5 Motives Mesothelioma Talc Lawsuit Is Actually A Beneficial Thing
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is the first to proceed since J&J spun off its talc business and filed for bankruptcy.

In the beginning of the year, substantial settlements were made in talc cases in New Jersey and California. Plaintiffs linked cancer to asbestos in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects the mesothelium the lining that surrounds organs and body cavities. It is most commonly found in the lungs, but it can also occur in the abdomen, the heart, chest cavity and testicles. Asbestos is the most well-known cause of mesothelioma, and people who have been exposed to asbestos are at a higher risk of developing this disease.

The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional when they heard the story of the plaintiff. The plaintiff, who is only 24 years old, was diagnosed with malignant pericardial cancer in 2022. He blamed his condition on childhood exposure to Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J has been accused of concealing asbestos risks from consumers for decades. The company has a long history of concealing asbestos-related information from regulators, and paying for asbestos tests that produced the results they desired. Several of the company's talcum powder suppliers have been named in these lawsuits, including Whittaker, Clark & Daniels and Imerys Talc America.

Women who used talcum for feminine hygiene on sanitary pads or condoms or in the genital region have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than forty years that the powder could cause ovarian cancer as well as other illnesses, but failed to warn consumers.

Mesothelioma symptoms can include breathing problems, chronic coughing and abdominal pain, fatigue and lumps or masses on the chest or abdomen. Doctors can identify the disease by a physical examination and imaging scans. These may include CT (computer tomography) scans, MRIs and PET or X-rays.

When a mesothelioma diagnosis is confirmed, patients can undergo chemotherapy, surgery, or radiation. Depending on the location of their tumors, surgeons may be able to remove the affected tissue. Some patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal tissue transplantation or cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong survival.

What causes Mesothelioma?

Mesothelioma, like most cancers is caused by DNA mutations within a cell. These mutations lead to uncontrolled cell growth, which creates tumors in the tissues. Asbestos is a frequent cause of mesothelioma. Asbestos exposure is common in a variety of industries, including mining, manufacturing and transportation. Asbestos is usually exposed for between 20 and 40 years prior to the onset of symptoms developing. Mesothelioma is more prevalent in men than women, and is most commonly diagnosed in those in their 50s and 70s. The type of mesothelioma that a person gets is often determined by the area of their body in which they were exposed to asbestos. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma which affects the lung. Others are diagnosed as having peritoneal mesothelioma. This kind of mesothelioma affects the abdomen. Some people are diagnosed with pericardial mesothelioma. This is an extremely rare type of cancer that affects both the liner (pericardium), and the organ itself.

Mesothelioma symptoms include fatigue, shortness of breath and abdominal pain, as well as weight loss. In the latter stages of mesothelioma, the tumors can expand to other parts of the body, causing severe discomfort and pain. Other signs of mesothelioma are fluid in the lungs, loss of appetite and difficulty swallowing and eating. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a man of 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers argued the company knew that talc was contaminated with asbestos, but did not inform customers. They also cited a letter from 1998 to a J&J executive which revealed asbestos could be present in their products.

This is the latest in a string of major verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. Last month, another jury in Missouri handed down $55 million in the same case. In addition, seven cases were added to the talcum powder MDL over the last month which brought the total number of lawsuits pending to 37,522. The majority of these lawsuits involve women who used J&J's Talcum powder for feminine hygiene purposes.

How Can I tell whether I have mesothelioma or not?

A diagnosis of mesothelioma could be devastating. Patients should consult an expert for the most accurate information available and prevent misdiagnosis that could result in unneeded treatment or allow cancer to grow.

A physical examination and a blood test is an excellent way to determine whether mesothelioma is causing symptoms. These tests can detect asbestos fibers in blood or to determine the extent to which a patient's organs are functioning. The most reliable method to diagnose mesothelioma is taking a biopsy. www.accidentinjurylawyers.claims/mesothelioma/navigating-the-legal-process-how-to-file-a-mesothelioma-lawsuit/ take tissues or fluids from the affected area and then examine them under a microscope to look for mesothelioma cancer cells.

The type of mesothelioma that sufferers have can affect his or her prognosis. Pleural mesothelioma, the most commonly encountered type of disease and is responsible for the majority of cases diagnosed. Peritoneal mesothelioma is a type of cancer that is found in the lining of the abdomen, is less common. The pericardial mesothelioma, an uncommon type that develops in the heart's lining is much less common and makes up around 1% of cases.

The first signs include a shortness of breath which gets worse with time, and then coughing up blood. Asbestos patients can also experience fluid accumulation in the chest cavity. This condition is called pleural effusion. The fluid can be eliminated from the chest cavity by inserting an needle into the affected area. In more serious cases, doctors can undergo a procedure called pleurodesis to close the space to stop the reaccumulation of fluid in the pleura.

Making sure that mesothelioma is diagnosed correctly is the best way to determine a patient's treatment options as well as their survival rate. Surgery, chemotherapy, and radiation are all options. Other options include immunotherapy, which is a form of treatment that enhances the immune system to fight mesothelioma tumors and tumor-targeting fields, which use a magnetic field to kill cancerous cells.

A specialist in mesothelioma can also help patients understand the different mesothelioma cells which determine how invasive the cancer is and what the prognosis for the patient is. Patients should discuss with their doctor their experience with asbestos exposure to determine whether mesothelioma is an option and what treatment options are available.

Mesothelioma is an uncommon and fatal illness caused by asbestos exposure, is a rare condition. Asbestos was once widely used in a variety of consumer and industrial products, including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder caused to their asbestos exposure and subsequently mesothelioma and various other health issues.

J&J believed to have known about the risk of asbestos and talcum powder for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. These lawsuits have been amalgamated into federal and state multidistrict litigations, or MDLs.

In 2018, one of the first major trial involving talc resulted in a $4.7 billion verdict for the plaintiff. This was a national news story and set the precedent for the rest. Last month, a court denied J&J's request to dismiss the lawsuits filed by the state.

J&J however, attempted again to halt the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company created a new entity to assume its obligations. The bankruptcy stopped hundreds of talc suits however, the 3rd Circuit rejected that strategy.

The lawsuits brought by the state of Mississippi are based on the same allegations as the individual lawsuits filed against J&J which allege that the company's inability to warn of the dangers of ovarian cancer resulting from the talcum powder was negligent and violated state law.

J&J has submitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing has been scheduled for June in order to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone you know has been diagnosed with mesothelioma, or any other condition that could be caused by talcum powder you should seek legal advice immediately. Our skilled lawyers can assist you in obtaining the compensation you deserve.
