Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has mesothelioma of the pericardium has claimed that Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma case marks the first trial that has been held since J&J filed for bankruptcy and spun off its talc division.

In the first quarter of the year, substantial settlements were made in talc lawsuits in New Jersey and California. Plaintiffs linked their cancer to asbestos found in J&J's Shower Shower and Baby Powder products.

What is Mesothelioma?

Mesothelioma is a lethal form of cancer, affects the mesothelium or lining around organs and cavities inside the body. It is most prevalent in the lungs, but it can be found in the chest and abdomen cavity. Asbestos, which is the only known cause of this disease, is asbestos. People who have been exposed to asbestos are at risk of developing it.

The first trial after J&J declared bankruptcy over its talcum powder division opened in Oakland, California this week. Jurors were moved by the story of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial cancer in 2022. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $26 million.

J&J is accused of obfuscating asbestos risks from consumers since decades. The company has a long history of hiding asbestos information from regulators, and even paying for asbestos tests that produced the results they wanted. These lawsuits have identified several of the company's suppliers of talcum powder, including Whittaker Clark & Daniels, Imerys Talc America, and others.

Many women who used talcum powder to maintain feminine hygiene in the genital area or on sanitary napkins or condoms have gotten cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could trigger ovarian cancer and other diseases, but failed to warn consumers.

Mesothelioma symptoms include abdominal pain, abdominal swelling, abdominal lumps and a persistent cough. Doctors can identify the disease by a physical examination and imaging scans. These could include CT (computer tomography) scans, MRIs and PET or X-rays.

Once a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. The surgeons are able to remove the affected tissue depending on the location of the tumors. Patients with mesothelioma may have a life expectancy less than five. However aggressive treatments like extracorporeal transplantation of tissue and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the duration of survival.

What is the cause of Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA mutations in a cell. These mutations cause cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is the most common cause mesothelioma. Asbestos exposure can occur in many different industries including manufacturing, mining, and transportation. Asbestos exposure typically occurs 20 to 40 years before symptoms develop. Mesothelioma is more prevalent in men than women, and is most often diagnosed in people in their 50s to 70s. The type of asbestos-related mesothelioma that someone develops is often determined by the location they were exposed. Most people with mesothelioma are diagnosed with pleural mesothelioma, which affects the lungs. Some are diagnosed with peritoneal mesothelioma, which is a mesothelioma type that affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is an extremely rare form of cancer that affects both the inner lining (pericardium) as well as the organ itself.

The symptoms of mesothelioma are shortness of breath, fatigue abdominal pain and weight loss. In the latter stages of mesothelioma, the tumors can grow to other areas which can cause extreme discomfort and discomfort. Other common symptoms of mesothelioma include swelling of the lungs (pleural effusion) and a loss of appetite, difficulty swallowing and a blockage within the small intestine, referred to as a obstruction in the bowel. Mesothelioma can be fatal.

visit my webpage in Oakland involved a man aged 24 who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos, but didn't warn customers. They also cited a letter from 1998 to a J&J executive that revealed the possibility of asbestos in their products.

This is only the latest in a string of major verdicts against J&J. In March the jury handed down $18.8 million to a woman who was diagnosed with mesothelioma of the ovarian tract from J&J's powder, and last month the jury in Missouri awarded $55 million in a separate case involving the same issue. In addition, seven new cases were added to the talcum powder MDL over the last month, bringing the total number of lawsuits pending to 37,522. The majority of these lawsuits are brought by women who have used J&J talcum powder to maintain their feminine hygiene.

How Can I tell whether I have mesothelioma not?

A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to ensure the most accurate diagnosis and to avoid misdiagnosis, which could lead to unneeded treatment and the spread of cancer.

A physical examination and a blood sample can help identify mesothelioma symptoms. These tests can be used to check for asbestos fibers in blood or the health of a patient's internal organs. The most accurate method to diagnose mesothelioma is the procedure of a biopsy. Doctors take tissues or fluids from an affected area and then examine them under a microscope to look for mesothelioma tumor cells.

The type of mesothelioma that a person has also affects the prognosis of their patient. Pleural mesothelioma, that forms in the thin lining that surrounds the lungs, is the common form of the disease and makes up the majority of cases diagnosed. Peritoneal mesothelioma, a cancer that develops in the lining of the abdomen is not as common. Lastly, pericardial msothelioma is a rare type that occurs in the lining the heart. It only accounts for 1percent of all cases.

The breath is short, and is more severe with time, and a bloody cough are some of the first symptoms. Asbestos patients can also experience fluid accumulation within the chest cavity. This is known as Pleural effusion. This can be drained by inserting a needle into the affected area of the chest cavity. In more severe cases doctors may opt to perform pleurodesis, a procedure that seals the space to stop the accumulation of fluid in the pleura.

Getting an accurate mesothelioma diagnosis is the best method to determine the patient's treatment options and the survival rate. There are many options for treatment that include surgery, chemotherapy and radiation. Other options include immunotherapy. It is a kind of treatment that increases the immune system to fight mesothelioma cells, and tumor treating fields, which uses a magnetic field to kill cancerous cells.

A mesothelioma expert can also assist patients in understanding the different mesothelioma types, which determine the severity of the cancer and the patient's outlook. Patients should discuss their experience of exposure to asbestos with their physician to determine if they are mesothelioma-related and discover what kinds of treatment are available to them.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos used to be widely used in a variety of industrial and consumer products, including baby powder. In talcum-powder cases, plaintiffs claim that asbestos exposure from inhaling the powder caused them to develop mesothelioma, or other health issues.

J&J was allegedly aware of the dangers of asbestos and talcum powder for a long time, but failed to warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. These claims have been consolidated in state and federal multidistrict litigations, or MDLs.

In 2018, one of the first large Talc trials ended in a $4.7 billion settlement for the plaintiff. It was a national news story that set the tone for the rest. Last month, a court denied J&J's request to dismiss the lawsuits filed by the state.

However, in an attempt to stop the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated a new entity to assume its liabilities. The bankruptcy was able to halt the talc lawsuits of thousands, however, the 3rd Circuit rejected this strategy.

The lawsuits filed by the state of Mississippi are built on the same allegations that were a part of the individual lawsuits against J&J which allege that the company's inability to warn of the dangers of ovarian cancer caused by talcum powder was negligent, and violated state law.

J&J has submitted its motion to dismiss the lawsuits to another bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to be pursued. If you or someone around you has been diagnosed with mesothelioma, or another condition that could be the result of talcum powder. You must seek legal advice immediately.
