Legality

The UK CBD market has grown largely because of the availability of high-quality, non-psychoactive marijuana. There are still concerns about the legality of CBD. Oil is the most commonly used type of CBD and is used in a variety of products, including health supplements and cosmetics. These products are typically available on the internet and in retail stores all over the nation. CBD contains cannabidiol which offers a variety of therapeutic properties. It also contains other phytocannabinoids, such as CBG, CBN, and CBC. These phytocannabinoids may help regulate the effects THC is the chemical responsible for the euphoric feeling that is associated with marijuana. THC induces euphoria through activation of specific receptors in the brain. These receptors are known as the endocannabinoid systems.

The CBD found in consumer products like gummies and vape juice originates from the low-THC cannabis, or 'hemp' plant. This exemption only allows for the presence of less than one percent THC in the product and only when certain conditions are satisfied.

This is creating confusion in the market. For example, some vape shops believe that the limit of THC for CBD vape juice is 0.2 percent. This is not true. The legal limit of THC in CBD vape liquid is 1mg/bottle/container.

The Home Office has recently published an analysis of the legality of CBD. It refers to peer-reviewed scientific literature and government reports (UK and international) and a request for evidence made by the ACMD and a previous ACMD guidance. The report concludes that the current conditions are not sustainable and recommends the development of a legal framework to regulate CBD for consumers.

Benefits

The UK CBD market continues to grow and consumers are becoming more interested in the potential benefits of this cannabinoid. It is a non-psychoactive cannabis that is available in products like capsules, edibles, drinks and vaping liquids. It can also be found in hemp oil, which can be found in the market and in a few health food stores. CBD oils in my area of hemp oil has led to certain untruthful manufacturers making false claims about its benefits. It is important for consumers to know the distinction between different kinds of CBD.


The CBD in most of the UK products currently available originates from a plant known as Industrial Hemp or 'Cannabis Sativa L.' This plant is grown under a license to grow low-9-THC cannabis for fibre and seeds and has a broad range of uses including clothing, paper rope, building materials, and rope. Farmers are required to remove plants that have more than 1 mg of THC. This is a requirement of the license because tetrahydrocannabinol (THC) is a psychoactive and can lead to an 'high' sensation.

CBD extracted from the plant doesn't have psychoactive effects, but it does contain phytocannabinoids such as CBN, THC, and CBC. These phytocannabinoids have no physical or mental effects, but they do help to regulate the balance of neurotransmitters inside the body. This helps promote calm and decrease the risk of anxiety and depression.

Trading Standards monitor the market and may seize any product making claims about health or medical benefits that does not have an authentic Novel Food Authorisation from the FSA. The Chartered Institute of Trading Standards is also surveying the market and this may include tests in the lab of CBD products sold in shops.

Dosage

Industrial hemp, also referred to as Cannabis Sativa L, is cultivated mostly for its fibres, seeds and a small amount of psychoactive THC. The plant must be grown under an official Home Office licence, which permits cultivation only for preparations that have the mature stalk, fibre or seeds - not flowers and leaves. To produce CBD for use in consumer products the entire plant has to be processed including the flower as well as leaves. This creates a 'CBD isolate product, but it does contain varying amounts of other phytocannabinoids found in the plant.

Even plants that are grown in similar conditions may have different levels of phytocannabinoids. There is limited information about the psychoactive effects of these other phytocannabinoids at levels that are likely to be present in consumer CBD products. Therefore, it was determined to limit the concentrations (9-THC) and its precursor (9 -THCA) in the consumption of CBD products, to a level that is unlikely to cause significant psychoactive effect.

It was also agreed that no limit should be set for the other controlled phytocannabinoids as it is difficult to measure these and establishing limits for them could place unnecessary restrictions on producers. In addition there is a lack of evidence that these other phytocannabinoids have any significant clinical effects.

The Working Group concludes by recommending that the maximum limit of 9-THC or 9THCA per unit of consumption in a CBD product for use by consumers be set at 50 milligrams. This limit should be checked every two years. The Working Group also recommends Dstl to analyze the phytocannabinoids that are controlled in consumer CBD products, so that they can verify that the limits are being adhered to.

The Working Group has based its recommendations on the available literature and government reports (UK and international), a call for evidence by the ACMD (ACMD 2021, 2021) and prior ACMD reports. The Group has also had discussions with representatives from industry as well as with staff from the Defence Science and Technology Laboratory and Government Chemist's Team.

Safety

The CBD that is sold in CBD products in the UK mostly comes from the Cannabis sativa L plant (hemp). The majority of hemp in the UK is harvested for its fibers, which are used in clothes, rope and building materials. The bud and flower of the plant are not consumed. Farmers are required to remove or leave the flowers and bud to decay on the farm. They are only able to harvest the seeds and stalks to make hemp oil, tinctures and other CBD-rich products.

The bulk of the consumer CBD products contain a mix of other phytocannabinoids as well as CBD. These other phytocannabinoids include trans-dimethyl-tetrahydrocannabinol ( The Misuse of Drugs Act of 1971 regulates cannabinoids, including 9-THC as well as other cannabinoids. It is challenging to extract these phytocannabinoids controlled by the law from CBD products, and it is impossible to determine the concentration of these cannabinoids present in the final CBD product.

In the absence of legislation that requires testing for controlled phytocannabinoids in the foods and beverages, the 9-THC levels in consumer CBD products can differ greatly. A Defence Science and Technology Laboratory investigation of forty-three commercial CBD products found that sixteen (37 percent) contained more than 5 mg of 9THC, an amount that could cause psychoactive effects comparable to a standard alcohol unit (Defence Science and Technology Laboratory report 2020a).

A limit on THC is in place in the UK but there are many other regulations that must be followed by manufacturers of CBD products. Food and drinks that contain CBD must, for example be in compliance with new food regulations, which means that they must be approved before being sold. This can take a year and cost tens or even hundreds of thousands of pounds.

In 2023, CBD oils that comply with UK law will be legal to buy in the UK as long as they do not contain more than 1mg THC per container. However, there are some products that aren't regulated and these are unlikely to stay on the market for long, given the evidence of their harms. Police will seize these products that are not regulated. For this reason, consumers should only purchase products from trusted manufacturers.
