Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A 24-year-old with pericardial msothelioma claims that Johnson & Johnson baby powder is to blame for his cancer. The Oakland mesothelioma trial is the first to proceed since J&J has dissolved its Talc business and filed for bankruptcy.
In the spring of this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs have linked cancer to asbestos found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma can be a deadly form of cancer that affects mesothelium or lining that surrounds organs and body cavities. It is most prevalent in the lungs, but can also be located in the chest and abdomen cavity. Asbestos is the most well-known mesothelioma causing agent and those who have been exposed to asbestos are at a higher risk of developing this disease.
The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional as they heard the plaintiff's story. The plaintiff, who is just 24 years old was diagnosed with malignant pericardial mesothelioma 2022. He blamed the cause of his illness to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $26 million.
J&J has been accused of obfuscating asbestos-related risks from consumers for a long time. The company has a long history of hiding asbestos information from regulators, and paying for asbestos tests that did not yield the results they wanted. The lawsuits have identified a number of the company's talcum-powder suppliers such as Whittaker Clark & Daniels, Imerys Talc America, and other companies.

The lawsuits claim that J&J was aware for more than forty years that the powder could trigger ovarian cancer and other illnesses, but failed to warn consumers.

What Causes Mesothelioma?
Like many cancers, mesothelioma is caused when a cell's DNA experiences mutations. These mutations can cause uncontrolled cell growth, which forms tumors in tissues. Asbestos is the most common mesothelioma-related cause. Asbestos exposure can be found in a variety of industries, including mining, manufacturing construction, transportation and construction. Asbestos is usually exposed for between 20 and 40 years prior to symptoms appearing. The trial involving talcum powder in Oakland involved a man of 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers claimed that J&J knew talc could contain asbestos, but did not warn consumers about it. They also cited a letter in 1998 to an J&J executive that revealed the possibility of asbestos in their products.
This is just the latest in a string of major verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. In March, a jury in Missouri handed down $55 million in the same case. In addition, seven new cases were added to the powder talcum MDL over the last month and brought the total number of pending lawsuits to 37,522. Most of these lawsuits are brought by women who have used J&J talcum powder to maintain feminine hygiene.

The lawsuits brought by Mississippi are based on the same allegations of the individual lawsuits brought against J&J. They assert that the company acted negligently in failing to warn of the possibility of ovarian carcinoma due to talcum-powder, and that this was an infraction to the law of the state.
J&J has submitted its motion to dismiss lawsuits before a different bankruptcy court. A hearing is scheduled for June in order to determine whether the lawsuits against J&J will be allowed to continue.
