However, to produce CBD for sale in consumer products it is necessary to process the whole plant, including flower and leaves. This creates a 'CBD isolate product, however it is still a mixture of other phytocannabinoids from the plant.

The concentrations of these additional phytocannabinoids vary between different varieties of cannabis and even between the plants grown under similar conditions. There isn't much information on the psychoactive effects of these other phytocannabinoids at levels that are likely to be present in consumer CBD products. It was therefore decided to limit the concentrations (9-THC) and its precursor (9 -THCA) in consumer CBD products to a level which is unlikely to cause significant psychoactive effect.

It was also agreed that no limit should be established for the other controlled phytocannabinoids, since it is very difficult to measure these, and setting a limit for them might put unnecessary restrictions on producers. In addition there is little evidence that the other phytocannabinoids cause any beneficial effects on humans.

The Working Group concludes by recommending that the maximum limit of 9-THC or 9-THCA per unit of consumption in the case of a CBD product for consumer use be set at 50 milligrams. This limit should be reviewed after two years, and the Working Group also recommends that an analysis of the controlled phytocannabinoids in consumer CBD products be conducted by Dstl to ensure that these limits are being met.

The Working Group has based its recommendations on the literature available as well as government reports (UK and international) and a request for evidence by the ACMD (ACMD 2021, 2021) and earlier ACMD reports. The Group has also had discussions with representatives from industry, as well with staff at the Defence Science and Technology Laboratory and Government Chemist's Team.

A Defence Science and Technology Laboratory study of 43 commercial CBD products found that 16 (37 percent) had more than 5mg of 9-THC. This can result in psychoactive effects comparable to standard alcohol units (Defence Science and Technology Laboratory 2020a).

A limit on THC is in place in the UK however there are other regulations to be followed by manufacturers of CBD products. For instance, food and drinks containing CBD must be in compliance with the novel food regulation that means they must be approved by the authorities before going on sale. This could take up to a year and can cost tens of thousands of pounds.

In 2023, CBD oils that comply with UK law will be legal to buy in the UK in the event that they do not contain more than 1mg of THC per bottle.
