It would seem that future studies should analyse the possible toxic effects of humectants and related products at concentrations similar to those that e-cigarette vapers are exposed to reach conclusive results. I will point out that there haven’t been enough long-term clinical studies to show that there are zero adverse health effects. I think most people agree, and most studies show, that there is a net benefit if you quit smoking and only use e-cigarettes. If you’re an adult smoker and you just switch from cigarettes to Juul, for example, you’re probably better off in the long run. The issue revolves around the kids, teens, and young people who become attracted to the product and develop a lifetime nicotine addiction. If you can separate that controversy out from the adult usage issue, then the industry would be okay.

They said, “We can never really know this stuff.” It feels like there are echoes of it now, where you can pick a study and it says what you want it to say. In the smokeless market, when they couldn’t figure out how to make a brand that was competing with Copenhagen, they just went out and bought it. And so they started thinking, “Well, let’s buy Juul.” They engaged in negotiations over a very long period of time, starting in 2017. By the time that the CDC got around to announcing that, the damage had already been done for Juul. Their product had taken such a hit on the market, people were so spooked by vaping and by Juul-ing, that by the time that the CDC clarified things, it was too late. There were all sorts of people who were furious at the CDC and the FDA for taking so long to come to that conclusion and for wrongly singling out just vaping as the problem.

Use of e-cigarettes mimics conventional cigarette smoking, and e-cigarettes also contain the same addictive ingredient, nicotine. Violations of these statutes can result in felony convictions and significant criminal fines and civil monetary penalties. They can also result in seizures of unauthorized products, which can help to make illegal e-cigarettes less accessible, including to young people. Through their participation in the task force USMS will help the FDA and the Department effectuate seizures of unauthorized e-cigarettes within the United States. So they said, “If you have your product on the market, we’re not going to enforce against you. To protect our youth, Massachusetts restricted the sale of flavored vapes, pods, and e-juices except in adult-only (21+) smoking bars. Due to federal regulation, no flavored pods, aside from “tobacco” or “menthol,” can be sold nationally. However, MA’s law considers menthol a flavor, so menthol products in MA are also restricted to adult-only smoking bars.
