今天，最高人民檢察院舉行「依法履行檢察職能，從嚴懲治開設賭場犯罪」新聞發佈會，發佈了檢察機關依法懲治開設賭場犯罪5起典型案例。最高檢第一檢察廳廳長苗生明通報檢察機關依法履行職能，從嚴懲治開設易七娛樂賭場犯罪工作情況並回答記者提問。
苗生明介紹説，今年1月至9月與2018年至2020年3年同期平均辦案數相比較，全國檢察機關提起公訴25140件63238人，上升49.27%和45.71%，開設賭場犯罪呈高發態勢。開設易七娛樂賭場犯罪相較其他犯罪，涉國（境）外因素多；新型開設賭場犯罪具有較強的欺騙性和隱蔽性；犯罪鏈條長、涉案人員多，犯罪集團化傾向明顯；犯罪涉及的地域廣，危害嚴重。
「最高檢高度重視打擊治理跨境賭博工作，加強了研究和指導；全國檢察機關充分發揮檢察一體化制度優勢，依法嚴懲開設賭場犯罪；堅持寬嚴相濟刑事政策，確保案件辦理效果。檢察機關將主動參與社會治理，會同有關部門共同加強出入境管理和推進網絡空間法治化建設，整治網絡黑灰產業鏈，淨化網絡空間，使賭博犯罪在『線上』『線下』無處遁形。」苗生明説。
辦理賭資流水24億餘元大案
【基本案情】 2018年，被告人劉某某、曾某某等人經商議後，將原先各自建在國內運營的兩個網絡易七娛樂賭盤軟件伺服器移至某國合併運營，並招納人員出境運營管理賭場。賭場開設「北京賽車」「重慶時時彩」「幸運飛艇」等賭博項目，在網絡上組織招攬包括福建、湖南、江西等10餘省的9242人為會員進行賭博，並以給會員「返水」、客服人員提成、發展代理的方式逐漸做大並新增多個易七娛樂賭盤。截至2019年11月案發，涉案賭資流水達24億餘元，犯罪團夥非法獲利2400多萬元。
法院最終以開設賭場罪分別判處劉某某、曾某某等11名被告人七年至一年不等的有期徒刑，並處最高55萬元的罰金。
【辦案經過】 福建省連城縣人民檢察院提前介入，引導公安機關通過技術手段調取相關證據，依法認定賭資及相關人員的非法獲利；針對33名涉案人員僅到案11人，大部分涉案人員尤其是負責賭場財務管理的核心人員滯留境外未歸案的情況，檢察機關與公安機關共同督促在案人員及家屬動員他們投案，後部分涉案人員主動回國投案。
【典型意義】 檢察機關在辦案中堅持貫徹寬嚴相濟刑事政策，依法提出量刑建議，綜合考慮社會危害性，建議對於所有被告人不適用緩刑，並根據各被告人在犯罪中的地位作用及非法獲利數額，建議對各被告人並處相應的罰金刑，剝奪其再犯的能力。對於認罪悔罪，成功規勸同案人投案的被告人，依法認定為立功，建議減輕處罰，相關意見得到法院採納。
戳破「商務活動」背後系列賭局
【基本案情】 1999年至2020年8月期間，吳某、鄧某某等與許某（另案處理）相互糾合，依託某國外賭場，以開展高爾夫球運動等「商務活動」為名，採取遊、住、賭一體化的經營模式，組織我國公民入住位於賭場所在酒店並參與賭博活動。2020年後，該犯罪組織為牟取更多的非法利益，依託該實體賭場發展面向我國公民的網上賭博業務，並將實體賭場的中國籍「洗碼」人員發展為賭博網站股東代理，再發展下級代理及會員。該犯罪組織發展中國籍股東代理與下級代理51名，發展中國籍賭博會員數百名，涉案賭資達2.5億元。
【辦案經過】 廣東省廣州市從化區人民檢察院通過提前介入，引導公安機關偵查取證。因涉案人員多、主要犯罪行為在國外實施、陸續到案， https://www.27betting.com/ ，被法院採納。
【典型意義】 犯罪分子以較有經濟實力的民營企業主為重點目標，利用與「商務公司」合作組織出國或與旅行社合作吸引高爾夫球客户的名義，組織民營企業主出國入住賭場所在的酒店參與賭博。有的參賭人員還被引誘發展為代理，繼續組織他人出國賭博，實施開設易七娛樂賭場犯罪，自己經營的企業則面臨破產。
