Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A 24-year-old man with mesothelioma of the pericardium has claimed that Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first trial that has been held since J&J filed for bankruptcy and split off its talc division.
In the first quarter of this year, large settlements were reached in talc suits in New Jersey and California. Plaintiffs linked cancer to asbestos in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a deadly type of cancer that affects the mesothelium, the lining that surrounds organs and body cavities. It is most commonly found in the lungs, but it can also be found in the abdomen, heart, chest cavity and testicles. Asbestos, the sole known cause of this illness, is asbestos. People who have been exposed are at an increased chance of developing it.
The first trial following J&J declared bankruptcy over its talcum powder division began in Oakland, California this week. Jurors were moved by the story of the plaintiff. The plaintiff, who is just 24 years old, was diagnosed with malignant pericardial mesothelioma 2022. He blamed the reason for his illness to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $26 million.
J&J has been accused of concealing asbestos risks from consumers since decades. The company has a long history of hiding asbestos-related findings from regulators, and even supplying asbestos tests to get the results it desired. A number of the company's talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.
Many women who used talcum powder to maintain feminine hygiene in the genital region or on sanitary napkins, or condoms have gotten cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than 40 years that the powder could cause ovarian cancer as well as other diseases, but failed to warn consumers.
Mesothelioma symptoms can include breathing difficulties, constant coughing abdominal pain, fatigue, and lumps or masses on the abdomen or chest. Doctors can diagnose the disease through a physical examination and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.
When mesothelioma is discovered, patients can undergo surgery, chemotherapy or radiotherapy. Depending on the site of their tumors, surgeons may be able remove the affected tissue. Certain patients with mesothelioma have a life expectancy less than five. However, aggressive treatments such as extracorporeal transplantation of tissue and chemotherapy for cytoreduction that uses hyperthermic intraperitoneal therapy can prolong survival.
What causes Mesothelioma?
Like most cancers, mesothelioma develops by DNA mutations. These mutations cause uncontrolled growth of cells, which forms tumors in tissues. Asbestos is the most common cause of mesothelioma. Asbestos exposure can occur in many different industries including manufacturing, mining and transportation. Asbestos exposure is typically seen 20 to 40 years before symptoms develop. Mesothelioma is more prevalent in men than women, and is most often diagnosed in people in their 50s and 70s. The type of mesothelioma a sufferer is usually determined by the region of their body that were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Other patients are diagnosed with peritoneal msothelioma. This kind of mesothelioma is affecting the abdomen. Certain people are diagnosed with pericardial msothelioma. This is an extremely rare type of disease that affects both the lining (pericardium), and the organ itself.
A lack of breath, fatigue, and abdominal pain are all signs of mesothelioma. In the later stages of mesothelioma, the tumors can grow to other areas which can cause extreme discomfort and discomfort. Other common symptoms of mesothelioma include swelling of the lungs (pleural effusion), loss of appetite, difficulties swallowing and a blockage in the small intestine, referred to as a bowel obstruction. Mesothelioma can be fatal.
The talcum powder trial in Oakland involved a 24-year-old man who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers claimed that J&J knew talc could contain asbestos, but didn't inform consumers. They also cited a 1998 letter to an J&J executive that highlighted the possibility of asbestos in their products.
This is the latest in a string of high-dollar verdicts against J&J. In March the jury awarded $18.8 million to a woman who was diagnosed with mesothelioma ovarian from J&J's talcum powder. Last month a jury in Missouri awarded $55 million in a different case involving the same issue. Seven new cases have been added to the MDL talcum-powder over the past month, which brings the total to 37,522 the number of lawsuits in the process. The majority of these lawsuits involve women who used J&J's Talcum powder to wash their feminine hygiene.
How Can I tell if I have mesothelioma or not?
A diagnosis of mesothelioma can be devastating. Patients should always seek out a specialist to ensure the most precise diagnosis and to avoid mistakes that could lead to unnecessary treatment and spread of cancer.
A physical examination and blood test is an effective way to determine whether mesothelioma may be causing symptoms. These tests can be used to check for asbestos fibers in blood or to assess the health of the patient's internal organs. The most precise method to determine if mesothelioma has been detected is through a biopsy, in which doctors remove fluid or tissue from the affected area and examine it under a microscope to search for mesothelioma cancer cells.
The type of mesothelioma a person has can also influence the prognosis of a patient. Pleural mesothelioma, the most commonly encountered type of disease and accounts for the majority of cases that are diagnosed. Peritoneal cancer, which forms in the lining surrounding the abdomen is a less well-known form. In addition, pericardial mesothelioma which is a rare form of cancer that occurs in the heart's lining is much less common and makes up about one percent of cases.
The first signs include shortness of breath which gets worse with time and a coughing up of blood. manchester mesothelioma lawsuit may also experience fluid buildup in the chest cavity, which is called pleural effusion. The fluid can be drained from the chest cavity by inserting an needle into the affected region. In more severe cases, doctors may perform a procedure called pleurodesis to close the space to prevent the reaccumulation in the pleura.
A reliable diagnosis of mesothelioma is essential to determining a patient's survival rate and treatment options. Treatment options include chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, which boosts the immune systems to fight mesothelioma and treatment fields for tumors that utilize the power of magnets to kill cancerous cell.
A specialist in mesothelioma can help patients understand the different mesothelioma cell types which determine how invasive the cancer is and what the prognosis for the patient is. Patients should discuss with their doctor their history of asbestos exposure to determine if mesothelioma is possible and what treatment options are available.

Mesothelioma, a rare and fatal disease caused by asbestos exposure is a rare disease. Asbestos was once used extensively in a variety of industrial and consumer products including baby powder. In talcum-powder cases, plaintiffs claim that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma and other health issues.
J&J did not warn the public about the dangers of asbestos and talcum, despite knowing them for decades. Plaintiffs have filed mesothelioma lawsuits against the firm seeking damages for punitive and compensatory. These lawsuits have been combined into federal and state multidistrict litigations, also known as MDLs.
In 2018, one of the largest Talc trials ended in an $4.7 billion verdict for the plaintiff. This was a major news story and set the tone for the rest. Last month, a judge ruled against the motion of J&J to dismiss the lawsuits filed by the state of Mississippi.
However, in an effort to stop the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company established an entity that would take on its obligations. The bankruptcy stopped thousands of talc suits, but the 3rd Circuit rejected that strategy.
The lawsuits brought by the state of Mississippi are based on the same allegations as the individual lawsuits filed against J&J that claim that the company's inability to warn of the dangers of ovarian cancer resulting from talcum powder was negligent and constituted violations of the law of the state.
J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June to determine if the lawsuits against J&J are able to proceed. If you or someone you know has been diagnosed with a mesothelioma, or any other condition which could be caused by talcum powder, you should seek legal advice immediately. Our skilled lawyers can assist you in obtaining the compensation you deserve.
