asbestos cancer lawsuit lawyer mesothelioma Against Johnson & Johnson

A man aged 24 with mesothelioma pericardial has claimed that Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first trial to be held since J&J filed for bankruptcy and split off its talc division.

This year, juries awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma, which is a fatal type of cancer, affects the mesothelium or lining around organs and cavities in the body. It is most commonly found in the lungs, but it can also occur in the abdomen, the heart and chest cavity, as well as the testicles. Asbestos, which is the only known cause of this disease, is asbestos. People who have been exposed to asbestos are at an increased risk of developing it.

The first trial since J&J declared its talcum powder division bankrupt opened this week, and jurors in Oakland, California were emotional as they listened to the story of the plaintiff. In 2022, the plaintiff, who was only 24 years old at the time, was diagnosed with malignant mesothelioma of the pericardium. He blamed his condition on the use of Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J is accused of obfuscating asbestos risks from consumers for several decades. The company has a long track record of hiding asbestos information from regulators, and even paying for asbestos tests that produced the results they desired. A number of the company's talcum powder suppliers have been named in these lawsuits and include Whittaker, Clark & Daniels and Imerys Talc America.

Many women who used talcum powder for feminine hygiene in the genital region or on sanitary napkins or condoms have gotten an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than 40 years that the powder could trigger ovarian cancer and other illnesses, but failed to warn consumers.

Mesothelioma symptoms include breathing problems, chronic coughing and fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can diagnose mesothelioma by a physical exam and imaging scans. These may include CT (computer tomography) scans, MRIs and PET or X-rays.

When mesothelioma is discovered patients can undergo chemotherapy, surgery, and/or radiotherapy. The surgeons are able to remove the affected tissue based on the location of the tumors. Some patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal tissue transplantation or cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong survival.

What is the cause of Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA changes in cells. These mutations cause uncontrolled growth of cells, which creates tumors in the tissues. Asbestos is the most common cause of mesothelioma. Exposure to asbestos can occur at work in many different industries such as manufacturing, mining, construction and transportation. Asbestos can be exposed for between 20 and 40 years prior to symptoms appearing. Mesothelioma affects men more than women, and it is usually diagnosed in people in their 50s and 70s. The type of mesothelioma that a sufferer is usually determined by the area of their body in which they were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural mesothelioma that affects the lung. Some are diagnosed with peritoneal melanoma, which is a mesothelioma type that affects the abdomen. In addition, some individuals are diagnosed with pericardial mesothelioma, an extremely rare type of the disease that affects the lining of the heart (pericardium) and the organ itself.

Symptoms of mesothelioma include shortness of breath, fatigue and abdominal pain, as well as weight loss. In the later stages of mesothelioma tumors may spread to other parts of the body, which can cause extreme pain and discomfort. Other symptoms that are common to mesothelioma include swelling of the lung (pleural effusion), loss of appetite, difficulties swallowing and a blockage within the small intestine, referred to as a bowel obstruction. Mesothelioma can be fatal.

The trial involving talcum powder in Oakland involved a man aged 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos, but didn't warn customers. They also cited a 1998 letter to an J&J executive that revealed asbestos could be present in their products.

This is the latest in a string of major verdicts against J&J. In March, J&J's Talcum powder caused ovarian mesothelioma in a woman. In the same month, a jury in Missouri awarded $55 million in an identical case. In addition, seven cases were added to the talcum powder MDL in the last month which brought the number of pending lawsuits to 37,522. The majority of these lawsuits are filed by women who have used J&J talcum powder to maintain feminine hygiene.

How Do I Know if I Have Mesothelioma?

A diagnosis of mesothelioma may be devastating. Patients should always consult a specialist to get the most accurate information possible and prevent misdiagnosis that could lead to unnecessary treatment and allow cancer to expand further.

A physical examination and blood test is an excellent way to determine whether mesothelioma is causing symptoms. These tests can be used to look for asbestos fibers in blood, or the health of the patient's internal organs. The most accurate method of diagnosing mesothelioma involves the procedure of a biopsy. Doctors take tissues or fluids from the affected area, and examine them under a microscope to look for mesothelioma cancer cells.

The type of mesothelioma sufferers have can influence their prognosis. Pleural mesothelioma that develops in the thin lining around the lungs, is the most frequent form of the disease and makes up the majority of cases diagnosed. Peritoneal mesothelioma is a type of cancer that forms in the lining of the abdomen is not as common. In addition, pericardial mesothelioma is a rare type that develops in the lining of the heart. It's only 1percent of all cases.

A shortness of breath that gets worse with time, and bloody coughing are a few of the initial symptoms. Asbestos patients may also experience fluid accumulation in the chest cavity. This is known as the pleural effusion. It can be removed by inserting a needle into the affected area of the chest cavity. In more severe cases, doctors might undergo a procedure called pleurodesis to seal the space to prevent the reaccumulation in the pleura.

A precise mesothelioma diagnosis is the best way to determine a patient's treatment options and the survival rate. There are a variety of options for treatment which include chemotherapy, surgery and radiation. There are also immunotherapy treatments that boosts the immune systems to fight mesothelioma as well as treatment fields for tumors that utilize magnetic fields to kill cancerous cells.

A mesothelioma specialist can assist patients in understanding the various mesothelioma cell types, which determine the extent of the cancer and the patient's outlook. Patients should discuss with their physician their history of asbestos exposure to determine whether mesothelioma is possible and what treatment options are available.

Mesothelioma is a rare but fatal illness that is caused by asbestos exposure. Asbestos was widely used in a variety of consumer and industrial products including baby powder. In talcum powder cases plaintiffs claim that asbestos exposure from inhaling the powder caused them to develop mesothelioma, or other health issues.

J&J was allegedly aware of the risk of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking damages for punitive and compensatory. These lawsuits have been consolidated in federal and state multidistrict litigations, or MDLs.

In 2018 one of the biggest talc cases led to a $4.7 billion verdict in the favor of the plaintiff. It was a national news story and set the tone for the rest of the year. In the last month, a judge denied J&J's motion to dismiss the lawsuits filed by the state.

However, in an attempt to stop the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company created an entity that would take on its liabilities. The bankruptcy stopped thousands of talc lawsuits, however, the 3rd Circuit rejected this strategy.

The lawsuits filed by the state of Mississippi are founded on the same allegations as the individual lawsuits against J&J that claim that the company's failure to warn of the dangers of ovarian cancer caused by talcum powder was negligent, and was a violation of the law of the state.

J&J has submitted its motion to dismiss lawsuits before a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone near you has been diagnosed with mesothelioma, or another condition which could have been caused by talcum powder. You should seek legal counsel immediately. Our skilled lawyers will assist you in getting the compensation you deserve.
