What's The Good And Bad About Mesothelioma Talc Lawsuit
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man aged 24 with mesothelioma pericardial has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case is the first trial that has been held since J&J filed for bankruptcy and split off its talc division.

In the beginning of the year, huge settlements were made in talc suits in New Jersey and California. Plaintiffs linked their cancer to asbestos in J&J's Shower Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma is a fatal form of cancer that affects mesothelium the lining that surrounds organs and body cavities. It is most often found in the lungs, however it can also be found in the abdomen, heart and chest cavity, as well as the testicles. Asbestos is the sole known mesothelioma causing agent and those who have been exposed to asbestos are at greater chance of developing the disease.

The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional as they listened to the story of the plaintiff. In 2022, the plaintiff, who was only 24 years old at the time, old at the time was diagnosed with malignant mesothelioma in the pericardium. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J has been accused of hiding asbestos-related risks from consumers for a long time. The company has a long history of concealing asbestos-related information from regulators, as well as paying for asbestos tests that did not yield the results they desired. These lawsuits have identified several of the talcum-powder suppliers for the company, including Whittaker Clark & Daniels, Imerys Talc America, and other companies.

Some women who used talcum to provide feminine hygiene on pads or condoms, or in the genital region have been diagnosed with mesothelioma and ovarian cancer. The lawsuits assert that J&J knew for more than 40 years that the powder caused mesothelioma and ovarian cancer but did not warn consumers of this danger.

Mesothelioma symptoms include breathing difficulties, constant coughing, abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can diagnose mesothelioma by an examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery, or radiation. The surgeons are able to remove the affected tissue, based on the location of the tumors. Certain patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal tissue transplantation or the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong survival.

What causes Mesothelioma?

Mesothelioma, like most cancers is caused by DNA changes in a cell. These mutations cause cells to multiply uncontrollably and form tumors in the tissues of the body. Asbestos is the most frequent mesothelioma-related cause. Exposure to asbestos can occur at work in many different industries which include manufacturing, mining construction, and transportation. Asbestos exposure usually occurs between 20 to 40 years prior to the time symptoms begin to manifest. Men are more likely to develop mesothelioma compared to women. It is also most often diagnosed in people between the ages 50 and 70. lawsuits mesothelioma of mesothelioma that a sufferer is usually determined by the region of their body that were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural mesothelioma which affects the lungs. Some are diagnosed with peritoneal msothelioma. This kind of mesothelioma affects the abdomen. Certain people are diagnosed with pericardial msothelioma. This is a rare form of cancer that affects both the inner lining (pericardium) as well as the organ itself.

The symptoms of mesothelioma are shortness of breath, fatigue, abdominal pain and weight loss. In the final mesothelioma stages, the tumors can spread to other areas of the body, causing severe pain and discomfort. Other symptoms that are common to mesothelioma include fluid on the lungs (pleural effusion) loss of appetite, difficulty swallowing and a blockage in the small intestine called a bowel obstruction. Mesothelioma can be fatal.

The trial involving talcum powder in Oakland involved a 24-year-old man who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers argued that the company knew talc could contain asbestos, but did not warn consumers about it. They also cited a 1998 letter to a J&J executive revealing the possibility of asbestos in their products.

This is just the latest in a string of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who developed mesothelioma of the ovarian tract from J&J's powder, and last month the jury in Missouri awarded $55 million in a different case involving the same issue. In addition, seven new cases were added to the powder talcum MDL over the last month, bringing the number of lawsuits pending to 37,522. Most of these lawsuits are filed by women who have used J&J talcum powder to maintain their feminine hygiene.

How can I tell whether I have mesothelioma or not?

A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to ensure the most accurate diagnosis and to avoid mistakes that could result in unnecessary treatment and spread of cancer.

A physical exam and a blood test could be an effective way to determine whether mesothelioma has caused symptoms. These tests can detect the presence of asbestos fibers in blood or to look at how well a patient's organs are functioning. The most reliable method of diagnosing mesothelioma is a biopsy. Doctors extract tissues or fluids from an affected area and then examine them under a microscope for mesothelioma cancerous cells.

The type of mesothelioma that a sufferer has also impacts his or her prognosis. Pleural mesothelioma, the most common type of the disease, and accounts for the majority of cases diagnosed. Peritoneal cancer that develops in the lining surrounding the abdomen, is a less common type. In addition, pericardial mesothelioma is a rare kind that is found in the lining of the heart. It is only 1% of all cases.

Some of the first symptoms include shortness of breath which gets worse with time and coughing up blood. Asbestos sufferers may also experience fluid accumulation in the chest cavity. This is known as pleural effusion. It can be removed by inserting a needle into the affected region of the chest cavity. In more severe cases, doctors may use a procedure known as pleurodesis to close the space to prevent reaccumulation of fluid in the pleura.

A precise mesothelioma diagnosis is the best method to determine the patient's treatment options and survival rate. There are a variety of treatments available which include chemotherapy, surgery and radiation. Other options include immunotherapy. It is a form of treatment that enhances the immune system to fight mesothelioma cancer cells and tumor-targeting fields, which use the power of magnets to destroy cancerous cells.

A mesothelioma expert can also help patients understand various mesothelioma cell types which determine the extent of the cancer as well as the outlook of the patient. Patients should discuss with their physician their experiences with asbestos exposure to determine whether mesothelioma could be possible and what treatment options are available.

Mesothelioma is a rare but fatal illness that is caused by exposure to asbestos. Asbestos was used in a variety of consumer and industrial products including baby powder. In talcum-powder cases plaintiffs assert that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma, or other health issues.

J&J failed to inform the public about the dangers of talcum and asbestos even though they were aware of them for many years. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. These lawsuits have been consolidated in federal and state multidistrict lawsuits, or MDLs.

In 2018 one of the first major talc trials resulted in a $4.7 billion verdict for the plaintiff. This was a national news story that set the stage for the rest of the year. Last month, a court denied J&J's request to dismiss the lawsuits brought by the state.

J&J, however, tried again to halt the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated a new entity to assume its obligations. The bankruptcy was able to halt the talc lawsuits of thousands, but the 3rd Circuit rejected this strategy.

The lawsuits filed by the state of Mississippi are built on the same allegations that were a part of the individual lawsuits filed against J&J which allege that the company's inability to warn consumers about the dangers of ovarian cancer from talcum powder was negligent and violated state law.

J&J has submitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to proceed.
