Legality

To create CBD for use in consumer products, it is required to process the entire plant, including flowers and leaves. This results in a CBD Isolate' product, but it does contain varying amounts of other phytocannabinoids in the plant.

The levels of these other phytocannabinoids can vary among different varieties of cannabis and even between plants grown under the same conditions. There aren't many studies on the psychoactive effects these other phytocannabinoids exhibit at levels that could be present in CBD products for consumers. Therefore, for this reason it was decided it is appropriate to limit the levels of 9-THC and its precursor (9-THCA) in consumer CBD products to a level at which they are not likely to have significant psychoactive effects.

The other phytocannabinoids that were controlled were also not restricted because they are difficult and costly to measure. Limits could also result in unnecessary restrictions for the producers. In addition there is a lack of evidence that the other phytocannabinoids have any significant clinical effects.

The Working Group concludes by recommending that the maximum amount of 9-THC or 9THCA per unit of consumption in a CBD product for use by consumers be set at 50 milligrams. This limit should be checked every two years. The Working Group also recommends Dstl to analyze the controlled phytocannabinoids found in consumer CBD products to make sure that the limits are being met.

The recommendations of the Working Group are based on research as well as government reports (UK & international) as well as an ACMD call for evidence (ACMD, 2020) and the previous ACMD report. Additionally, the Group has had discussions with representatives of industry, and with personnel from the Defence Science and Technology Laboratory and the Government Chemist's Team.

A limit on THC is in place in the UK but there are other regulations that must be followed by manufacturers of CBD products. For instance, food items and drinks that contain CBD must conform to the latest food regulations that means they have to be approved by authorities before being sold. This could take up to a year, and can cost tens or even hundreds of thousands of pounds.

In 2023 the legal CBD oils will remain legal to purchase in the UK provided they contain at least 1mg of THC per bottle.
