5 The 5 Reasons Mesothelioma Talc Lawsuit Is Actually A Great Thing
Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A 24-year-old man with pericardial mesothelioma has alleged Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma case is the first trial to take place since J&J has dissolved its Talc business and filed for bankruptcy.

Earlier this year, jury awards in New Jersey and California led to massive settlements in talc lawsuits. Plaintiffs linked cancer to asbestos found in J&J products Shower to Shower and baby powder.

What is Mesothelioma?

Mesothelioma can be a deadly form of cancer that affects mesothelium or lining that surrounds organs and body cavities. It is most common in the lungs, but can be found in the chest and abdomen cavity. Asbestos is the only known mesothelioma-related cause and those who have been exposed to asbestos are at a greater risk of developing this disease.

The first trial since J&J declared its Talcum Powder division bankrupt began this week, and jurors in Oakland, California were emotional as they heard the plaintiff's story. In 2022, the plaintiff, who was only 24 years old at the time, was diagnosed with malignant mesothelioma of pericardium. He blamed the cause of his condition to his use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.

J&J has been accused of concealing asbestos risks from consumers since many years. The company has a long history of hiding asbestos information from regulators, as well as paying for asbestos tests that gave the results they desired. Several of the company's talcum powder suppliers have been named in these lawsuits, including Whittaker, Clark & Daniels and Imerys Talc America.

Many women who used talcum powder for feminine hygiene in the genital areas or on sanitary napkins or condoms have developed cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits claim that J&J knew for more than 40 years that the powder caused mesothelioma and ovarian cancer however, they failed to warn consumers of this danger.

Mesothelioma symptoms include abdominal pain, abdominal swelling, abdominal lumps and persistent coughing. Doctors can identify the disease through a physical exam and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

If a mesothelioma diagnosis has been confirmed, patients may undergo surgery, chemotherapy and/or radiation. The surgeons can remove affected tissue depending on the location of the tumors. Certain patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal transplantation of tissue and chemotherapy for cytoreduction that uses hyperthermic intraperitoneal therapy can prolong the duration of survival.

What is the cause of Mesothelioma?

Mesothelioma, like most cancers is caused by DNA mutations in cells. These mutations can cause uncontrolled cell growth that forms tumors in tissues. Asbestos is the leading mesothelioma cause. Asbestos exposure can occur in many different industries, including mining, manufacturing construction, and transportation. Asbestos exposure is typically seen 20 to 40 years before symptoms develop. Mesothelioma affects men more than women, and it is most commonly diagnosed in people in their 50s to 70s. The type of mesothelioma that a person is usually determined by the region of their body where they were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural mesothelioma that affects the lung. Some are diagnosed with peritoneal mesothelioma. a type of mesothelioma that affects the abdomen. Some patients are diagnosed with pericardial msothelioma. This is a rare form of the disease which affects both the liner (pericardium), and the organ itself.

A lack of breath, fatigue and abdominal pain are all signs of mesothelioma. In the last stages of mesothelioma, tumors may expand to other parts of the body that cause severe discomfort and discomfort. Other signs of mesothelioma can include fluid in the lungs, loss of appetite, difficulty eating and swallowing. Mesothelioma is a debilitating illness that is usually fatal.

The talcum powder trial in Oakland involved a man aged 24 who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that J&J knew that talc might contain asbestos, but didn't inform consumers. They also cited a letter in 1998 to a J&J executive which revealed asbestos could be present in their products.

This is the latest in a string of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in one woman. Last month, another jury in Missouri handed down $55 million in an identical case. Seven new cases have been added to the MDL talcum-powder in the last month, which brings the total to 37,522 the total number of pending suits. The majority of these lawsuits involve women who have used J&J's talcum powder to wash their feminine hygiene.

How Can I Tell If I Have Mesothelioma?

A diagnosis of mesothelioma could be devastating. Patients should always consult a specialist to get the most accurate information available and prevent misdiagnosis that could lead to unnecessary treatment and let cancer expand further.

A physical exam and blood sample can aid in identifying mesothelioma symptoms. These tests can be used to determine the presence of asbestos fibers in blood or to look at how well a patient's organs are functioning. The most precise method to determine if mesothelioma has been detected is through a biopsy, where doctors remove tissue or fluid from the affected area, and then examine the area under a microscope to search for mesothelioma cancer cells.

The type of mesothelioma is present in a patient can affect his or her prognosis. Pleural mesothelioma, which forms in the thin lining that surrounds the lungs, is the most frequent form of the disease and accounts for the vast majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that forms in the lining of the abdomen is less prevalent. The pericardial mesothelioma, a rare type of cancer that develops in the heart's lining, is much less common and makes up around 1% of cases.

Some of the first symptoms include a shortness of breath which gets worse with time, and then coughing up blood. Asbestos patients may also experience fluid accumulation within the chest cavity. This is known as the pleural effusion. The fluid can be eliminated from the chest cavity by inserting a needle into the area affected. In more serious cases, doctors can perform a procedure called pleurodesis to close the space to prevent the reaccumulation in the pleura.

Getting an accurate mesothelioma diagnosis is the best method to determine the patient's treatment options and the survival rate. Surgery, chemotherapy, and radiation are all options. mesothelioma lawsuit settlements include immunotherapy which boosts the immune systems to fight mesothelioma as well as cancer treating fields that employ magnetic fields to kill cancerous cells.

A mesothelioma expert can also assist patients in understanding different mesothelioma cells that determine the extent of the cancer and the outlook of the patient. Patients should discuss their experience of exposure to asbestos with their doctor to determine if they are mesothelioma-related and find out what types of treatment might be available to them.

Mesothelioma is a rare, but fatal disease that is caused by asbestos exposure. Asbestos used to be widely used in many industrial and consumer products, including baby powder. In talcum powder cases plaintiffs assert that exposure to asbestos from inhaling the powder led to the development of mesothelioma and other health issues.

J&J believed to have known about the dangers of talcum powder and asbestos for a long time, but failed to warn consumers. Plaintiffs have filed mesothelioma lawsuits against the company seeking punitive and compensatory damages. The claims have been combined in federal and state multidistrict lawsuits, also known as MDLs.

In 2018, one of the largest Talc cases resulted in a $4.7 billion verdict in favor of the plaintiff. This made national headlines and set the tone for the rest of the litigation. In the last month, a judge denied J&J's request to dismiss the lawsuits brought by the state.

However, in an attempt to stop the litigation, J&J tried again. LTL Management, a subsidiary of J&J was forced to file for bankruptcy after the company incorporated a new entity to assume its liabilities. The bankruptcy stopped thousands of talc lawsuits, but the 3rd Circuit rejected this strategy.

The lawsuits brought by the state of Mississippi are based on the same allegations that were a part of the individual lawsuits filed against J&J that claim that the company's failure to warn consumers about the dangers of ovarian cancer resulting from talcum powder was negligent and violated the law of the state.

J&J has submitted its motion to dismiss lawsuits to a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to be pursued. If you or someone you know has been diagnosed with a mesothelioma, or any other condition that could have been caused by talcum powder you should seek legal representation immediately.
