A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is to blame for his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J spun off its talc business and filed for bankruptcy.
This year, juries awards in New Jersey and California led to massive settlements in talc-related lawsuits. Plaintiffs blamed their cancer on asbestos found in J&J's Shower Baby and Shower Powder products.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects the mesothelium the lining that surrounds organs and body cavities. It is most often found in the lungs, however it can also be found in the abdomen, the heart and chest cavity, as well as the testicles. Asbestos is the most well-known mesothelioma-related cause and those who have been exposed to asbestos are at a greater chance of developing the disease.
The first trial since J&J declared its talcum powder division bankrupt opened this week, and jurors in Oakland, California were emotional when they heard the testimony of the plaintiff. He attributed his illness to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J has been accused of concealing asbestos-related risks from consumers for a long time. The company has a long tradition of keeping asbestos information from regulators, and even paying for asbestos tests that gave the results they wanted. Several of the company's talcum powder suppliers have been named in these lawsuits and include Whittaker, Clark & Daniels and Imerys Talc America.
Many women who used talcum powder for feminine hygiene in the genital area or on sanitary napkins or condoms have developed an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits assert that J&J knew for more than 40 years that using the powder could cause mesothelioma and ovarian cancer however, they failed to warn consumers of the risk.
The symptoms of mesothelioma are abdominal pain, abdominal lumps, abdominal swelling and a persistent cough. Doctors can diagnose the disease through a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.
When a mesothelioma diagnosis is confirmed, patients can undergo chemotherapy, surgery, or radiation. The surgeons can remove the affected tissue, based on the location of the tumors. Certain patients with mesothelioma have a lifespan less than five. However aggressive treatments like extracorporeal tissue transplantation or chemotherapy for cytoreduction that uses hyperthermic intraperitoneal therapy can prolong survival.
What is the cause of Mesothelioma?
Like all cancers, mesothelioma develops by DNA mutations. These mutations cause uncontrolled growth of cells, which causes tumors to form in tissues. Asbestos is a frequent cause of mesothelioma. Asbestos exposure is common in a variety of industries, including manufacturing, mining and transportation. Asbestos is typically exposed between 20 and 40 years prior to the onset of symptoms appearing. Mesothelioma is more common in males than women, and it is most commonly diagnosed in those in their 50s to 70s. The type of mesothelioma that a person is usually determined by the region of their body that were exposed to asbestos. The majority of mesothelioma patients are diagnosed with pleural msothelioma which affects the lung. Other patients are diagnosed with peritoneal mesothelioma, one type of mesothelioma which affects the abdomen. Additionally, some patients are diagnosed with pericardial mesothelioma. It is the most rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.
Shortness of breath as well as abdominal pain and fatigue are all symptoms of mesothelioma. In the later stages of mesothelioma the tumors may spread to other parts, causing severe discomfort and discomfort. Other typical symptoms of mesothelioma include swelling of the lungs (pleural effusion) and a loss of appetite, difficulties swallowing and a blockage within the small intestine, referred to as a bowel obstruction. The talcum-powder trial in Oakland involved a man of 24 years old who was diagnosed with pericardial mesothelioma as a result of using J&J baby powder. His lawyers argued that the company knew that talc contained asbestos, but didn't inform consumers. They also cited a 1998 letter sent to a J&J executive revealing the possibility of asbestos being present in their products.
This is the latest in a string of large verdicts against J&J. In March the jury handed down $18.8 million to a woman who contracted mesothelioma ovarian from J&J's talcum powder, and last month a jury in Missouri awarded $55 million in another case involving the same issue. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the total number of lawsuits pending. Most of these lawsuits are brought by women who have used J&J talcum powder to maintain their feminine hygiene.

Mesothelioma, an extremely rare and fatal condition caused by asbestos exposure is a rare disease. Asbestos was once used extensively in a variety of consumer and industrial products including baby powder. In talcum-powder cases, plaintiffs claim that exposure to asbestos from inhaling the powder caused them to develop mesothelioma or other health problems.
J&J failed to inform the public about the dangers of asbestos and talcum even though they were aware of them for decades. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. These lawsuits have been consolidated in federal and state multidistrict lawsuits, or MDLs.
In 2018, one of the largest Talc cases resulted in a $4.7 billion verdict in the favor of the plaintiff. The news made headlines across the country and set a tone for the remainder of the litigation. Last month, a court denied J&J's motion to dismiss the lawsuits filed by the state.
J&J however, tried again to stall the litigation. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company established an entity to take over its liabilities. The bankruptcy was able to halt thousands of talc lawsuits, but the 3rd Circuit rejected this strategy.
The lawsuits brought by the state of Mississippi are founded on the same allegations as the individual lawsuits brought against J&J which allege that the company's inability to warn consumers about the dangers of ovarian cancer resulting from the talcum powder was negligent and constituted violations of state law.
J&J has resubmitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J are able to continue. If you or someone you love has been diagnosed with mesothelioma or another condition that could be caused by talcum powder, you should seek legal advice immediately.
