The Most Prevalent Issues In Mesothelioma Compensation Royal Navy
Mesothelioma Compensation and the Royal Navy

On 16 December 2015, the Ministry of Defence changed their policy to allow service personnel diagnosed with mesothelioma to decide whether to receive an amount in one lump sum or a traditional war pension. The decision, however, was not applicable to all veterans who had been diagnosed with the disease.

Rhod Minall and Fred Palmer were also affected, because they were exposed to asbestos in their military service or in civilian positions. This was a major injustice to them and their families.

The law has changed

Mesothelioma is a deadly, terminal cancer that is caused by exposure to asbestos can take years to manifest. The symptoms can take years to show up and, after being diagnosed with the disease sufferers are expected to live for one or two more years.

The Government's decision to change the law is a huge step in the right direction. From April 2016, veterans of the armed services diagnosed with mesothelioma can choose select whether to receive a pension or a lump sum amounting to PS140,000. This is a more substantial amount than the typical civil award.

Before the changes, members of the armed forces who were diagnosed with mesothelioma had access to the War Disablement Pension. This was an income per month which was not suitable for those suffering from severe chronic diseases like mesothelioma. In addition it was not possible to receive lump sum compensation under the War Pension Scheme.

After intense lobbying, and aided by the Royal British Legion, Asbestos Victims Support Group Forum and the Royal British Legion, the law was changed to allow veterans of the armed forces diagnosed with mesothelioma the right to lump sums of up to PS140,000, addition to the traditional War Pension. The lump sum will be tax-free.

A mesothelioma diagnosis previously would have been eligible for a war-related disability pension of up to PS32,000 if the person was single, divorced or widowed. In contrast, civilians with mesothelioma can receive up to PS600,000 in the Government's Diffuse Mesothelioma Scheme.

All members of the armed forces who have been diagnosed with mesothelioma will be able to choose this option. It is also accessible to those who were exposed to asbestos during their armed forces service and outside of it, known as "dual exposure".

Mesothelioma UK has already started helping former sailors and other armed personnel with mesothelioma-related claims. We can help them understand the new laws and what they entail. We can also assist them in determining the best way to receive compensation. This can include tracing the companies that could be accountable for their exposure to asbestos.

The lump amount will be PS140,000.

The amount of compensation paid to sufferers is based on a range of factors such as age, the impact mesothelioma has on the lifespan and how much care is required. The amount of compensation paid to patients is determined by a range of factors including age, the effect mesothelioma has on life expectancy, and how much care they need.

Asbestos victims must seek compensation from the people responsible for their exposure to asbestos. However, for those not able to locate the responsible party the government scheme will pay an amount in lump sum to patients of mesothelioma. The average amount paid is about PS144,000.

Previously, ex-servicemen diagnosed with mesothelioma would only be eligible for a war-related disability pension under the Diffuse Mesothelioma Scheme 2008. This is a monthly payment based on an individual's age and their level of disablement. However, this is a significantly smaller sum than mesothelioma compensation for civilians that can exceed six figures.

Fred Minall from Northampton who served in the Royal Navy as a naval engineering between 1957 and 1964 was informed that he is entitled to a lump sum payment of PS140,000, under the new law. Mesothelioma is an incurable lung disease that is caused by exposure to asbestos.

According to mesothelioma lawyers, Simpson Millar, this is an enormous victory for mesothelioma patients who have suffered from the disease. The majority of Navy personnel, like many civilians, docked in US ports during their career and were exposed to asbestos-related toxins. This is due to the extensive use of asbestos on American ships in the current. Symptoms of mesothelioma can take decades to show up, and as a result the patients are often left with only a few options to seek compensation.

The Ministry of Defence confirmed that Mesothelioma sufferers, who had not previously been awarded a war-pension, will be offered up to PS140,000 in a lump-sum payment. This will be a significant increase over the amount that non-married veterans with mesothelioma receive under the Diffuse Mesothelioma scheme.

However, this new payment will be deducted from any existing war pension that an individual is entitled to. As a result, it is important that anyone diagnosed with mesothelioma and contemplating applying for this payment seeks the advice of experienced mesothelioma solicitors to ensure they receive the right deal.

It is a win for the Royal British Legion

The Royal British Legion has delivered an enraged rebuke to the government over claims that it has reneged on its promise to establish the military covenant in law. The charity has demanded that the minister explain why the government isn't honouring its commitment to veterans. It has also threatened to pull out of various forums where it has been working with the Ministry of Defence.

Engagement of the Legion with the MoD is crucial, but it must be more productive to ensure that the community's needs are met in a way which makes a real impact on their lives. It is therefore essential that the feedback loop within forums is improved in order that all issues that are not being addressed are understood and the reasons for this are clearly explained.

The Royal British Legion, as the UK's largest and oldest Armed Forces Charity, is located at the heart of a larger network of support for members of the Armed Forces. They are also the organization that is best placed to understand the challenges that those who serve, have served and their widows and widowers.

The fact that mesothelioma patients are often left without financial security is among their most pressing concerns. The compensation that is available is usually not enough to cover the costs of care or living expenses, and it's often not possible to get a mortgage.

Asbest was used in shipbuilding, among other Naval activities. Many veterans are struggling to cope with their ailments and the impact of their illness on their financial situation.

However there are a variety of organisations that can help with this. For example, mesothelioma lawyers can assist in obtaining legal compensation for patients, which can be used to pay for treatment or essential living costs. Mesothelioma sufferers may also seek compensation from the companies who supplied asbestos-containing products.

It will be a welcome sight for veterans

Navy veterans diagnosed with mesothelioma will be able to access a lump sum of PS140,000 according to the Ministry of Defence has announced. This will allow them to receive a substantial financial assistance to ease the financial burden that mesothelioma has caused for their families.

Former service members who have been diagnosed with mesothelioma are sure to appreciate this news. mesothelioma compensation scheme has been modified to allow them to be paid the same amount as civilian patients who have a mesothelioma compensation claim.

The change came about due to an initiative by the Royal British Legion, and other groups. This led to the Prime Minster promising to examine the issue. The change made by the MoD will help many veterans who are dying, and could have been eligible for a war pension, to receive a lump sum. This will provide them with peace of mind and the financial support they need to live the rest of their lives.

Asbestos exposure is linked to mesothelioma. It can take years before symptoms begin to show up however just one exposure can increase the chance of developing the disease. The vast majority of mesothelioma victims were exposed to asbestos at work, which includes Navy shipyards. In the past year, the UK law was changed to allow employees who were exposed to asbestos in the workplace to sue their employers. However, many veterans are unaware that they could be eligible for compensation from the government.

Mesothelioma is a devastating cancer and there aren't words to express the extent it has affected many lives. The decision of the government to address the discrimination against military veterans is a major victory.

However, it's not enough end the suffering of mesothelioma patients as well as their families. They'll also have to seek compensation from the companies who supplied the military with asbestos-based products. Veterans could file trust fund claims against a variety of different corporations depending on where they worked, including bases, shipyards, and ships. This can include large multinationals with a long track record of selling asbestos products to the US Navy or other branches of the military.
