5 Mesothelioma Talc Lawsuit Lessons From The Professionals
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J has dissolved its Talc business and filed for bankruptcy.

In the spring of this year, jury awards in New Jersey and California led to big settlements in talc lawsuits. Plaintiffs have linked cancer to asbestos found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects mesothelium the lining around organs and body cavities. It is most commonly found in the lungs but it can also be found in the abdomen, heart, chest cavity and testicles. Asbestos is the most well-known mesothelioma causing agent, and people who have been exposed to asbestos are at a higher risk of developing this disease.

The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional when they heard the plaintiff's story. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He blamed the cause of his condition to his early use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J has been accused of concealing asbestos-related risks from consumers for decades. The company has a long history of concealing asbestos-related information from regulators, and even paying for asbestos tests that did not yield the results they desired. A number of the company's talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.

Some women who used talcum to provide feminine hygiene on sanitary pads or condoms as well as in the genital region have been diagnosed with mesothelioma and ovarian cancer. The lawsuits claim that J&J knew for more than 40 years that the powder caused mesothelioma and ovarian cancer but failed to warn customers of the risk.

Mesothelioma symptoms may include breathing problems, chronic coughing and abdominal pain, fatigue and lumps or masses on the abdomen or chest. Doctors can diagnose the disease through a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

After a mesothelioma is diagnosed, patients can undergo chemotherapy, surgery, or radiotherapy. Depending on the site of their tumors, surgeons may be able remove the affected tissue. Patients with mesothelioma are sometimes given a life expectancy less than five years. However, aggressive treatments like extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy can prolong survival.

What is the cause of Mesothelioma?

Mesothelioma, as with most cancers, is caused by DNA mutations in a cell. These mutations cause cells to multiply rapidly and develop tumors in tissues of the body. Asbestos is a common cause mesothelioma. Asbestos exposure can occur in a variety of industries, including manufacturing, mining and transportation. Asbestos can be exposed for 20 to 40 years before symptoms becoming apparent. Mesothelioma is more prevalent in men than women, and it is most commonly diagnosed in those in their 50s to 70s. The type of mesothelioma that a person is usually determined by the region of their body that were exposed to asbestos. The majority of mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Some are diagnosed with peritoneal mesothelioma. a type of mesothelioma that affects the abdomen. Some people are diagnosed with pericardial mesothelioma. This is a rare type of the disease which affects both the liner (pericardium) and the organ itself.

The symptoms of mesothelioma are shortness of breath, fatigue abdominal pain and weight loss. In the final stages of mesothelioma, the tumors can spread to different parts of the body, which can cause severe pain and discomfort. Other signs of mesothelioma are fluid in the lung, a loss of appetite and difficulty swallowing and eating. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a person who was 24 who developed pericardial mesothelioma as a result of using J&J baby powder. His lawyers claimed that J&J knew talc could contain asbestos, but didn't inform consumers. try what he says cited a letter in 1998 to a J&J executive that revealed asbestos could be present in their products.

This is the latest in a long line of large verdicts against J&J. In March the jury awarded $18.8 million to a woman who was diagnosed with mesothelioma ovarian from J&J's talcum powder. Last month a jury in Missouri awarded $55 million in another case that involved the same issue. Seven new cases have been added to the MDL talcum-powder over the past month, bringing it to 37,522 the total number of lawsuits in the process. Most of these lawsuits were brought by women who have used J&J talcum powder to maintain feminine hygiene.

How Can I Tell if I Have Mesothelioma?

A diagnosis of mesothelioma can be devastating. Patients should consult a specialist to get the most accurate diagnosis possible and avoid misdiagnosis which could result in unneeded treatment and let cancer expand further.

A physical exam and a blood sample can aid in identifying mesothelioma signs. These tests can be used to check for asbestos fibers in blood, or the health of the patient's internal organs. The most accurate way to diagnose mesothelioma is by a biopsy, where doctors remove tissue or fluid from the affected area and examine the area under a microscope to search for mesothelioma cancer cells.

The type of mesothelioma a person has also affects the prognosis of their patient. Pleural mesothelioma, that forms in the thin lining of the lungs, is the common form of the disease and accounts for the majority of cases diagnosed. Peritoneal mesothelioma is a type of cancer that develops in the lining of the abdomen is not as common. The pericardial msothelioma, in turn, is a rare form of cancer that develops in the lining of the heart. It only accounts for 1percent of all cases.

A shortness of breath that is more severe with time, and a bloody cough are among the first symptoms. Asbestos patients may also experience fluid buildup in the chest cavity, which is known as pleural effusion. It can be eliminated by inserting a needle in the affected region of the chest cavity. In more serious cases, doctors can undergo a procedure called pleurodesis to close the space to prevent the reaccumulation in the pleura.

A precise mesothelioma diagnosis is the best method to determine a patient's treatment options as well as their survival rate. Surgery, chemotherapy, and radiation are all options. Other options include immunotherapy. It is a form of treatment that enhances the immune system to fight mesothelioma tumors and tumor-removing fields, which use the power of magnets to eliminate cancerous cells.

A specialized mesothelioma specialist can also assist patients in understanding the different mesothelioma cells which determine how invasive the cancer is and what the prognosis of the patient is. Patients should discuss with their doctor their experiences with asbestos exposure to determine if mesothelioma is possible and what treatment options are available.

Mesothelioma, a rare and fatal disease caused by asbestos exposure, is a rare disease. Asbestos was once widely used in a variety of consumer and industrial products including baby powder. In talcum-powder lawsuits plaintiffs claim that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma, or other health issues.

J&J allegedly knew about the risk of talcum powder and asbestos for a long time, but failed to warn consumers. Plaintiffs have filed lawsuits seeking punitive damages as well as compensatory damages against the company. The claims have been consolidated into state and federal multidistrict litigations, or MDLs.

In 2018, one of the largest talc cases led to a $4.7 billion settlement in favor of the plaintiff. This was a national news story that set the stage for the rest of the year. Last month, a judge rejected the motion of J&J to dismiss the lawsuits brought by the state of Mississippi.

J&J, however, tried again to stall the litigation. The company set up an entity that was a subsidiary to take on its talc liability, and LTL Management filed for bankruptcy. The bankruptcy was able to halt the talc lawsuits of thousands, however, the 3rd Circuit rejected this strategy.

The lawsuits brought by Mississippi are based on the same allegations that are in the background of the individual lawsuits filed against J&J. They allege that the company was negligent in not warning of the possibility of ovarian carcinoma from talcum-powder and that this constituted an infraction of the law of the state.

J&J has submitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June to determine if the lawsuits against J&J can continue.
