Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A 24-year-old man with pericardial mesothelioma has alleged Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma case is the first trial to be held since J&J filed for bankruptcy and split off its Talc division.
In the first quarter of the year, huge settlements were made in talc lawsuits in New Jersey and California. Plaintiffs linked cancer to asbestos in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a lethal type of cancer is a disease of the mesothelium lining around organs and cavities in the body. It is most prevalent in the lungs, but can be located in the abdomen and chest cavity. Asbestos, which is the only known cause of this disease, is asbestos. People who have been exposed to asbestos are at chance of developing it.
The first trial after J&J declared bankruptcy on its talcum powder division began in Oakland, California this week. Jurors were moved by the story of the plaintiff. In 2022, the plaintiff, who was only 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma of the pericardium. The plaintiff attributed his condition to the use of Johnson & Johnson baby powder. The jury awarded him $26 million.
J&J is accused of obfuscating asbestos risks from consumers since decades. The company has a long history of concealing asbestos-related information from regulators, as well as paying for asbestos tests that produced the results they desired. The lawsuits have identified a number of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and others.
Many women who used talcum powder to maintain feminine hygiene in the genital region or on sanitary napkins or condoms have gotten ovarian cancer, and some have been diagnosed with mesothelioma. The lawsuits assert that J&J knew for more than 40 years that using the powder could cause ovarian cancer and mesothelioma, but did not warn consumers of the risk.
mesothelioma wrongful death lawsuit include abdominal pain as well as abdominal lumps, abdominal swelling and persistent coughing. Doctors can diagnose mesothelioma through an examination and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.
When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the site of their tumors, surgeons may be able to remove the affected tissue. Patients with mesothelioma may be given a life expectancy less than five years. However, aggressive treatments such as extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy can prolong the life expectancy.
What is the cause of Mesothelioma?
Mesothelioma, like most cancers is caused by DNA changes in a cell. These mutations can cause uncontrolled growth of cells, which forms tumors in tissues. Asbestos is the most common mesothelioma cause. The exposure to asbestos can be found in many different industries, including mining, manufacturing construction, transportation and construction. Asbestos is typically exposed between 20 and 40 years prior to the onset of symptoms appearing. Men are more likely to develop mesothelioma compared to women. It is also most often diagnosed among those between the ages 50 and 70. The kind of mesothelioma involving asbestos that someone develops is usually determined by the place they were exposed. The majority of people diagnosed with mesothelioma are diagnosed with pleural melanoma, which affects the lungs. Some are diagnosed with peritoneal melanoma, a type of mesothelioma that affects the abdomen. Certain people are diagnosed with pericardial mesothelioma. This is a rare form of disease that affects both the liner (pericardium), and the organ itself.
Mesothelioma symptoms include fatigue, breathlessness, abdominal pain and weight loss. In the late stages of mesothelioma tumors can spread to other parts of the body, creating severe pain and discomfort. Other common symptoms of mesothelioma are fluid on the lungs (pleural effusion) loss of appetite, difficulty swallowing and a blockage within the small intestine, referred to as a obstruction in the bowel. Mesothelioma can be fatal.
The trial involving talcum powder in Oakland involved a man aged 24 who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that J&J knew that talc was contaminated with asbestos, but did not inform customers. They also cited an 1998 letter sent to an J&J executive revealing the possibility of asbestos being in their products.
This is only the latest in a series of major verdicts against J&J. In March, a jury handed down $18.8 million to a woman who contracted mesothelioma of the ovarian tract from J&J's powder, and last month, a jury in Missouri awarded $55 million in another case involving the same issue. In addition, seven new cases were added to the talcum powder MDL over the course of the month which brought the number of lawsuits pending to 37,522. The majority of these lawsuits involve women who used J&J's Talcum powder for feminine hygiene purposes.
How do I know if I Have Mesothelioma?
A diagnosis of mesothelioma is devastating. Patients should always consult a specialist to ensure the most precise diagnosis and to avoid false diagnosis, which could lead to unneeded treatment and spread of cancer.
A physical examination and a blood sample can aid in identifying mesothelioma symptoms. These tests can be used to determine the presence of asbestos fibers in blood or to look at how well a patient's organs are functioning. The most reliable method of diagnosing mesothelioma is a biopsy. Doctors remove tissue or fluids from the affected area, and then look at them under a microscope for mesothelioma cancerous cells.
The type of mesothelioma sufferers have can affect his or her prognosis. Pleural mesothelioma, that forms in the thin lining around the lungs, is the most frequent form of the disease and makes up the majority of diagnosed cases. Peritoneal cancer, which forms in the lining surrounding the abdomen is a less prevalent type. The pericardial msothelioma, in turn, is a rare kind that is found in the lining of the heart. It is only 1percent of all cases.
The first signs include breathlessness which gets worse with time and a coughing up of blood. Asbestos patients can also experience fluid accumulation within the chest cavity. This condition is called the pleural effusion. It can be removed by inserting a needle in the affected region of the chest cavity. In more severe cases doctors may opt to perform pleurodesis, which is a procedure which seals the area to prevent the accumulation of fluid in the pleura.
A mesothelioma accurate diagnosis is essential to determining the patient's survival rate as well as treatment options. There are many treatments available which include chemotherapy, surgery and radiation. Other options include immunotherapy. It is a type of treatment that boosts the immune system to fight mesothelioma tumors and tumor-targeting fields, which uses a magnetic field to kill cancerous cells.
A mesothelioma specialist who is specialized can also help patients understand the different mesothelioma cell types that determine how aggressive the cancer is and what the prognosis for the patient is. Patients should discuss their history of exposure to asbestos with their physician to determine if they are mesothelioma candidates and find out what types of treatment are available to them.

Mesothelioma is a rare, but fatal disease that is caused by asbestos exposure. Asbestos was once widely used in a range of consumer and industrial products including baby powder. Plaintiffs in talcum powder cases claim that inhaling talcum powder led to their asbestos exposure and subsequently mesothelioma as well as other health issues.
J&J believed to have known about the risk of talcum powder and asbestos for decades but failed to warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. The claims have been combined in state and federal multidistrict litigations, or MDLs.
In 2018 one of the largest trial involving talc resulted in an $4.7 billion settlement for the plaintiff. This was a major news story that set the tone for the rest. Last month, a court denied J&J's request to dismiss the lawsuits brought by the state.
J&J however, tried again to halt the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company established a new entity to assume its liabilities. The bankruptcy stopped hundreds of talc suits however, the 3rd Circuit rejected that strategy.
The lawsuits brought by the state of Mississippi are founded on the same allegations that were a part of the individual lawsuits filed against J&J which allege that the company's inability to warn about the risks of ovarian cancer caused by the talcum powder was negligent and constituted violations of the law of the state.
J&J has submitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing has been scheduled for June to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone near you has been diagnosed with mesothelioma, or another condition that could be the result of talcum powder. You must seek legal advice immediately. Our skilled lawyers can assist you in obtaining the compensation you deserve.
