7 Small Changes You Can Make That'll Make A Big Difference With Your Mesothelioma Compensation Royal Navy
Mesothelioma Compensation and the Royal Navy

The Ministry of Defence changed its policy on 16 December 2015 to give service members suffering from mesothelioma the option of receiving the lump-sum amount or a traditional war pension. But the decision was not applicable to all veterans who had already been diagnosed with the disease.

This included Rhod Palmer and Fred Minall, who were exposed to asbestos while in their military service and in civilian jobs. This was a great injustice to them and their families.

The law has been modified

Mesothelioma, an aggressive terminal cancer caused by asbestos exposure can take years to manifest. The symptoms can take several years to manifest and, once diagnosed with the disease sufferers are expected to live one or two more years.

The decision of the Government to amend the law is a huge step in the right direction. Veterans who are diagnosed with mesothelioma could choose to receive their pension, or a lump-sum of up to 140 000 francs. This is a much higher compensation than the average civil award.

Before the changes, members of the armed forces diagnosed with mesothelioma had access to a War Disablement Pension. This was a limited benefit that only offered a regular monthly income and was not appropriate for those suffering with serious long-term illnesses such as mesothelioma. The War Pension Scheme did not provide lump-sum compensation.

After extensive lobbying, backed by the Royal British Legion and Asbestos Victims Support Group Forum, the law has been amended to allow veterans of the armed forces diagnosed with mesothelioma to receive a lump sum of up to PS140,000, in addition to traditional War Pension. The lump sum will be tax-free.

Prior to this, mesothelioma diagnosed could have qualified a person to receive a war disability pension up to PS32,000, regardless of whether they were divorced, single, or widowed. However, civilians who have mesothelioma are eligible for up to PS600,000 under the Government's Diffuse Mesothelioma Scheme.

All veterans of the armed forces diagnosed with mesothelioma are eligible to select this option. The law will also be applicable to those who have been exposed to asbestos during their service and outside it, also referred to as "dual exposure".

Mesothelioma UK has already started helping former sailors and other armed personnel with mesothelioma-related claims. We can help them be aware of the new law and the issues involved. We can help them determine the best way to receive compensation. This could include tracing businesses who are responsible for their asbestos exposure.

The lump sum will be PS140,000.

Compensation is determined by a range of variables, including age, life expectancy after mesothelioma and the amount of care required. It is also based on the impact mesothelioma's disease has had on family members and whether or not the individual can work.

Asbestos sufferers should seek compensation from those responsible for their exposure to asbestos. If they are unable to locate the responsible parties, a government program pays lump sums to mesothelioma patients. The average amount is around PS144,000.

In the past, ex-servicemen who were diagnosed with mesothelioma would only receive a war disabled pension under the Diffuse Mesothelioma Scheme 2008. This is a monthly amount determined by the individual's age and level of disability. However, this is a significantly smaller sum than the mesothelioma settlement for civilians, which can reach six-figures.

Fred Minall, 74 from Northampton Fred Minall, 74, from Northampton, who was an engineer in the naval sector of the Royal Navy between 1957 and 1965, has now been told that he'll be entitled to an amount of PS140,000 in one lump sum under the new law. He is suffering mesothelioma which is an incurable lung disease caused by exposure to asbestos.

According to mesothelioma attorneys, Simpson Millar, this is an enormous victory for mesothelioma patients who have suffered from the disease. The majority of Navy personnel, like many civilians, were docked in US ports throughout their careers which exposed them to asbestos-related toxins. This is due to the extensive use of asbestos on American ships at the time. Symptoms of mesothelioma can take decades to manifest, and as a result, veterans are often left with fewer options for compensation.

The Ministry of Defence confirmed that veterans with Mesothelioma who have not received a war-pension, will be offered up to PS140,000 as a lump-sum payment. This is a significant increase from the current amount that non-married mesothelioma veterans receive under the Diffuse Mesothelioma Scheme.

This new payment will however be taken out of the current war pension an individual receives. It is imperative that anyone suffering from mesothelioma who is thinking about applying for this benefit seeks the advice of an experienced mesothelioma attorney to ensure they get the best deal.

It's a win to the Royal British Legion

The Royal British Legion has delivered a stinging rebuke to the government over claims that it has reneged on its promise to establish the military covenant in law. The charity has asked the minister responsible to explain the reason for reneging on its commitment to veterans and has threatened to pull out of several forums where it works with the Ministry of Defence.

Engagement of the Legion with the MoD is essential, but it must be more productive to ensure that the needs of the community are addressed in a manner that has a significant impact on their lives. It is therefore essential that the feedback loop in forums is improved to ensure that any issues that are not being addressed are recognized and the reasons are clearly explained.

The Royal British Legion, as the UK's biggest and oldest Armed Forces Charity, is at the centre of a national network that offers support to members of the Armed Forces. They are also the group that is the most suited to understand the challenges faced by those who are serving or have served, as well as their widows and widowers.

The fact that patients with mesothelioma are often left without financial security is among their biggest worries. The amount of compensation available is typically not enough to cover the cost of treatment or living expenses, and it is usually not feasible to obtain a mortgage.

Asbest was used in shipbuilding, among other Naval activities. Many veterans are struggling with the symptoms of their illness and the impact on their financial health.

There are a variety of organizations that can help. For instance, mesothelioma lawyers can help to secure legal compensation for sufferers. This can be used to pay for treatment or to cover the essential expenses of living. Mesothelioma sufferers may also seek compensation from the companies who supplied asbestos-containing products.

It will be welcomed by veterans

The Ministry of Defence announced that Navy veterans with mesothelioma can receive a lump-sum payout of PS140,000. This will allow them to receive a substantial financial support to ease the financial pressure that mesothelioma can cause their families.

Former service members who have been diagnosed with mesothelioma will be delighted by this news. The law has changed to allow them to receive a similar amount of compensation as civilians with mesothelioma claims.

The change came about due to an effort by the Royal British Legion, and other groups. This led to the Prime Minster promising to examine the issue. The MoD's u-turn will allow a lot of veterans who would have been eligible for a pension to receive a lump sum. This will provide them with peace of mind and the financial support they require to live out the rest of their lives.

Asbestos is linked to mesothelioma. It can take decades for symptoms to appear, but even a single exposure can increase the risk of developing the disease. The vast majority of mesothelioma sufferers were exposed to asbestos while working, including in Navy shipyards. compensation for mesothelioma was amended to allow employees who were exposed to asbestos at work to sue their employers. However, many veterans are unaware that they could be entitled to compensation from the government.

Mesothelioma is a devastating illness that has affected many lives. The decision of the government to address the unfair treatment of veterans of the military is a huge victory.

However, it is not enough to alleviate the suffering of veterans with mesothelioma or their families. They also have to seek compensation from the companies who supplied the military with asbestos-based products. Based on the shipyards, bases, and ships they were employed on, veterans may be able to make trust fund claims against a variety of corporations. This can include a variety of large multinationals that have a history of selling asbestos-related products to the US Navy and other branches of the armed forces.
