle and the circumstances surrounding a particular driving incident. A court will also look at the extent to which restrictions were imposed on the scope of permissive use and if even an unintentional deviation from the date, time, and location limitations of the original permission would violate these limitations.
Remember that adding a driver to your auto insurance policy will increase your premium, because the vehicle becomes more difficult to insure. Therefore, it is important to weigh your options carefully before giving your vehicle over to others.
