Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man who is 24 years old and has mesothelioma of the pericardium has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case is the first trial that has been held since J&J filed for bankruptcy and spun off its Talc division.
In the beginning of the year, huge settlements were made in talc lawsuits in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Baby and Shower Powder products.
What is Mesothelioma?
mesothelioma lawsuit after death is a deadly type of cancer that affects the mesothelium or lining that surrounds organs and body cavities. It is most common in the lungs but can also be located in the abdomen and chest cavity. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed are at risk of developing it.
The first trial after J&J declared bankruptcy on its talcum-powder division opened in Oakland, California this week. Jurors were moved by the story of the plaintiff. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma 2022. The plaintiff attributed his condition to childhood use of Johnson & Johnson baby powder. The jury awarded him $25 million.
J&J is accused of obfuscating asbestos risks from consumers since several decades. The company has a long history of obstructing asbestos research from regulators and funding asbestos tests to achieve the results it wanted. A number of the company's talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.
Many women who used talcum powder for feminine hygiene in the genital region or on sanitary napkins, or condoms have developed ovarian cancer, and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could trigger ovarian cancer and other illnesses, but did not take the time to warn consumers.
Mesothelioma symptoms include abdominal pain and abdominal swelling, abdominal lumps, and persistent coughing. Doctors can diagnose mesothelioma by a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.
When a mesothelioma diagnosis is confirmed, patients can undergo chemotherapy, surgery, or radiation. Depending on the location of their tumors surgeons may be able to remove the affected tissue. Patients with mesothelioma may have a lifespan less than five. However aggressive treatments like extracorporeal tissue transplantation or the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the duration of survival.
What causes Mesothelioma?
Like most cancers, mesothelioma develops by DNA mutations. These mutations cause uncontrolled growth of cells, which forms tumors in tissues. Asbestos is the most common cause of mesothelioma. Asbestos exposure is common in a variety of industries such as mining, manufacturing and transportation. Asbestos exposure is typically seen 20 to 40 years before symptoms appear. Men are more likely to develop mesothelioma than females. It is also diagnosed most often among those between the ages of 50 and 70. The kind of mesothelioma caused by asbestos that someone develops is usually determined by where on their body they were exposed. The majority of people diagnosed with mesothelioma are diagnosed with pleural mesothelioma which affects the lung. Some are diagnosed with peritoneal mesothelioma. This kind of mesothelioma is affecting the abdomen. Finally, some people are diagnosed with pericardial mesothelioma, an extremely rare type of the disease that affects the heart's lining (pericardium) and the organ itself.
Shortness of breath, fatigue and abdominal pain are all symptoms of mesothelioma. In the final mesothelioma stages, the tumors can spread to different areas of the body, which can cause severe discomfort and pain. Other signs of mesothelioma can include fluid in the lung, a loss of appetite and difficulty swallowing and eating. Mesothelioma is a terminal illness that is often fatal.
The talcum powder trial in Oakland involved a man aged 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers argued that J&J knew that talc contained asbestos but didn't warn customers. They also cited a 1998 letter sent to an J&J executive that revealed the possibility of asbestos being in their products.
This is the latest in a string of high-dollar verdicts against J&J. In March, J&J's Talcum powder caused ovarian mesothelioma in one woman. In March, a jury in Missouri handed down $55 million in an identical case. In addition, seven cases were added to the talcum powder MDL in the last month, bringing the total number of lawsuits pending to 37,522. The majority of these lawsuits are filed by women who have used J&J talcum powder to maintain their feminine hygiene.
How Do I Know If I Have Mesothelioma?
A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to get the most accurate diagnosis and to avoid false diagnosis, which could lead to unneeded treatment and spread of cancer.
A physical exam and blood sample can help to identify mesothelioma symptoms. These tests can be used to look for asbestos fibers in blood, or the health of a patient's internal organs. The most precise method to determine if mesothelioma has been detected is through biopsy, which is when doctors remove fluid or tissue from the affected area and examine the area under a microscope to search for mesothelioma cancer cells.
The type of mesothelioma a sufferer has also impacts the likelihood of a positive outcome. Pleural mesothelioma, which forms in the thin lining of the lungs, is the common form of the disease and accounts for the vast majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that develops in the abdomen's lining, is less common. In addition, pericardial mesothelioma is a rare form of cancer that occurs in the lining the heart. It is only 1% of all cases.
A shortness of breath that becomes worse over time, and a bloody cough are among the first symptoms. Asbestos sufferers may also experience fluid accumulation in the chest cavity. This condition is called the pleural effusion. This can be drained by inserting a needle in the affected area of the chest cavity. In more severe cases, doctors might perform pleurodesis. This is a procedure which seals the area in order to prevent fluid from accumulating again in the pleura.
A mesothelioma accurate diagnosis is essential to determining the rate of survival for a patient and treatment options. There are many options for treatment which include chemotherapy, surgery and radiation. Other options include immunotherapy which boosts the immune systems to fight mesothelioma as well as cancer treating fields that employ the power of magnets to kill cancerous cell.
A specialized mesothelioma specialist can also help patients understand the various mesothelioma types that determine how aggressive the cancer is and what the patient's prognosis is. Patients should discuss with their physician their history of asbestos exposure to determine whether mesothelioma could be a possibility and what treatment options are available.

Mesothelioma is a rare, but fatal disease that is caused by asbestos exposure. Asbestos was once used extensively in a range of industrial and consumer products including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder led to asbestos exposure, which contributed to mesothelioma as well as other health issues.
J&J allegedly knew about the risk of talcum powder and asbestos for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the company seeking compensatory and punitive damages. These lawsuits have been consolidated in state and federal multidistrict lawsuits, also known as MDLs.
In 2018, one of the largest trial involving talc resulted in a $4.7 billion settlement for the plaintiff. It was a national news story and set the stage for the rest of the year. Last month, a judge rejected the motion of J&J to dismiss the lawsuits brought by the state of Mississippi.
In an attempt to derail the lawsuit, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company created an entity that would take on its liabilities. The bankruptcy stopped the filing of thousands of talc lawsuits, but the 3rd Circuit rejected that strategy.
The lawsuits filed by Mississippi are based on the same allegations as those of the individual lawsuits brought against J&J. They claim that the company was negligent in failing to warn of the possibility of ovarian carcinoma from talcum-powder and that this constituted an infraction of the law of the state.
J&J has submitted its motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone near you has been diagnosed with mesothelioma or another condition that could have been caused talcum powder. You should seek legal counsel immediately. Our experienced attorneys can assist you in obtaining the justice you deserve.
