This Is The Good And Bad About Mesothelioma Talc Lawsuit
mesothelioma lawsuit navy Against Johnson & Johnson

A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma case marks the first trial to be held since J&J filed for bankruptcy and spun off its Talc division.

This year, juries awards in New Jersey and California led to massive settlements in talc-related lawsuits. Plaintiffs linked cancer to asbestos in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma, which is a fatal form of cancer, affects the mesothelium or lining around organs and cavities inside the body. It is most common in the lungs, but it can be found in the abdomen and chest cavity. Asbestos is the most well-known cause of mesothelioma and those who have been exposed to asbestos are at greater chance of developing the disease.

The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional as they heard the plaintiff's story. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma 2022. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $25 million.

J&J has been accused of obfuscating asbestos-related risks from consumers for decades. J&J has a history of withholding asbestos findings from regulators and even funding asbestos tests to generate the results it wanted. These lawsuits have identified several of the company's talcum-powder suppliers, including Whittaker Clark & Daniels, Imerys Talc America, and others.

Some women who used talcum for feminine hygiene on pads or condoms, or in the genital region have developed ovarian and mesothelioma. The lawsuits assert that J&J knew for more than 40 years that the powder led to ovarian cancer and mesothelioma, but failed to warn customers of this danger.

Mesothelioma symptoms may include breathing difficulties, constant coughing, abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can identify the disease by a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

When a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery and/or radiation. The surgeons are able to remove the affected tissue, based on the location of the tumors. Certain patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal tissue transplantation and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the life of patients.

What causes Mesothelioma?

Like all cancers, mesothelioma develops when a cell's DNA experiences mutations. These mutations cause cells to multiply in uncontrolled ways and form tumors in the tissues of the body. Asbestos is the most common cause of mesothelioma. Asbestos exposure can be found in many different industries including manufacturing, mining, and transportation. Asbestos is typically exposed between 20 and 40 years prior to the onset of symptoms developing. Men are more likely to develop mesothelioma than women. It is also most often diagnosed in those between the ages of 50 and 70. The type of mesothelioma a person is usually determined by the region of their body in which they were exposed to asbestos. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma which affects the lung. Some are diagnosed with peritoneal msothelioma. This type of mesothelioma affects the abdomen. In addition, some individuals are diagnosed with pericardial melanoma, an extremely rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.

A lack of breath, fatigue and abdominal pain are all signs of mesothelioma. In the later stages of mesothelioma, tumors can spread to other parts that cause severe discomfort and pain. Other symptoms that are common to mesothelioma include swelling of the lung (pleural effusion) and a loss of appetite, difficulties swallowing, and a blockage of the small intestine referred to as a obstruction of the bowel. Mesothelioma can be fatal.

The talcum-powder trial in Oakland involved a man of 24 years old who was diagnosed with pericardial mesothelioma as a result of using J&J baby powder. His lawyers claimed that J&J knew that talc was contaminated with asbestos, but did not inform customers. They also cited a letter in 1998 to a J&J executive which revealed the possibility of asbestos in their products.

This is the latest in a long line of large verdicts against J&J. In March the jury awarded $18.8 million to a woman who was diagnosed with ovarian mesothelioma from J&J's talcum powder. Then, last month a jury in Missouri awarded $55 million in another case that involved the same issue. Seven new cases have been added to the MDL talcum powder over the last month, bringing it to 37,522 the total number of lawsuits in the process. Most of these lawsuits were filed by women who used J&J talcum powder to maintain feminine hygiene.

How do I know if I have mesothelioma or not?

A diagnosis of mesothelioma can be devastating. Patients should always consult a specialist to get the most accurate diagnosis possible and prevent misdiagnosis that could lead to unneeded treatment and allow cancer to grow.

A physical examination and a blood sample can help to identify mesothelioma signs. These tests can be used to determine the presence of asbestos fibers in blood or to determine the extent to which a patient's organs are functioning. The most precise method to determine if mesothelioma has been detected is through biopsy, which is when doctors remove fluid or tissue from the affected area, and then examine the area under a microscope to detect mesothelioma-related cells.

The type of mesothelioma that a person has can also influence the prognosis of a patient. Pleural mesothelioma that develops in the thin lining that surrounds the lungs, is the most common form of the disease and makes up the majority of diagnosed cases. Peritoneal mesothelioma, which is a cancer that forms in the abdomen's lining is not as common. The pericardial msothelioma, in turn, is a rare form of cancer that occurs in the lining the heart. It only accounts for 1% of all cases.

The breath is short, and gets worse with time, and a bloody cough are some of the first symptoms. Asbestos sufferers may also experience fluid buildup in the chest cavity, a condition known as pleural effusion. The fluid can be removed from the chest cavity by inserting an needle into the area affected. In more severe cases, doctors may use a procedure known as pleurodesis to seal the space to prevent the reaccumulation in the pleura.

A precise diagnosis of mesothelioma is essential to determining the patient's survival rate as well as treatment options. There are many options for treatment that include surgery, chemotherapy and radiation. There are also immunotherapy treatments that boosts the immune systems to fight mesothelioma as well as cancer treating fields that employ the power of magnets to kill cancerous cell.

A mesothelioma specialist may also assist patients in understanding different mesothelioma types which determine the extent of the cancer as well as the outlook of the patient. Patients should discuss with their doctor their history of asbestos exposure to determine if mesothelioma is an option and what treatment options are available.

Mesothelioma, an extremely rare and fatal condition caused by asbestos exposure is a rare disease. Asbestos was a time when it was widely used in a variety of consumer and industrial products, including baby powder. In talcum-powder cases, plaintiffs claim that exposure to asbestos from inhaling the powder led to the development of mesothelioma and other health issues.

J&J did not warn the public about the dangers of asbestos and talcum even though they were aware of them for decades. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against the company. These claims have been combined into federal and state multidistrict litigations, or MDLs.

In 2018 one of the biggest talc cases led to a $4.7 billion verdict in favor of the plaintiff. This was a major news story that set the stage for the rest. In the last month, a judge denied J&J's request to dismiss the lawsuits filed by the state.

J&J, however, tried again to halt the litigation. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated an entity to take over its liabilities. The bankruptcy stopped hundreds of talc suits however, the 3rd Circuit rejected that strategy.

The lawsuits filed by Mississippi are based upon the same allegations as those of the individual lawsuits filed against J&J. They assert that the company acted negligently in not warning of the risk of ovarian carcinoma from talcum-powder and that this constituted an infraction of the law of the state.

J&J has filed a motion to dismiss lawsuits to another bankruptcy court. A hearing has been scheduled for June in order to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone close to you has been diagnosed with mesothelioma, or another condition that could have been caused talcum powder. You should seek legal advice as soon as possible.
