The Home Office published a report recently on the legality CBD. The report cites peer-reviewed scientific papers and government reports (UK & international), an ACMD call for evidence and earlier ACMD recommendations. It concludes that the current conditions are not sustainable and recommends the development of a legal framework to regulate CBD for consumers.

The UK CBD market continues to grow and customers are becoming more interested in the potential benefits of this cannabinoid. It is a nonpsychoactive cannabinoid that is found in capsules, edibles and drinks as well as in vaping liquids. Dosage

The CBD that is sold in the UK as a food supplement, health product and in vape products (cigs) is mostly derived from 'Industrial hemp' which is also known as Cannabis sativa L. Industrial hemp is cultivated for its fibers and seeds, and has little psychoactive THC. The plant has to be grown under an official Home Office licence, which only allows cultivation of it for preparations that contain the mature stalk, fibre or seeds not leaves or flowers. However, in order to create CBD for consumption in consumer products, it is required to process the entire plant, including flowers and leaves. This results in a CBD Isolate product, however it does contain varying amounts of other phytocannabinoids in the plant.

The concentrations of these additional phytocannabinoids can vary among different varieties of cannabis and even between the plants grown under the same conditions. There isn't much information on the psychoactive effects of these phytocannabinoids in the levels that could be present in consumer CBD products. It was therefore decided to limit the concentrations (9-THC) and its precursor (9 -THCA), in the consumption of CBD products to a level which is unlikely to cause significant psychoactive effects.

The other phytocannabinoids controlled by the FDA were also not to be subjected to a limit because they are hard and expensive to quantify. Limits could also result in unnecessary restrictions for the producers. In addition there is a lack of evidence to suggest that the other phytocannabinoids have any clinically important effects.

The Working Group concludes by recommending that the maximum amount of 9-THC or 9THCA per unit of consumption in the case of a CBD product for use by consumers be set at 50 milligrams. This limit should be reviewed after two years. Furthermore, the Working Group also recommends that an examination of the phytocannabinoids that are controlled in consumer CBD products should be conducted by Dstl, to ensure that these limits are adhered to.

The Working Group has based its recommendations on the available literature and government reports (UK and international) as well as a call for evidence by the ACMD (ACMD, 2021) and prior ACMD reports. In addition the Group has held discussions with representatives of industry, along with staff from the Defence Science and Technology Laboratory and the Government Chemist's Team.

Safety

The CBD that is available in CBD products in the UK mostly comes from the Cannabis sativa L plant (hemp). The majority of hemp in the UK is harvested for its fibers that are used to make rope, clothing and other building materials. The bud and flower of the plant aren't consumed. Farmers are required to eliminate or leave the bud and flowers to rot on the farm. They are only allowed to harvest stalks and seeds to make hemp oil, CBD tinctures, and other CBD-containing CBD products.

A THC limit is in place in the UK but there are other regulations to be adhered to by producers of CBD products. Food and drinks that contain CBD are required to, for example be in compliance with new food regulations, which means that they must be approved prior to being sold. This could take up to a year and cost tens or even hundreds of thousands of pounds.

In 2023 the legal CBD oils will remain legal to purchase in the UK provided they contain at least 1mg of THC per bottle. However, there are a few products that aren't regulated and these are unlikely to stay on the market for very long, considering the evidence that they cause harm. These products that are not regulated can be seized by the police. To avoid this, customers should only purchase products from reputable producers.
