The Reasons Mesothelioma Talc Lawsuit Is Everywhere This Year
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man aged 24 with pericardial msothelioma claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma trial is one of the first to proceed since J&J spun off its talc business and filed for bankruptcy.

In the beginning of this year, large settlements were made in talc lawsuits in New Jersey and California. Plaintiffs attributed their cancer to asbestos in J&J's Shower to Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects the mesothelium, the lining that surrounds organs and body cavities. It is most often found in the lungs, but it can also be found in the abdomen, the heart, chest cavity and testicles. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed to asbestos are at risk of developing it.

The first trial since J&J declared its Talcum Powder division bankrupt was opened this week, and jurors in Oakland, California were emotional when they heard the testimony of the plaintiff. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He attributed the reason for his illness to his use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J has been accused of hiding asbestos-related risks from consumers for a long time. The company has a long history of hiding asbestos information from regulators, and even paying for asbestos tests that produced the results they desired. A number of the company's talcum powder suppliers have been named in these lawsuits, including Whittaker, Clark & Daniels and Imerys Talc America.

Some women who used talcum to provide feminine hygiene on sanitary pads or condoms, or in the genital region have developed ovarian and mesothelioma. The lawsuits claim that J&J knew for more than 40 years that using the powder caused mesothelioma and ovarian cancer however, they failed to warn consumers of the risk.

Mesothelioma symptoms include breathing problems, chronic coughing, abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can detect mesothelioma with physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.

Once a mesothelioma diagnosis is confirmed, patients can undergo surgery, chemotherapy and/or radiation. Depending on the location of their tumors, surgeons might be able to remove the affected tissue. Patients with mesothelioma may be given a life expectancy of less than five years, however aggressive treatments such as extracorporeal Membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy may prolong the duration of their survival.

What is the cause of Mesothelioma?

Mesothelioma, like most cancers is caused by DNA changes in a cell. These mutations can cause uncontrolled cell growth that creates tumors in the tissues. Asbestos is a frequent cause mesothelioma. Exposure to asbestos can be found in a variety of fields such as manufacturing, mining construction, and transportation. Asbestos is typically exposed 20 to 40 years prior to the onset of symptoms becoming apparent. Mesothelioma is more common in males than women, and is most commonly diagnosed in people in their 50s and 70s. The kind of mesothelioma caused by asbestos that someone develops is often determined by where they were exposed. The majority of mesothelioma patients are diagnosed with pleural msothelioma which affects the lung. Others are diagnosed as having peritoneal msothelioma. This kind of mesothelioma affects the abdomen. Additionally, some patients are diagnosed with pericardial melanoma, an extremely rare type of the disease that affects the heart's lining (pericardium) and the organ itself.

Mesothelioma symptoms include shortness of breath, fatigue and abdominal pain, as well as weight loss. In the latter stages of mesothelioma, tumors can expand to other parts of the body, causing severe discomfort and discomfort. Other signs of mesothelioma can include fluid in the lungs, nausea, difficulty eating and swallowing. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a man of 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos, but did not inform customers. They also cited a letter in 1998 to an J&J executive which revealed the possibility of asbestos in their products.

This is just the latest in a long line of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who contracted mesothelioma ovarian from J&J's talcum powder. Last month, a jury in Missouri awarded $55 million in a different case involving the same issue. In addition, seven cases were added to the powder's MDL over the last month, bringing the number of lawsuits pending to 37,522. The majority of these lawsuits involve women who have used J&J's talcum powder for feminine hygiene purposes.

How do I know if I Have Mesothelioma?

A diagnosis of mesothelioma can be devastating. Patients should always see a specialist to get the most accurate diagnosis possible and avoid misdiagnosis which could lead to unnecessary treatment and let cancer expand further.

A physical examination and blood test can be a good start to identify whether mesothelioma may be causing symptoms. These tests can be used to determine the presence of asbestos fibers in the blood or to assess the extent to which a patient's organs are functioning. The most reliable method to identify mesothelioma is with biopsy, which is when doctors remove tissue or fluid from the affected area and then examine the area under a microscope to look for mesothelioma cells.

The type of mesothelioma that a sufferer has also impacts his or her prognosis. Pleural mesothelioma is the most common type of the disease and is responsible for the majority of cases that are diagnosed. Peritoneal cancer, which develops in the lining around the abdomen is a less well-known type. Finally, pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is much less common and represents approximately 1% of cases.

Some of the earliest symptoms include breathlessness which gets worse with time and coughing up blood. Asbestos sufferers might also experience fluid buildup in the chest cavity, a condition called pleural effusion. It can be eliminated by inserting a needle into the affected area of the chest cavity. In more serious cases, doctors might perform pleurodesis. This is which is a procedure which seals the area in order to prevent the accumulation of fluid in the pleura.

Making sure that mesothelioma is diagnosed correctly is the best way to determine a patient's treatment options as well as their survival rate. Surgery, chemotherapy and radiation are all options. Other options include immunotherapy, which enhances the immune system to fight mesothelioma and treatment fields for tumors that utilize the power of magnets to kill cancerous cells.

A mesothelioma specialist may also help patients understand different mesothelioma types, which determine the severity of the cancer and the patient's outlook. Patients should discuss with their doctor their experience with asbestos exposure to determine whether mesothelioma is an option and what treatment options are available.

Asbestos used to be widely utilized in a variety of consumer and industrial products including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder led to their exposure to asbestos which led to mesothelioma and other health problems.

J&J failed to warn the public about the dangers of asbestos and talcum even though they were aware of them for many years. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against the company. The claims have been amalgamated into federal and state multidistrict litigations, or MDLs.

In 2018, one of the largest talc cases led to a $4.7 billion settlement in favor of the plaintiff. This was a major news story and set a tone for the remainder of the litigation. Last month, a judge denied a motion by J&J to dismiss the lawsuits brought by the state of Mississippi.

However, in an attempt to halt the lawsuit, J&J tried again. The company set up an entity that was a subsidiary to take on its talc liability and LTL Management filed for bankruptcy. The bankruptcy stopped hundreds of talc suits however, the 3rd Circuit rejected that strategy.

The lawsuits brought by Mississippi are based upon the same allegations as those of the individual lawsuits brought against J&J. They allege that the company was negligent in failing to warn of the possibility of ovarian carcinoma from talcum-powder and that this resulted in a violation of state law.

J&J has submitted its motion to dismiss lawsuits to a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to be pursued.
