10 Mesothelioma Talc Lawsuit Tricks All Experts Recommend
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old man with pericardial mesothelioma has alleged Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first trial to take place since J&J spun off its Talc business and filed for bankruptcy.

In the beginning of the year, huge settlements were reached in talc cases in New Jersey and California. Plaintiffs attributed cancer to asbestos in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a lethal form of cancer is a disease of the mesothelium lining around organs and cavities within the body. It is most common in the lungs, but can be found in the chest and abdomen cavity. Asbestos is the most well-known mesothelioma-related cause, and people who have been exposed to asbestos are at greater risk of developing this disease.

The first trial since J&J declared its Talcum Powder division bankrupt was opened this week, and jurors in Oakland, California were emotional when they heard the testimony of the plaintiff. In 2022, the plaintiff who was just 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma in the pericardium. He attributed his illness to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J has been accused of concealing asbestos-related risks from consumers for decades. The company has a long tradition of concealing asbestos-related information from regulators, and paying for asbestos tests that did not yield the results they desired. These lawsuits have named several of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and others.

Women who used talcum for feminine hygiene on pads or condoms as well as in the genital area have developed ovarian and mesothelioma. The lawsuits claim that J&J knew for more than 40 years that using the powder led to mesothelioma and ovarian cancer however, they failed to warn consumers of the risk.

Mesothelioma symptoms include breathing difficulties, constant coughing and fatigue, abdominal pain and lumps or masses on the chest or abdomen. Doctors can diagnose the condition by a physical examination and imaging scans. These could include CT (computer tomography) scans, MRIs and PET or X-rays.

When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the location of their tumors, surgeons might be able to remove the affected tissue. Patients with mesothelioma may be given a life expectancy less than five years. However, aggressive treatments like extracorporeal membrane transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy can extend the life expectancy.

What causes Mesothelioma?

Like all cancers, mesothelioma develops when a cell's DNA experiences mutations. The mutations cause the cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is the most frequent mesothelioma-related cause. Asbestos exposure can occur in a variety of industries, including mining, manufacturing and transportation. Asbestos can be exposed for between 20 and 40 years prior to the onset of symptoms appearing. Men are more likely to develop mesothelioma than females. It is also found most often in those between the ages of 50 and 70. The type of asbestos-related mesothelioma that a person develops is often determined by the place on their body they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma which affects the lungs. Others are diagnosed as having peritoneal msothelioma. This kind of mesothelioma is affecting the abdomen. Some patients are diagnosed with pericardial msothelioma. This is an extremely rare type of disease that affects both the lining (pericardium) as well as the organ itself.

Insomnia, fatigue and abdominal pain are all symptoms of mesothelioma. In the final stages of mesothelioma tumors can spread to different areas of the body creating severe discomfort and pain. Other signs of mesothelioma are fluid in the lung, a loss of appetite and difficulty swallowing and eating. Mesothelioma is a debilitating illness that is usually fatal.

The talcum powder trial in Oakland involved a person who was 24 who developed pericardial msothelioma after using J&J baby powder. His lawyers claimed that J&J knew talc could contain asbestos and didn't warn consumers. They also cited a 1998 letter to an J&J executive which revealed asbestos could be present in their products.

This is the latest in a series of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who contracted mesothelioma of the ovarian tract from J&J's powder. Last month, a jury in Missouri awarded $55 million in a different case involving the same issue. Seven new cases have been added to the MDL talcum-powder over the past month, bringing to 37,522 the total number of lawsuits in the process. The majority of these lawsuits concern women who have used J&J's talcum powder for feminine hygiene reasons.

How do I know If I Have Mesothelioma?

A diagnosis of mesothelioma can be devastating. Patients should always consult a specialist to get the most accurate information available and avoid misdiagnosis which could result in unneeded treatment or allow cancer to grow.

A physical examination and blood test is a good start to identify whether mesothelioma has caused symptoms. These tests can be used to check for asbestos fibers in blood, or the health of a patient's internal organs. The most reliable method of diagnosing mesothelioma is taking a biopsy. Doctors remove tissues or fluids from an affected area, and then look at them under a microscope to look for mesothelioma tumor cells.

The type of mesothelioma sufferers have can influence the prognosis of a patient. Pleural mesothelioma that develops in the thin lining that surrounds the lungs, is the most common form of the disease and makes up the majority of diagnosed cases. Peritoneal mesothelioma is a type of cancer that forms in the lining of the abdomen, is less common. The pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is much less common and represents approximately one percent of cases.

The breath is short, and gets worse with time, and bloody coughing are some of the first symptoms. Asbestos sufferers can also experience fluid accumulation in the chest cavity, a condition called pleural effusion. It can be removed by inserting a needle into the affected region of the chest cavity. In more serious cases, doctors may opt to perform pleurodesis, a procedure that seals the cavity to prevent the accumulation of fluid within the pleura.

Getting an accurate mesothelioma diagnosis is the best way to determine the patient's treatment options as well as their survival rate. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, which boosts the immune systems to fight mesothelioma as well as treatment fields for tumors that utilize a magnetic field in order to kill cancerous cell.

A mesothelioma specialist who is specialized can also help patients understand the different mesothelioma cell types which determine how invasive the cancer is and what the patient's prognosis is. Patients should discuss their experience of asbestos exposure with their physician to determine if they're a mesothelioma candidate and learn about the various types of treatment might be available to them.

Mesothelioma is a rare but fatal disease caused by exposure to asbestos. Asbestos was a time when it was widely used in a variety of consumer and industrial products including baby powder. In talcum-powder cases plaintiffs assert that exposure to asbestos through inhalation of the powder led to the development of mesothelioma, or other health issues.

J&J did not inform the public about the dangers of talcum and asbestos even though they were aware of them for decades. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. These lawsuits have been consolidated in federal and state multidistrict lawsuits, or MDLs.

In 2018 one of the largest trial involving talc resulted in a $4.7 billion settlement for the plaintiff. This was a major news story and set a tone for the rest of the litigation. Last month, a court denied J&J's request to dismiss the lawsuits brought by the state.

J&J however, tried to stop the litigation. LTL Management, a subsidiary of J&J, filed for bankruptcy after the company created a new entity to assume its obligations. The bankruptcy ended thousands of talc suits, however, the 3rd Circuit rejected that strategy.

The lawsuits brought by the state of Mississippi are founded on the same allegations that were a part of the individual lawsuits brought against J&J that claim that the company's failure to warn of the dangers of ovarian cancer resulting from talcum powder was negligent and constituted violations of state law.

J&J has resubmitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June in order to determine if the lawsuits against J&J are able to proceed. If you or someone near you has been diagnosed with mesothelioma, or another condition that could be the result of talcum powder. You should seek legal advice as soon as possible.
