What Mesothelioma Talc Lawsuit Experts Want You To Know
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has pericardial mesothelioma has alleged Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case is the first to proceed since J&J spun off its Talc business and filed for bankruptcy.

In the first quarter of the year, huge settlements were made in talc suits in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma is a lethal form of cancer, affects the mesothelium or the lining that surrounds organs and cavities inside the body. It is most prevalent in the lungs but can be found in the chest and abdomen cavity. Asbestos, which is the only known cause of this disease is asbestos. People who have been exposed to asbestos are at a higher risk of developing it.

The first trial since J&J declared bankruptcy over its talcum powder division began in Oakland, California this week. Jurors were impressed by the story of the plaintiff. In 2022, the plaintiff who was only 24 years old at the time, was diagnosed with malignant mesothelioma of the pericardium. He attributed the cause of his condition to his early use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J has been accused of concealing asbestos risks from consumers for several decades. The company has a long history of withholding asbestos findings from regulators and even funding asbestos tests to generate the results it desired. The lawsuits have identified a number of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and others.

Many women who used talcum powder for feminine hygiene in the genital areas or on sanitary napkins, or condoms have been diagnosed with ovarian cancer, and some have been diagnosed with mesothelioma. The lawsuits allege that J&J knew for more than 40 years that the powder could cause mesothelioma and ovarian cancer, but did not warn consumers of this danger.

Mesothelioma symptoms may include difficulty breathing, persistent coughing, abdominal pain, fatigue and lumps or masses on the abdomen or chest. Doctors can diagnose mesothelioma by a physical exam and imaging scans. These could include CT (computer tomography) scans, MRIs and PET or X-rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery and/or radiation. The surgeons can remove affected tissue based on the location of the tumors. Patients with mesothelioma may be given a life expectancy less than five years, however aggressive treatments such as extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy may prolong the life expectancy.

What Causes Mesothelioma?

Mesothelioma is a type of cancer that is caused by DNA changes in a cell. These mutations can cause uncontrolled cell growth that forms tumors in tissues. Asbestos is the most common cause mesothelioma. The exposure to asbestos can occur at work in a variety of fields such as mining, manufacturing, construction and transportation. Asbestos is typically exposed 20 to 40 years before symptoms becoming apparent. Mesothelioma affects men more than women, and it is most commonly diagnosed in people in their 50s to 70s. The kind of mesothelioma involving asbestos that someone develops is often determined by the place on their body they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma which affects the lungs. Other patients are diagnosed with peritoneal msothelioma. This type of mesothelioma affects the abdomen. Some people are diagnosed with pericardial mesothelioma. This is an extremely rare form of the disease which affects both the liner (pericardium) and the organ itself.

Insomnia as well as abdominal pain and fatigue are all symptoms of mesothelioma. In the late stages of mesothelioma tumors can spread to other areas of the body, which can cause extreme pain and discomfort. Other symptoms of mesothelioma include fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma is a terminal disease, and is often fatal.

The talcum powder trial in Oakland involved a man of 24 who developed pericardial msothelioma after using J&J baby powder. His lawyers argued the company knew that talc contained asbestos but didn't warn customers. They also cited a 1998 letter sent to a J&J executive, revealing the possibility of asbestos being in their products.

This is the latest in a series of high-dollar verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in a woman. Last month, another jury in Missouri awarded $55 Million in an identical case. Seven new cases have been added to the MDL talcum powder over the last month, bringing it to 37,522 the number of lawsuits in the process. The majority of these lawsuits involve women who have used J&J's talcum powder for feminine hygiene reasons.

Mesothelioma, a rare and fatal disease caused by asbestos exposure is a rare condition. Asbestos was utilized in a variety of industrial and consumer products, including baby powder. In talcum-powder lawsuits plaintiffs claim that exposure to asbestos through inhalation of the powder led to the development of mesothelioma, or other health issues.

J&J was allegedly aware of the risk of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against J&J seeking punitive and compensatory damages. The claims have been combined in federal and state multidistrict lawsuits, also known as MDLs.

In 2018, one of the first large trial involving talc resulted in a $4.7 billion verdict for the plaintiff. This made national headlines and set the stage for the rest of the litigation. In the last month, a judge ruled against a motion by J&J to dismiss the lawsuits filed by the state of Mississippi.

J&J, however, tried to stop the litigation. The company set up a new subsidiary entity to assume its talc liabilities, and LTL Management filed for bankruptcy. The bankruptcy stayed thousands of talc lawsuits, however, the 3rd Circuit rejected this strategy.

The lawsuits brought by the state of Mississippi are founded on the same allegations that were a part of the individual lawsuits filed against J&J that claim that the company's inability to warn about the risks of ovarian cancer from the talcum powder was negligent and violated the law of the state.

J&J has resubmitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to be pursued.
