Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is the first trial that has been held since J&J filed for bankruptcy and spun off its Talc division.
This year, juries awards in New Jersey and California led to massive settlements in talc-related lawsuits. Plaintiffs blamed their cancer on asbestos found in J&J's Shower Shower and Baby Powder products.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects the mesothelium the lining around organs and body cavities. It is most common in the lungs, but can also be located in the abdomen and chest cavity. Like all cancers, mesothelioma is caused by DNA mutations. These mutations cause cells to multiply uncontrollably, forming tumors in the tissues of the body. Asbestos is the most frequent mesothelioma cause. Exposure to asbestos can be found in many different industries which include mining, manufacturing, construction and transportation. Asbestos exposure typically occurs in the 20 to 40 years preceding symptoms begin to manifest. Mesothelioma affects men more than women, and it is most often diagnosed in those in their 50s to 70s. The type of mesothelioma that a person is usually determined by the region of their body that were exposed to asbestos. Other symptoms that are common to mesothelioma include swelling of the lung (pleural effusion) loss of appetite, difficulty swallowing and a blockage in the small intestine, referred to as a bowel obstruction. Mesothelioma can be fatal.
The talcum-powder case in Oakland involved an individual of 24 years old who was diagnosed with pericardial mesothelioma as a result of using J&J baby powder. His lawyers argued the company knew that talc was contaminated with asbestos, but didn't warn customers. They also cited a 1998 letter to an J&J executive that highlighted asbestos could be present in their products.
This is the latest in a long line of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in a woman. In the same month, a jury in Missouri handed down $55 million in an identical case. Seven new cases have been added to the MDL talcum-powder over the past month, bringing to 37,522 the total number of pending suits. Most of these lawsuits were filed by women who have used J&J talcum powder to maintain feminine hygiene.

They allege that the company acted negligently in not warning of the possibility of ovarian cancer due to talcum-powder, and that this was an infraction to the law of the state.
J&J has filed a motion to dismiss lawsuits before a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to proceed.
