Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man who is 24 years old and has pericardial mesotheliom claims that Johnson & Johnson baby powder is responsible for his cancer. The Oakland mesothelioma case is the first trial to be held since J&J filed for bankruptcy and split off its talc division.
In the early part of the year, huge settlements were made in talc lawsuits in New Jersey and California. Plaintiffs have linked cancer to asbestos in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a lethal type of cancer that affects the mesothelium, or the lining that surrounds organs and cavities inside the body. It is most common in the lungs but can be found in the abdomen and chest cavity. Asbestos is the only known mesothelioma causing agent, and people who have been exposed to asbestos are at greater risk of developing this disease.
The first trial since J&J declared its talcum powder division bankrupt opened this week and jurors in Oakland, California were emotional as they heard the plaintiff's story. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He attributed the reason for his illness to his use of Johnson & Johnson Baby Powder. The jury awarded him $26 million.
J&J has been accused of hiding asbestos risks from the public for a long time. The company has a long track record of concealing asbestos-related information from regulators, and even paying for asbestos tests that produced the results they wanted. These lawsuits have named several of the company's talcum-powder suppliers such as Whittaker Clark & Daniels, Imerys Talc America, and others.
Many women who used talcum powder to maintain feminine hygiene in the genital areas or on sanitary napkins or condoms have developed cancer of the ovary, and a few have been diagnosed with mesothelioma. The lawsuits assert that J&J was aware for more than forty years that the powder could cause ovarian cancer as well as other illnesses, but failed to warn consumers.
The symptoms of mesothelioma are abdominal pain and abdominal lumps, abdominal swelling and a persistent cough. Doctors can detect mesothelioma with an examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X-rays.
Once a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery, or radiation. The surgeons can remove affected tissue, based on the location of the tumors. Certain patients with mesothelioma have a lifespan less than five. However, aggressive treatments such as extracorporeal tissue transplantation or the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong survival.
What is the cause of Mesothelioma?
Mesothelioma, like most cancers is caused by DNA changes within a cell. These mutations cause uncontrolled cell growth, which creates tumors in the tissues. Asbestos is the most frequent mesothelioma cause. Asbestos exposure is common in a variety of industries, including manufacturing, mining, and transportation. Asbestos exposure is typically seen 20 to 40 years prior to the time symptoms appear. Mesothelioma is more common in males than women, and it is most often diagnosed in those in their 50s to 70s. The type of mesothelioma that a sufferer is usually determined by the part of their body where they were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural melanoma, which affects the lung. Others are diagnosed as having peritoneal msothelioma. This type of mesothelioma affects the abdomen. lawsuit for mesothelioma are diagnosed with pericardial msothelioma. This is an extremely rare type of the disease which affects both the inner lining (pericardium) and the organ itself.
Mesothelioma symptoms include shortness of breath, fatigue, abdominal pain and weight loss. In the last stages of mesothelioma, the tumors may grow to other areas which can cause extreme discomfort and discomfort. Other common symptoms of mesothelioma are fluid on the lung (pleural effusion) and a loss of appetite, difficulty swallowing, and a blockage of the small intestine called a bowel obstruction. Mesothelioma can be fatal.
The trial involving talcum powder in Oakland involved a 24-year-old man who developed pericardial mesothelioma from the use of J&J baby powder. His lawyers argued that the company knew that talc contained asbestos and didn't warn consumers. They also cited a 1998 letter to an J&J executive that revealed the possibility of asbestos in their products.
This is the latest in a string of major verdicts against J&J. In March, a jury handed down $18.8 million to a woman who contracted mesothelioma ovarian from J&J's talcum powder, and last month a jury in Missouri awarded $55 million in a different case that involved the same issue. Seven new cases have been added to the MDL talcum powder over the last month, bringing to 37,522 the number of lawsuits pending. The majority of these lawsuits concern women who used J&J's talcum powder for feminine hygiene purposes.
How Can I Tell if I Have Mesothelioma?
A diagnosis of mesothelioma could be devastating. Patients should always consult an expert to obtain the most accurate diagnosis possible and prevent misdiagnosis that could result in unneeded treatment or allow cancer to expand further.
A physical exam and a blood test can be a good start to identify whether mesothelioma has caused symptoms. These tests can be used to test for asbestos fibers in blood, or the health of the patient's internal organs. The most accurate method of diagnosing mesothelioma is taking a biopsy. Doctors extract tissue or fluids from the affected area, and then look at them under a microscope to look for mesothelioma tumor cells.
The type of mesothelioma a person has also affects the prognosis of their patient. Pleural mesothelioma is the most prevalent type of disease and is responsible for the majority of cases diagnosed. Peritoneal mesothelioma, a cancer that forms in the lining of the abdomen, is less common. The pericardial mesothelioma, a rare type of cancer that develops in the heart's lining is much rarer and only represents about 1percent of cases.
Some of the first symptoms include a shortness of breath that becomes worse over time and a coughing up of blood. Asbestos victims might also experience fluid buildup in the chest cavity, a condition called pleural effusion. It can be eliminated by inserting a needle in the affected region of the chest cavity. In more severe cases, doctors might perform a procedure called pleurodesis to close the space to prevent reaccumulation of fluid in the pleura.
A reliable diagnosis of mesothelioma is crucial to determine the patient's survival rate as well as treatment options. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, a form of treatment that enhances the immune system to fight mesothelioma cancer cells, and tumor treating fields, which employ an electromagnetic field to kill cancerous cells.
A mesothelioma specialist can assist patients in understanding the different mesothelioma types which determine the extent of the cancer as well as the patient's outlook. Patients should discuss with their doctor their experience with asbestos exposure to determine whether mesothelioma is a possibility and what treatment options are available.

Mesothelioma, an extremely rare and fatal condition caused by asbestos exposure is a rare disease. Asbestos was once used extensively in a variety of consumer and industrial products, including baby powder. In talcum-powder cases plaintiffs claim that exposure to asbestos through inhalation of the powder caused them to develop mesothelioma and other health issues.
J&J failed to inform the public about the dangers of asbestos and talcum, despite knowing them for many years. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against the company. The claims have been amalgamated into federal and state multidistrict litigations, also known as MDLs.
In 2018 one of the biggest Talc cases resulted in a $4.7 billion verdict in the favor of the plaintiff. This was a major news story and set the stage for the remainder of the litigation. Last month, a court denied J&J's motion to dismiss the lawsuits brought by the state.
However, in an effort to stop the lawsuit, J&J tried again. The company set up a new subsidiary entity to assume its talc liabilities and LTL Management filed for bankruptcy. The bankruptcy stopped thousands of talc lawsuits however, the 3rd Circuit rejected this strategy.
The lawsuits filed by the state of Mississippi are based on the same allegations that were a part of the individual lawsuits against J&J: that the company's failure to warn of the dangers of ovarian cancer caused by the talcum powder was negligent and violated state law.
J&J has submitted its motion to dismiss the lawsuits to another bankruptcy court. A hearing is scheduled for June in order to determine if the lawsuits against J&J can proceed. If you or someone you love has been diagnosed with mesothelioma, or any other condition that could be caused by talcum powder you should seek legal assistance immediately.
