8 Tips To Enhance Your Mesothelioma Talc Lawsuit Game
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma case is the first trial that has been held since J&J filed for bankruptcy and split off its Talc division.

This year, juries awards in New Jersey and California led to massive settlements in talc-related lawsuits. Plaintiffs attributed cancer to asbestos that was found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects the mesothelium the lining that surrounds organs and body cavities. It is most prevalent in the lungs, but it can be located in the abdomen and chest cavity. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed are at a higher chance of developing it.

The first trial following J&J declared bankruptcy over its talcum powder division began in Oakland, California this week. Jurors were impressed by the story of the plaintiff. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma in 2022. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $26 million.

J&J is accused of obfuscating asbestos risks from consumers for several decades. The company has a long history of withholding asbestos findings from regulators and even funding asbestos tests to get the results it desired. Some of the company's Talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Many women who used talcum powder for feminine hygiene in the genital region or on sanitary napkins or condoms have gotten cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J knew for more than 40 years that the powder could cause mesothelioma and ovarian cancer, however, they failed to warn consumers of the risk.

Mesothelioma symptoms may include breathing difficulties, constant coughing and abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can identify the disease by a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

Once a mesothelioma diagnosis is confirmed, patients may undergo surgery, chemotherapy and/or radiation. The surgeons can remove affected tissue based on the location of the tumors. Some patients with mesothelioma have a lifespan less than five. However aggressive treatments like extracorporeal transplantation of tissue and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the duration of survival.

What causes Mesothelioma?

Like all cancers, mesothelioma occurs when a cell's DNA experiences mutations. These mutations cause cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is the leading cause of mesothelioma. Asbestos exposure can be found in many different industries including mining, manufacturing and transportation. Asbestos exposure typically occurs 20 to 40 years prior to the time symptoms appear. Men are more likely to develop mesothelioma compared to women. It is also diagnosed most often in people between the ages of 50 and 70. The kind of mesothelioma involving asbestos that someone develops is usually determined by the place on their body they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma which affects the lungs. Some are diagnosed with peritoneal mesothelioma. This kind of mesothelioma is affecting the abdomen. Certain people are diagnosed with pericardial msothelioma. This is a rare form of cancer that affects both the lining (pericardium), and the organ itself.

Mesothelioma symptoms include fatigue, breathlessness abdominal pain and weight loss. In the later stages of mesothelioma tumors can spread to different parts of the body, which can cause extreme pain and discomfort. Other symptoms of mesothelioma include fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma can be fatal.

The talcum-powder case in Oakland involved a person who was 24 years old who developed pericardial msothelioma after using J&J baby powder. His lawyers argued that the company knew that talc contained asbestos, but didn't inform consumers. They also cited a 1998 letter sent to an J&J executive that revealed the possibility of asbestos in their products.

This is the latest in a string of large verdicts against J&J. In March, a jury handed down $18.8 million to a woman who contracted mesothelioma of the ovarian tract from J&J's powder. Then, last month a jury in Missouri awarded $55 million in another case that involved the same issue. In addition, seven cases were added to the powder's MDL over the last month which brought the total number of lawsuits pending to 37,522. The majority of these lawsuits are filed by women who used J&J talcum powder to maintain feminine hygiene.

How do I know if I Have Mesothelioma?

A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to get the most accurate diagnosis and to avoid false diagnosis, which could result in unnecessary treatment and spread of cancer.

A physical examination and a blood sample can aid in identifying mesothelioma-related symptoms. mesothelioma lawsuit settlement amounts can check for asbestos fibers in blood or to assess the extent to which a patient's organs are functioning. The most accurate method to diagnose mesothelioma is the procedure of a biopsy. Doctors take tissue or fluids from the affected area and then examine them under a microscope to look for mesothelioma cancerous cells.

The type of mesothelioma that is present in a patient can influence their prognosis. Pleural mesothelioma, that forms in the thin lining around the lungs, is the frequent form of the disease and makes up the majority of cases diagnosed. Peritoneal cancer, which forms in the lining of the abdomen is a less prevalent type. The pericardial msothelioma, in turn, is a rare kind that is found in the lining of the heart. It only accounts for 1percent of all cases.

The breath is short, and gets worse with time, and bloody coughing are among the first symptoms. Asbestos sufferers can also experience fluid accumulation in the chest cavity, a condition called pleural effusion. It can be removed by inserting a needle into the affected area of the chest cavity. In more serious cases, doctors can undergo a procedure called pleurodesis, which seals the area to prevent the reaccumulation in the pleura.

A reliable diagnosis of mesothelioma is crucial in determining the rate of survival for a patient and treatment options. There are many treatments available that include surgery, chemotherapy and radiation. There are also immunotherapy treatments that enhances the immune system to fight mesothelioma and cancer treating fields that employ the power of magnets to kill cancerous cell.

A mesothelioma specialist who is specialized can also help patients understand the different mesothelioma cells that determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their physician their experience with asbestos exposure to determine whether mesothelioma is a possibility and what treatment options are available.

Mesothelioma is a rare, but fatal disease caused by exposure to asbestos. Asbestos was a time when it was widely used in a wide range of industrial and consumer products, including baby powder. In talcum-powder cases plaintiffs assert that exposure to asbestos through inhalation of the powder led to the development of mesothelioma and other health issues.

J&J failed to inform the public about the dangers of talcum and asbestos even though they were aware of them for many years. Plaintiffs have filed lawsuits seeking punitive damages as well as compensatory damages against J&J. These claims have been consolidated into state and federal multidistrict litigations, also known as MDLs.

In 2018, one of the largest trial involving talc resulted in an $4.7 billion verdict for the plaintiff. It was a national news story that set the stage for the rest. In the last month, a judge denied a request by J&J to dismiss the lawsuits brought by the state of Mississippi.

However, in an effort to derail the litigation, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company incorporated an entity to take over its liabilities. The bankruptcy stopped thousands of talc suits, but the 3rd Circuit rejected that strategy.

The lawsuits brought by Mississippi are based on the same allegations of the individual lawsuits filed against J&J. They allege that the company acted negligently in not warning of the possibility of ovarian cancer from talcum powder and that this constituted an infraction to the law of the state.

J&J has submitted its motion to dismiss lawsuits to another bankruptcy court. A hearing has been scheduled for June to decide whether the lawsuits against J&J will be allowed to proceed.
