Mesothelioma Talc Lawsuit Tips That Will Transform Your Life
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old man with mesothelioma pericardial has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case is the first trial to be held since J&J filed for bankruptcy and spun off its Talc division.

This year, juries awards in New Jersey and California led to big settlements in talc lawsuits. Plaintiffs attributed their cancer to asbestos in J&J's Shower Shower and Baby Powder products.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects the mesothelium the lining around organs and body cavities. It is most prevalent in the lungs, but it can also be found in the abdomen and chest cavity. Asbestos, the only known cause of this disease, is asbestos. People who have been exposed to asbestos are at chance of developing it.

The first trial since J&J declared its Talcum Powder division bankrupt was opened this week, and jurors in Oakland, California were emotional as they listened to the testimony of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial cancer in 2022. He attributed the reason for his illness to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $25 million.

J&J is accused of hiding asbestos risks from consumers for many years. The company has a long track record of concealing asbestos-related information from regulators, as well as paying for asbestos tests that did not yield the results they desired. The lawsuits have identified a number of the talcum-powder suppliers for the company, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.

Many women who used talcum powder to maintain feminine hygiene in the genital area or on sanitary napkins or condoms have developed cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than 40 years that the powder could trigger ovarian cancer and other diseases, but failed to warn consumers.

Mesothelioma symptoms include breathing difficulties, constant coughing and fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can diagnose the condition through a physical exam and imaging scans. These may include CT (computer tomography) scans, MRIs and PET or X-rays.

When a mesothelioma diagnosis is confirmed, patients may undergo surgery, chemotherapy and/or radiation. The surgeons can remove affected tissue depending on the location of the tumors. Patients with mesothelioma are sometimes given a life expectancy of less than five years, however aggressive treatments like extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy can prolong survival.

What Causes Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA mutations in a cell. These mutations cause uncontrolled growth of cells, which forms tumors in tissues. Asbestos is a frequent cause of mesothelioma. Exposure to asbestos can occur at work in a variety of fields, including manufacturing, mining, construction and transportation. Asbestos is typically exposed 20 to 40 years prior to the onset of symptoms appearing. Men are more likely to develop mesothelioma than women. It is also found most often in those between the ages 50 and 70. The type of mesothelioma a person gets is often determined by the area of their body that were exposed to asbestos. The majority of patients diagnosed with pleural msothelioma, which affects the lung. Other patients are diagnosed with peritoneal mesothelioma. This type of mesothelioma affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is a rare form of cancer that affects both the inner lining (pericardium) as well as the organ itself.

Shortness of breath, fatigue, and abdominal pain are all symptoms of mesothelioma. In the late mesothelioma stages, the tumors may spread to other areas of the body creating severe pain and discomfort. Other signs of mesothelioma are fluid in the lung, a loss of appetite difficulties eating and swallowing. Mesothelioma is a terminal illness that is usually fatal.

The talcum-powder case in Oakland involved an individual of 24 who developed pericardial mesothelioma as a result of using J&J baby powder. His lawyers argued that the company knew that talc might contain asbestos, but didn't inform consumers. They also cited an 1998 letter addressed to a J&J executive that revealed the possibility of asbestos in their products.

This is only the latest in a string of major verdicts against J&J. In March, a jury handed down $18.8 million to a woman who contracted mesothelioma of the ovarian tract from J&J's powder, and last month a jury in Missouri awarded $55 million in another case involving the same issue. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the number of lawsuits pending. The majority of these lawsuits involve women who used J&J's Talcum powder to wash their feminine hygiene.

How Can I Tell If I Have Mesothelioma?

A diagnosis of mesothelioma is devastating. Patients should always see an expert to obtain the most accurate diagnosis possible and avoid misdiagnosis that could lead to unneeded treatment and let cancer grow.

A physical examination and blood test could be a good start to identify whether mesothelioma has caused symptoms. These tests can be used to test for asbestos fibers in blood, or the health of a patient's internal organs. The most reliable method to diagnose mesothelioma is the procedure of a biopsy. Doctors take tissues or fluids from the affected area, and examine them under a microscope for mesothelioma cancer cells.

The type of mesothelioma that a person has also affects the likelihood of a positive outcome. Pleural mesothelioma, which forms in the thin lining that surrounds the lung, is the most common form of mesothelioma and accounts for the vast majority of cases diagnosed. Peritoneal cancer, which develops in the lining surrounding the abdomen, is a less common type. The pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is more rare and only accounts for around 1% of cases.

Shortness of breath, which becomes worse over time, and a bloody cough are some of the first symptoms. lawsuit attorneys mesothelioma may also experience fluid accumulation within the chest cavity. This condition is called pleural effusion. It can be removed by inserting a needle into the affected area of the chest cavity. In more severe cases, doctors might perform pleurodesis. This is which is a procedure which seals the area to stop fluid from accumulating again in the pleura.

Making sure that mesothelioma is diagnosed correctly is the best way to determine the patient's treatment options and survival rate. There are a myriad of options for treatment which include chemotherapy, surgery and radiation. Other options include immunotherapy. It is a form of treatment that enhances the immune system to fight mesothelioma cancer cells, and tumor treating fields, which uses the power of magnets to eliminate cancerous cells.

A specialized mesothelioma specialist can help patients understand the different mesothelioma cells that determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their physician their experience with asbestos exposure to determine if mesothelioma is an option and what treatment options are available.

Mesothelioma, an uncommon and fatal illness caused by asbestos exposure, is a rare disease. Asbestos was once used extensively in a variety of consumer and industrial products, including baby powder. In talcum-powder lawsuits, plaintiffs claim that exposure to asbestos from inhaling the powder caused them to develop mesothelioma, or other health issues.

J&J believed to have known about the dangers of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed lawsuits seeking punitive damages as well as compensatory damages against the company. These lawsuits have been consolidated in state and federal multidistrict lawsuits, or MDLs.

In 2018 one of the biggest talc cases led to a $4.7 billion verdict in the favor of the plaintiff. This was a major news story that set the tone for the rest. Last month, a court denied J&J's motion to dismiss the lawsuits brought by the state.

J&J, however, tried to stop the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company created an entity to take over its obligations. The bankruptcy stopped thousands of talc suits, but the 3rd Circuit rejected that strategy.

The lawsuits brought by the state of Mississippi are built on the same allegations as the individual lawsuits against J&J: that the company's inability to warn of the dangers of ovarian cancer caused by talcum powder was negligent and violated the law of the state.

J&J has resubmitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing is scheduled for June to decide whether the lawsuits against J&J will be allowed to proceed. If you or someone you know has been diagnosed with a mesothelioma or other disease which could be caused by talcum powder you should seek legal assistance immediately.
