Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man aged 24 with pericardial msothelioma claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J spun off its talc business and filed for bankruptcy.
In the early part of this year, large settlements were reached in talc lawsuits in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower Baby and Shower Powder products.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects the mesothelium, or lining that surrounds organs and body cavities. It is most common in the lungs but can also be found in the chest and abdomen cavity. Asbestos is the sole known cause of mesothelioma and those who have been exposed to asbestos are at a higher chance of developing the disease.
The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional as they listened to the plaintiff's story. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He blamed the reason for his illness to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $25 million.
J&J has been accused of obfuscating asbestos risks from consumers for a number of years. The company has a long track record of hiding asbestos information from regulators, and even paying for asbestos tests that produced the results they wanted. These lawsuits have identified several of the talcum-powder suppliers for the company, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.
Some women who used talcum for feminine hygiene on sanitary pads or condoms as well as in the genital area have developed ovarian and mesothelioma. The lawsuits assert that J&J was aware for more than 40 years that the powder could trigger ovarian cancer and other diseases, but failed to warn consumers.
Mesothelioma symptoms include abdominal pain, abdominal lumps, abdominal swelling and a persistent cough. Doctors can diagnose the disease through a physical exam and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.
Once a mesothelioma diagnosis is confirmed, patients can undergo surgery, chemotherapy and/or radiation. The surgeons can remove the affected tissue based on the location of the tumors. Patients with mesothelioma can be given a life expectancy of less than five years, however aggressive treatments like extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy may prolong the life expectancy.
What causes Mesothelioma?
Like many cancers, mesothelioma develops by DNA mutations. The mutations cause the cells to multiply uncontrollably and develop tumors in tissues of the body. Asbestos is a frequent cause of mesothelioma. The exposure to asbestos can be found in a variety of industries, including manufacturing, mining construction, transportation and construction. Asbestos exposure is typically seen 20 to 40 years prior to the time symptoms appear. Mesothelioma is more common in males than women, and is most commonly diagnosed in those in their 50s to 70s. The kind of mesothelioma caused by asbestos that a person develops is often determined by where on their body they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma, which affects the lung. Other patients are diagnosed with peritoneal mesothelioma. visit site of mesothelioma affects the abdomen. Some people are diagnosed with pericardial msothelioma. This is a rare form of cancer that affects both the inner lining (pericardium) and the organ itself.
Insomnia, fatigue, and abdominal pain are all symptoms of mesothelioma. In the late stages of mesothelioma, the tumors can spread to different parts of the body, causing severe discomfort and pain. Other symptoms of mesothelioma include fluid in the lungs, nausea and difficulty swallowing and eating. Mesothelioma can be fatal.
The talcum powder trial in Oakland involved a person who was 24 who developed pericardial msothelioma following the use of J&J baby powder. His lawyers claimed that J&J knew that talc was contaminated with asbestos, but didn't warn customers. They also cited a 1998 letter to an J&J executive revealing the possibility of asbestos being in their products.
This is only the latest in a long line of high-dollar verdicts against J&J. In March the jury handed down $18.8 million to a woman who developed mesothelioma ovarian from J&J's talcum powder, and last month the jury in Missouri awarded $55 million in a separate case involving the same issue. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the number of lawsuits in the process. The majority of these lawsuits are filed by women who used J&J talcum powder to maintain their feminine hygiene.
How can I tell whether I have mesothelioma not?
A diagnosis of mesothelioma can be devastating. Patients should always consult a specialist to get the most accurate diagnosis and to avoid false diagnosis, which could result in unnecessary treatment and the spread of cancer.
A physical exam and blood sample can aid in identifying mesothelioma-related symptoms. These tests can be used to test for asbestos fibers in blood or the health of a patient's internal organs. The most accurate way to diagnose mesothelioma is by a biopsy, in which doctors remove fluid or tissue from the affected area and examine the area under a microscope to detect mesothelioma-related cells.
The type of mesothelioma a person has can also affect his or her prognosis. Pleural mesothelioma, that forms in the thin lining around the lungs, is the frequent form of the disease and accounts for the majority of diagnosed cases. Peritoneal cancer, which develops in the lining of the abdomen is a less well-known form. In addition, pericardial mesothelioma is a rare type that develops in the lining of the heart. It only accounts for one percent of all cases.
The first signs include a shortness of breath which gets worse with time, and then coughing up blood. Asbestos patients may also experience fluid accumulation in the chest cavity. This condition is called pleural effusion. It can be eliminated by inserting a needle in the affected area of the chest cavity. In more severe cases, doctors may undergo a procedure called pleurodesis, which seals the area to prevent the reaccumulation in the pleura.
Making sure that mesothelioma is diagnosed correctly is the most reliable way to determine the patient's treatment options and survival rate. There are many options for treatment which include chemotherapy, surgery and radiation. There are also immunotherapy treatments that enhances the immune system to fight mesothelioma and treatment fields for tumors that utilize magnetic fields to kill cancerous cells.
A mesothelioma specialist may also assist patients in understanding various mesothelioma cell types that determine the severity of the cancer and the outlook of the patient. Patients should discuss with their doctor their experience with asbestos exposure to determine if mesothelioma is possible and what treatment options are available.
