It's Time To Expand Your Mesothelioma Talc Lawsuit Options
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is the cause of his cancer. The Oakland mesothelioma trial is the first trial to be held since J&J filed for bankruptcy and split off its talc division.

In the spring of this year, jury awards in New Jersey and California led to massive settlements in talc-related lawsuits. Plaintiffs attributed cancer to asbestos found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma is a fatal form of cancer that affects the mesothelium, the lining around organs and body cavities. It is most commonly found in the lungs, but it can also be found in the abdomen, the heart, chest cavity and testicles. Asbestos, the only known cause of this disease, is asbestos. People who have been exposed to asbestos are at risk of developing it.

The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional when they heard the story of the plaintiff. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial cancer in 2022. He blamed his condition on childhood exposure to Johnson & Johnson baby powder. The jury awarded him $26 million.

J&J is accused of hiding asbestos-related risks from consumers for decades. The company has a long tradition of keeping asbestos information from regulators, and even paying for asbestos tests that did not yield the results they desired. These lawsuits have named several of the company's suppliers of talcum powder which include Whittaker Clark & Daniels, Imerys Talc America, and others.

Some women who used talcum for feminine hygiene, such as sanitary pads or condoms, or in the genital region have developed ovarian and mesothelioma. The lawsuits claim that J&J was aware for more than forty years that the powder could trigger ovarian cancer and other illnesses, but failed to warn consumers.

Mesothelioma symptoms may include breathing difficulties, constant coughing abdominal pain, fatigue and lumps or masses on the abdomen or chest. Doctors can diagnose mesothelioma through physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo chemotherapy, surgery and/or radiation. Depending on the location of their tumors surgeons might be able to remove the affected tissue. Patients with mesothelioma may be given a life expectancy less than five years, but aggressive treatments such as extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy can prolong the duration of their survival.

What is the cause of Mesothelioma?

Mesothelioma, like most cancers is caused by DNA changes in a cell. The mutations cause the cells to multiply rapidly and develop tumors in tissues of the body. Asbestos is a common cause of mesothelioma. Asbestos exposure can be found in a variety of industries such as mining, manufacturing and transportation. Asbestos exposure usually occurs between 20 to 40 years prior to the time symptoms begin to manifest. Mesothelioma is more common in males than women, and it is most often diagnosed in people who are in their 50s and 70s. The type of mesothelioma that a person gets is often determined by the region of their body that were exposed to asbestos. The majority of patients diagnosed with pleural msothelioma, which affects the lung. Other patients are diagnosed with peritoneal mesothelioma. This kind of mesothelioma is affecting the abdomen. In addition, some individuals are diagnosed with pericardial mesothelioma, the most rare form of the disease that affects the heart's lining (pericardium) and the organ itself.

Symptoms of mesothelioma include fatigue, breathlessness abdominal pain and weight loss. In the later stages of mesothelioma, the tumors can expand to other parts of the body which can cause extreme discomfort and pain. Other typical symptoms of mesothelioma are fluid on the lung (pleural effusion) loss of appetite, difficulties swallowing, and a blockage of the small intestine called a obstruction of the bowel. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a person who was 24 who developed pericardial msothelioma following the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos but didn't warn customers. They also cited a 1998 letter to a J&J executive that revealed the possibility of asbestos being present in their products.

This is just the latest in a series of high-dollar verdicts against J&J. In March the jury handed down $18.8 million to a woman who developed mesothelioma of the ovarian tract from J&J's powder. Then, last month, a jury in Missouri awarded $55 million in another case involving the same issue. In addition, seven cases were added to the talcum powder MDL over the last month which brought the total number of lawsuits pending to 37,522. The majority of these lawsuits are filed by women who have used J&J talcum powder to maintain feminine hygiene.

How Can I Tell if I Have Mesothelioma?

The diagnosis of mesothelioma could be devastating. Patients should always consult an expert for the most accurate diagnosis possible and avoid misdiagnosis that could lead to unneeded treatment and let cancer expand further.

A physical examination and a blood sample can help identify mesothelioma symptoms. Full Write-up can be used to test for asbestos fibers in blood or to assess the health of a patient's internal organs. The most reliable method of diagnosing mesothelioma involves taking a biopsy. Doctors remove tissues or fluids from an affected area and then examine them under a microscope to look for mesothelioma tumor cells.

The type of mesothelioma that is present in a patient can influence their prognosis. Pleural mesothelioma that develops in the thin lining around the lungs, is the common form of the disease and makes up the majority of cases diagnosed. Peritoneal cancer that develops in the lining around the abdomen is a less prevalent type. The pericardial msothelioma, in turn, is a rare kind that is found in the lining of the heart. It is only 1% of all cases.

Some of the first symptoms include shortness of breath that gets worse over time and a coughing up of blood. Asbestos patients can also experience fluid accumulation within the chest cavity. This condition is called Pleural effusion. It can be eliminated by inserting a needle in the affected region of the chest cavity. In more severe cases, doctors may opt to perform pleurodesis, a procedure which seals the area to stop fluid from accumulating again within the pleura.

A precise mesothelioma diagnosis is the best method to determine the patient's treatment options as well as their survival rate. There are a myriad of options for treatment that include surgery, chemotherapy and radiation. Other options include immunotherapy which boosts the immune systems to fight mesothelioma as well as tumor treating fields that use the power of magnets to kill cancerous cell.

A mesothelioma specialist can assist patients in understanding the different mesothelioma cells that determine the extent of the cancer and the patient's outlook. Patients should discuss their history of asbestos exposure with their doctor to determine if they're a mesothelioma candidate and find out what types of treatment might be available to them.

Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos. Asbestos was once used extensively in a range of consumer and industrial products, including baby powder. In talcum-powder lawsuits, plaintiffs claim that exposure to asbestos from inhaling the powder caused them to develop mesothelioma, or other health issues.

J&J believed to have known about the dangers of asbestos and talcum powder for decades but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the firm seeking damages for punitive and compensatory. These claims have been combined into federal and state multidistrict litigations, also known as MDLs.

In 2018, one of the largest talc cases resulted in an $4.7 billion verdict in favor of the plaintiff. This was a major news story and set the tone for the rest of the litigation. In the last month, a judge ruled against a request by J&J to dismiss the lawsuits brought by the state of Mississippi.

In an attempt to derail the lawsuit, J&J tried again. The company set up a new subsidiary entity to take on its talc liability, and LTL Management filed for bankruptcy. The bankruptcy ended thousands of talc suits, but the 3rd Circuit rejected that strategy.

The lawsuits filed by the state of Mississippi are founded on the same allegations that were a part of the individual lawsuits brought against J&J that claim that the company's failure to warn consumers about the dangers of ovarian cancer caused by talcum powder was negligent, and constituted violations of the law of the state.

J&J has submitted its motion to dismiss the lawsuits to a different bankruptcy court. A hearing is scheduled for June in order to determine if the lawsuits against J&J are able to proceed. If you or someone you know has been diagnosed with a mesothelioma or other disease that could have been caused by talcum powder, you should seek legal advice immediately. Our lawyers are experienced and can assist you in obtaining the compensation you're entitled to.
