Why Mesothelioma Talc Lawsuit Might Be Your Next Big Obsession
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old man with pericardial mesothelioma has alleged Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma case is the first one to be held since J&J has dissolved its talc business and filed for bankruptcy.

In the spring of this year, jury awards in New Jersey and California led to big settlements in talc-related lawsuits. Plaintiffs have linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a lethal type of cancer is a disease of the mesothelium the lining that surrounds organs and cavities inside the body. It is most prevalent in the lungs, but can also be found in the abdomen and chest cavity. Asbestos, the only known cause of this disease, is asbestos. People who have been exposed are at risk of developing it.

The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional as they heard the testimony of the plaintiff. In 2022, the plaintiff who was only 24 years old at the time, was diagnosed with malignant mesothelioma of pericardium. He attributed his illness to childhood exposure to Johnson & Johnson baby powder. The jury awarded him $26 million.

J&J has been accused of concealing asbestos risks from consumers since decades. The company has a history of hiding asbestos-related findings from regulators and even funding asbestos tests to generate the results it wanted. Several of the company's talcum powder suppliers have been named in these lawsuits and include Whittaker, Clark & Daniels and Imerys Talc America.

Women who used talcum for feminine hygiene on pads or condoms, or in the genital region have developed ovarian and mesothelioma. The lawsuits claim that J&J knew for more than 40 years that the powder led to mesothelioma and ovarian cancer, but failed to warn customers of the risk.

Symptoms of mesothelioma include abdominal pain as well as abdominal lumps, abdominal swelling, and persistent coughing. Doctors can detect mesothelioma with physical examination and imaging scans. These may include CT (computer tomography) scans, MRIs and PET or X-rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the site of their tumors, surgeons may be able remove the affected tissue. Some patients with mesothelioma have a lifespan less than five. However, aggressive treatments such as extracorporeal tissue transplantation and the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the duration of survival.

What causes Mesothelioma?

Like all cancers, mesothelioma develops by DNA mutations. These mutations cause the cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is the most frequent mesothelioma-related cause. Asbestos exposure is common in a variety of industries such as manufacturing, mining and transportation. lawsuit attorneys mesothelioma occurs in the 20 to 40 years preceding symptoms develop. Men are more likely to develop mesothelioma compared to women. It is also found most often in people between the ages of 50 and 70. The kind of mesothelioma caused by asbestos that a person develops is usually determined by where they were exposed. Most people with mesothelioma are diagnosed with pleural melanoma, which affects the lungs. Other patients are diagnosed with peritoneal melanoma, which is a mesothelioma type that affects the abdomen. Finally, some people are diagnosed with pericardial melanoma, an extremely rare form of the disease that affects the heart's lining (pericardium) and the organ itself.

Insomnia, fatigue and abdominal pain are all symptoms of mesothelioma. In the later stages of mesothelioma, tumors may expand to other parts of the body that cause severe discomfort and pain. Other symptoms of mesothelioma include fluid in the lungs, nausea, difficulty eating and swallowing. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a man of 24 who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers argued the company knew that talc contained asbestos, but didn't warn customers. They also cited a 1998 letter to a J&J executive that highlighted the possibility of asbestos in their products.

This is the latest in a series of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who was diagnosed with ovarian mesothelioma from J&J's talcum powder. Then, last month, a jury in Missouri awarded $55 million in a separate case that dealt with the same issue. In addition, seven cases were added to the talcum powder MDL over the course of the month and brought the total number of pending lawsuits to 37,522. The majority of these lawsuits concern women who used J&J's talcum powder to wash their feminine hygiene.

How Can I Tell if I Have Mesothelioma?

A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to get the most accurate diagnosis and to prevent misdiagnosis, which could lead to unneeded treatment and spread of cancer.

A physical exam and a blood sample can aid in identifying mesothelioma symptoms. These tests can be used to determine asbestos fibers in blood or to look at the way in which the organs of a patient are functioning. The most precise method to identify mesothelioma is with a biopsy, in which doctors remove fluid or tissue from the affected area and then examine it under a microscope to look for mesothelioma cells.

The type of mesothelioma that is present in a patient can affect his or her prognosis. Pleural mesothelioma, which forms in the thin lining around the lungs, is the common form of mesothelioma and makes up the majority of cases diagnosed. Peritoneal cancer that develops in the lining of the abdomen, is a less common type. Lastly, pericardial msothelioma is a rare form of cancer that is found in the lining of the heart. It only accounts for 1percent of all cases.

A shortness of breath that becomes worse over time, and bloody coughing are a few of the initial symptoms. Asbestos patients may also experience fluid accumulation in the chest cavity. This condition is called pleural effusion. The fluid can be eliminated from the chest cavity by inserting a needle into the affected area. In more severe cases, doctors may opt to perform pleurodesis, an operation that seals the space to prevent the fluid from accumulating in the pleura.

Making sure that mesothelioma is diagnosed correctly is the best way to determine the patient's treatment options and survival rate. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, which is a form of treatment that enhances the immune system to fight mesothelioma cells, and tumor treating fields, which use a magnetic field to kill cancerous cells.

A mesothelioma specialist who is specialized can help patients understand the different mesothelioma cells that determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss with their doctor their history of asbestos exposure to determine whether mesothelioma could be an option and what treatment options are available.

Mesothelioma is an extremely rare and fatal condition caused by asbestos exposure, is a rare condition. Asbestos was once used extensively in a range of consumer and industrial products including baby powder. In talcum-powder cases plaintiffs assert that asbestos exposure from inhaling the powder led to the development of mesothelioma and other health issues.

J&J failed to warn the public about the dangers of asbestos and talcum, despite knowing them for many years. Plaintiffs have filed mesothelioma lawsuits against the firm seeking punitive and compensatory damages. These claims have been combined into federal and state multidistrict litigations, also known as MDLs.

In 2018, one of the first major talc trials resulted in an $4.7 billion settlement for the plaintiff. The news made headlines across the country and set a tone for the rest of the litigation. In the last month, a judge denied the motion of J&J to dismiss the lawsuits brought by the state of Mississippi.

However, in an effort to stop the litigation, J&J tried again. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company established a new entity to assume its obligations. The bankruptcy stopped hundreds of talc suits however, the 3rd Circuit rejected that strategy.

The lawsuits filed by the state of Mississippi are based on the same allegations that were a part of the individual lawsuits brought against J&J: that the company's failure to warn consumers about the dangers of ovarian cancer from the talcum powder was negligent and violated state law.
