Davacının iddialarına karşı, benim aleyhime verilen kararda hatalı bir uygulama olduğuna inanmaktayım. Öncelikle, davacının Mevlana Mahallesi'ndeki kira borcu iddiasının gerçeği yansıtmadığına dair elimde delil bulunmaktadır.
Mahkeme kararında belirtildiği üzere, itiraz hakkım olduğu iddia edilmektedir. İtirazda bulunduğumu beyan etmek isterim.
Kira Borcunun Ödenmediği İddiasına dair davacının iddiasına karşı,belgelerle kira borcunu ödediğimi ispatlamam gerektiğinin farkındayım ve bu belgeleri mahkemeye sunmaya hazırım.
Mahkeme kararının birinci bendinde belirtildiği gibi, mahkemenin vereceği hüküm yeterince açık olmalıdır. Ancak, kararın ayrıntıları konusunda belirsizlik ve tereddüt mevcuttur. Bu nedenle, HMK'nun 305. maddesine dayanarak hükmün düzeltilmesini talep ediyorum.
