Settlement of a Medical Malpractice Lawsuit
Settlements can be used to end a medical negligence lawsuit without having to go through a trial. In most cases, defendants will pay a lump-sum to the plaintiff to cover their losses.
Compensation can vary greatly depending on your circumstances and the laws of your state. An experienced lawyer from the Erb's Palsy can help you determine the value of your claim is worth.
Breech birth
The brachial plexus is a network of nerves that transmits signals from the spinal cord to the elbow, shoulder and fingers. If these nerves are injured during childbirth, it might cause arm paralysis. Erb's syndrome is one form of brachial plexus birth injury that can be mild or severe. It affects the upper section of nerves in the brachial plexus and usually does not prevent movement of the lower arms (like shaking fingers).
A breech delivery is a birth where an infant's feet emerge first instead of its head. It can cause the shoulders of a baby to become stuck in the birth canal. In these instances, doctors will often employ forceps or tubes to lift the shoulders of the baby out of the birth canal. This can result in nerve damage that can lead to erb’s palsy.
In less severe cases of the Erb's Palsy the upper nerves of the brachialplexus can be stretched without tear. This condition is referred to as neuropraxia. It will heal on its own within about a couple of weeks. In more severe instances it is possible that the lower nerves within the brachial plexus may also be damaged. These injuries are more difficult to recover from and can lead to the formation of scar tissue, known as a neuroma. It can press on healthy nerve fibers, limiting the healing process.
Gestational diabetes
Macrosomia may occur in the case of a pregnant mother who develops gestational diabetes. This occurs when the foetus converts excess glucose into fat, which results in an extremely large baby. Babies with larger sizes are at a greater risk of shoulder dystocia, brachial plexus injury and other birth injuries.
Doctors must be alert when treating a woman suffering from gestational diabetes to check for signs of macrosomia. This means checking the mother's blood sugar, taking insulin, and delivering the baby via C-section if needed.
The job of an obstetrician during childbirth is to give birth safely, without causing injury to the mother or child. If the doctor causes Erb’s palsy by pulling too hard on a baby's shoulders or body, this could be medical negligence. The legal issues in this kind of case are usually centered around what the healthcare professional should have done and if they breached their duty to act in a reasonable manner under the given circumstances. The victim can recover compensation for their medical bills, lost wages, pain and suffering, and mental anxiety. To commence a lawsuit, you should schedule a consultation with a seasoned lawyer.
Shoulder dystocia
In some cases, the baby's shoulders can become stuck between the pelvic bones during the birth. This is called shoulder dystocia. It could be an extremely serious birth complications. If it causes injury to the nerves that control the arm and shoulder and arm, it could cause Erb's palsy. In the most severe instances, it may cause oxygen deprivation to the baby during birth.
Doctors have several maneuvers they can employ to assist a baby out of the position safely. They can also perform C-sections while the mother is in anesthesia, which is safer for the baby and mother.
If the doctor uses too much force or pressure on the baby's head during this procedure this can result in an injury to the brachial plexus. This is called a shoulder dystocia or a type of Erb's Palsy, also known as brachial plexus birth palsy.
erb's palsy lawsuit hayward is caused due to an injury to nerves that connect the spine, shoulder, arm and hands. It can result in a permanent loss of muscle motion and feeling, or it may be temporary and recover within days to months.
Cephalopelvic disproportion
CPD occurs when the baby's head grows larger than the mother's pelvic cavity during labor. This condition requires assisted delivery methods, such as vacuum extractors or forceps to facilitate vaginal birth. This kind of delivery could cause serious injuries to mother and baby, like Erb's palsy.
If doctors suspect CPD they should prescribe medications such as Pitocin in order to help the process of labor. They should also be prepared to perform a Cesarean section if necessary to avoid serious complications.
Unfortunately, CPD cannot always be identified before labor commences. If a doctor suspects that labor isn't progressing according to plan and they want to examine the mother's pelvic bones and use instruments such as ultrasounds and radiologic Pelmetography. They must also be looking for signs of CPD such as a slow thinning of the cervical cervix or lack of dilation. If a doctor fails to recognize CPD, a child could be seriously injured during vaginal birth or be forced to undergo an emergency Cesarean.
Birth trauma
A birth injury caused due to medical negligence can have an impact on your child's future. It may prevent your children from participating in certain activities such as playing sports or using their hands. It could also have a negative psychological impact on your child.
A successful birth injury lawsuit can provide families the compensation needed to cover life-long medical and treatment. Additionally, it can help pressure medical professionals to keep patients safe and ensure that they are following standard procedure.
In a few instances the brachial plexus injury can be caused by a doctor's mistake or negligence during the delivery. The symptoms may include a loss of muscle motion specifically in the shoulder, arm wrist, hand and wrist. In a physical examination, doctors will look for any indications of nerve damage or limited mobility in the affected area. They typically use a sequence of tests to pinpoint the injury, including electromyography. This test evaluates the electrical activity of muscles, and could reveal nerve damage. In severe cases of Erb’s palsy, the nerves are completely cut off at their root (a condition referred to as avulsion). This requires surgery to splice and graft healthy nerves in order to restore mobility.
