Say "Yes" To These 5 Mesothelioma Talc Lawsuit Tips
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has mesothelioma pericardial has claimed that Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma case is the first trial that has been held since J&J filed for bankruptcy and spun off its Talc division.

In the spring of this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs have linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a lethal type of cancer, affects the mesothelium or lining around organs and cavities in the body. It is most prevalent in the lungs but can also be located in the abdomen and chest cavity. Asbestos is the sole known mesothelioma-related cause and those who have been exposed to asbestos are at a greater risk of developing this disease.

The first trial since J&J declared its Talcum Powder division bankrupt was opened this week, and jurors in Oakland, California were emotional as they listened to the story of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial mesothelioma in 2022. He attributed the cause of his illness to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $25 million.

J&J is accused of obfuscating asbestos risks from consumers since decades. J&J has a history of obstructing asbestos research from regulators and funding asbestos tests to generate the results it wanted. These lawsuits have identified several of the company's suppliers of talcum powder, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.

Women who used talcum to provide feminine hygiene, such as sanitary pads or condoms as well as in the genital region have developed ovarian and mesothelioma. The lawsuits allege that J&J knew for more than 40 years that the powder led to mesothelioma and ovarian cancer, but failed to warn customers of this risk.

Mesothelioma symptoms include difficulty breathing, persistent coughing, abdominal pain, fatigue and lumps or masses on the abdomen or chest. Doctors can diagnose the condition through a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

If mesothelioma has been diagnosed patients can undergo surgery, chemotherapy, and/or radiotherapy. The surgeons can remove the affected tissue based on the location of the tumors. Patients with mesothelioma may be given a life expectancy of less than five years, but aggressive treatments such as extracorporeal Membrane transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong the duration of their survival.

What is the cause of Mesothelioma?

Mesothelioma, like most cancers is caused by DNA mutations in cells. These mutations lead to uncontrolled cell growth that forms tumors in tissues. Asbestos is the leading mesothelioma-related cause. Asbestos exposure can occur at work in a variety of industries such as mining, manufacturing construction, transportation and construction. Asbestos exposure typically occurs 20 to 40 years prior to the time symptoms begin to manifest. Mesothelioma is more common in males than women, and it is most commonly diagnosed in people in their 50s and 70s. The type of mesothelioma that a sufferer is usually determined by the area of their body where they were exposed to asbestos. Most people with mesothelioma are diagnosed with pleural melanoma, which affects the lung. Other patients are diagnosed with peritoneal mesothelioma. This type of mesothelioma affects the abdomen. Finally, some people are diagnosed with pericardial mesothelioma. It is an extremely rare type of the disease that affects the lining of the heart (pericardium) and the organ itself.

A lack of breath, fatigue, and abdominal pain are all symptoms of mesothelioma. In the later stages of mesothelioma, the tumors can spread to other areas of the body, causing severe pain and discomfort. Other signs of mesothelioma can include fluid in the lungs, nausea difficulties eating and swallowing. Mesothelioma is a debilitating illness that is often fatal.

The talcum-powder trial in Oakland involved an individual of 24 years old who developed pericardial msothelioma following the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos but didn't warn customers. They also cited a 1998 letter addressed to a J&J executive, revealing the possibility of asbestos in their products.

This is the latest in a string of large verdicts against J&J. In March, a jury awarded $18.8 million to a woman who contracted mesothelioma ovarian from J&J's talcum powder, and last month, a jury in Missouri awarded $55 million in another case that dealt with the same issue. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the total number of pending suits. Most of these lawsuits were brought by women who have used J&J talcum powder to maintain feminine hygiene.

How Can I Tell If I Have Mesothelioma?

A diagnosis of mesothelioma can be devastating. Patients must always consult a doctor to get the most precise diagnosis and to avoid misdiagnosis, which could lead to unnecessary treatment and cancer spreading.

A physical exam and blood sample can help to identify mesothelioma signs. These tests can be used to check for asbestos fibers in blood or to assess the health of the patient's internal organs. The most accurate way to diagnose mesothelioma is by a biopsy, in which doctors remove tissue or fluid from the affected area and then examine the area under a microscope to search for mesothelioma cancer cells.

The type of mesothelioma that a person is suffering from also affects his or her prognosis. Pleural mesothelioma, the most commonly encountered type of disease, and accounts for the majority of cases that are diagnosed. Peritoneal mesothelioma, a cancer that develops in the abdomen's lining is less prevalent. The pericardial msothelioma, in turn, is a rare type that is found in the lining of the heart. It only accounts for 1percent of all cases.

The first signs include shortness of breath that gets worse over time, and then coughing up blood. Asbestos patients may also experience fluid accumulation in the chest cavity. This is known as pleural effusion. The fluid can be eliminated from the chest cavity by inserting an needle into the affected region. In more serious cases, doctors can perform a procedure called pleurodesis to seal the space to prevent reaccumulation of fluid in the pleura.

Making sure that mesothelioma is diagnosed correctly is the best method to determine the patient's treatment options as well as their survival rate. Chemotherapy, surgery and radiation are all options. There are also immunotherapy treatments that increases the immune system to fight mesothelioma as well as cancer treating fields that employ the power of magnets to kill cancerous cells.

A mesothelioma expert can also help patients understand various mesothelioma cell types that determine the severity of the cancer and the outlook of the patient. Patients should discuss their history of asbestos exposure with their physician to determine if they're a mesothelioma candidate and learn about the various types of treatment are available to them.

How Can I Get Help?

If you have used Johnson & Johnson talcum and suffered from ovarian or other diseases such as mesothelioma following the use of the talcum powder, you could be eligible for a significant amount of compensation. Contact mesothelioma class action lawsuits for a no-cost, non- obligation case evaluation. We can assist you with filing mesothelioma claims against J&J and hold J&J accountable for their wrongful conduct.

Mesothelioma is a rare but fatal disease caused by asbestos exposure. Asbestos was once used extensively in a range of industrial and consumer products including baby powder. In talcum-powder lawsuits plaintiffs claim that asbestos exposure from inhaling the powder led to the development of mesothelioma and other health issues.

J&J allegedly knew about the risk of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking damages for punitive and compensatory. These lawsuits have been amalgamated into federal and state multidistrict litigations, also known as MDLs.

In 2018, one of the largest Talc trials ended in a $4.7 billion verdict for the plaintiff. This was a major news story and set a tone for the remainder of the litigation. Last month, a judge denied the motion of J&J to dismiss the lawsuits brought by the state of Mississippi.

However, in an attempt to derail the lawsuit, J&J tried again. The company created an additional subsidiary entity to take on its talc liability, and LTL Management filed for bankruptcy. The bankruptcy stopped the filing of thousands of talc lawsuits, however, the 3rd Circuit rejected that strategy.

The lawsuits filed by Mississippi are based on the same allegations as those of the individual lawsuits filed against J&J. They allege that the company was negligent in failing to warn of the risk of ovarian carcinoma from talcum-powder and that this constituted a violation of state law.

J&J has resubmitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June to decide whether the lawsuits against J&J will be allowed to proceed. If you or someone you know is diagnosed with mesothelioma or another condition that could have been caused by talcum powder you should seek legal assistance immediately.
