Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with mesothelioma of the pericardium has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first to proceed since J&J spun off its Talc business and filed for bankruptcy.
In the early part of the year, substantial settlements were reached in talc suits in New Jersey and California. Plaintiffs linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects mesothelium or lining that surrounds organs and body cavities. It is most commonly found in the lungs, but it can also occur in the abdomen, heart and chest cavity as well as testicles. Asbestos is the sole known cause of mesothelioma and those who have been exposed to asbestos are at greater risk of developing this disease.
The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional when they heard the testimony of the plaintiff. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma in 2022. He blamed the cause of his condition to his use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.
J&J has been accused of obfuscating asbestos risks from the public for decades. The company has a long tradition of keeping asbestos information from regulators, and paying for asbestos tests that gave the results they wanted. The lawsuits have identified a number of the talcum-powder suppliers for the company such as Whittaker Clark & Daniels, Imerys Talc America, and other companies.
Many women who used talcum powder to maintain feminine hygiene in the genital area or on sanitary napkins, or condoms have been diagnosed with an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits assert that J&J knew for more than 40 years that using the powder led to mesothelioma and ovarian cancer, but failed to warn customers of this risk.
Mesothelioma symptoms can include breathing problems, chronic coughing, abdominal pain, fatigue and lumps or masses on the abdomen or chest. Doctors can detect mesothelioma with a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.
If a mesothelioma diagnosis has been confirmed, patients may undergo surgery, chemotherapy and/or radiation. Depending on the location of their tumors surgeons may be able remove the affected tissue. Certain patients with mesothelioma have a life expectancy less than five. However, supplemental resources as extracorporeal tissue transplantation and chemotherapy for cytoreduction that uses hyperthermic intraperitoneal therapy can prolong survival.
What causes Mesothelioma?
Like many cancers, mesothelioma develops when a cell's DNA experiences mutations. These mutations can cause uncontrolled growth of cells, which forms tumors in tissues. Asbestos is a common cause of mesothelioma. Asbestos exposure can be found in a variety of industries such as manufacturing, mining and transportation. Asbestos is usually exposed for 20 to 40 years before symptoms developing. Men are more likely to develop mesothelioma than females. It is also found most often in those between the ages of 50 and 70. The type of asbestos-related mesothelioma that a person develops is usually determined by the place on their body they were exposed. Most people with mesothelioma are diagnosed with pleural mesothelioma, which affects the lung. Some are diagnosed with peritoneal melanoma, which is a mesothelioma type that affects the abdomen. In addition, some individuals are diagnosed with pericardial mesothelioma, the most rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.
Insomnia as well as abdominal pain and fatigue are all signs of mesothelioma. In the final mesothelioma stages, the tumors can spread to other areas of the body creating severe discomfort and pain. Other typical symptoms of mesothelioma are fluid on the lung (pleural effusion) loss of appetite, difficulty swallowing and a blockage within the small intestine called a obstruction of the bowel. Mesothelioma is a debilitating disease, and is often fatal.
The trial involving talcum powder in Oakland involved a 24-year-old man who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos but did not inform customers. They also cited a 1998 letter to an J&J executive which revealed asbestos could be present in their products.
This is the latest in a string of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in a woman. In the same month, a jury in Missouri handed down $55 million in an identical case. In addition, seven new cases were added to the talcum powder MDL in the last month, bringing the total number of pending lawsuits to 37,522. The majority of these lawsuits concern women who used J&J's talcum powder for feminine hygiene reasons.
How Do I Know If I Have Mesothelioma?
A diagnosis of mesothelioma is devastating. Patients should always see a specialist to get the most accurate information possible and avoid misdiagnosis which could result in unneeded treatment or allow cancer to expand further.
A physical examination and a blood test can be an effective way to determine whether mesothelioma is causing symptoms. These tests can be used to test for asbestos fibers in blood or to assess the health of the patient's internal organs. The most accurate method of diagnosing mesothelioma is a biopsy. Doctors take tissues or fluids from an affected area and then examine them under a microscope for mesothelioma tumor cells.
The type of mesothelioma that is present in a patient can influence their prognosis. Pleural mesothelioma, the most prevalent type of disease and accounts for the majority of cases diagnosed. Peritoneal mesothelioma, a cancer that is found in the abdomen's lining is less prevalent. The pericardial msothelioma, in turn, is a rare type that is found in the lining of the heart. It only accounts for one percent of all cases.
Some of the first symptoms include breathlessness that becomes worse over time and a coughing up of blood. Asbestos sufferers can also experience fluid accumulation in the chest cavity, which is known as pleural effusion. It can be removed by inserting a needle into the affected region of the chest cavity. In more severe cases, doctors may perform a procedure called pleurodesis, which seals the area to prevent the reaccumulation in the pleura.
A reliable diagnosis of mesothelioma is crucial to determine the rate of survival for a patient and treatment options. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, a kind of treatment that increases the immune system to fight mesothelioma tumors and tumor-targeting fields, which use an electromagnetic field to kill cancerous cells.
A mesothelioma specialist may also assist patients in understanding the different mesothelioma types which determine the extent of the cancer as well as the patient's outlook. Patients should discuss their history of exposure to asbestos with their physician to determine if they're mesothelioma-related and find out what types of treatment options are available to them.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos was widely used in many industrial and consumer products, including baby powder. Plaintiffs in talcum powder lawsuits claim that inhaling talcum powder contributed to their exposure to asbestos, which contributed to mesothelioma as well as other health issues.
J&J allegedly knew about the risk of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against the company seeking punitive and compensatory damages. These lawsuits have been amalgamated into federal and state multidistrict litigations, also known as MDLs.
In 2018 one of the biggest talc cases led to a $4.7 billion verdict in the favor of the plaintiff. It was a national news story and set the precedent for the rest of the year. Last month, a judge rejected a motion by J&J to dismiss the lawsuits filed by the state of Mississippi.
J&J however, tried to stop the litigation. The company established an entity that was a subsidiary to take over its talc liabilities and LTL Management filed for bankruptcy. The bankruptcy ended thousands of talc suits, however, the 3rd Circuit rejected that strategy.
supplemental resources filed by Mississippi are based upon the same allegations as those of the individual lawsuits filed against J&J. They assert that the company was negligent in failing to warn consumers of the risk of ovarian carcinoma from talcum powder and that this was an infraction of the law of the state.
J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to move forward. If you or someone around you has been diagnosed with mesothelioma, or another condition which could be the result of talcum powder. You should seek legal counsel immediately. Our experienced attorneys can help you receive compensation that you deserve.
