Why People Don't Care About Mesothelioma Compensation Royal Navy
Mesothelioma Compensation and the Royal Navy

On 16 December 2015 the Ministry of Defence changed their policy to allow service members diagnosed with mesothelioma the option of choosing whether they want to receive a lump sum or a traditional war pension. However, the change did not apply to all veterans who had already been diagnosed with the disease.

Rhod Minall and Fred Palmer were also affected, because they were exposed to asbestos during their military service or in civilian positions. This was a massive injustice for them as well as their families.

The law has changed

Mesothelioma is a virulent type of cancer that is triggered by exposure to asbestos. It can take decades for symptoms to show and once diagnosed, most sufferers will live for a minimum of one or two years.

The government's decision to alter the law is a huge step in the right direction. From April 2016, armed forces veterans diagnosed with mesothelioma will be able to decide whether they want to receive a pension or receive an amount of lump sum up to PS140,000. This is a significantly greater amount than a typical civil award.

Before the changes, members of the armed forces diagnosed with mesothelioma had access to an War Disablement Pension. However, this only provided an income that was regular and monthly, and was not suitable for those suffering from severe long-term illnesses such as mesothelioma. The War Pension Scheme did not provide lump-sum compensation.

After a lot of lobbying, backed by the Royal British Legion and Asbestos Victims Support Group Forum, the law has been modified to allow armed forces veterans diagnosed with mesothelioma access to an amount of up to PS140,000 in addition to traditional War Pension. The lump sum will also be tax-free.

Prior to this, a mesothelioma diagnosis could have qualified someone for a war-related disability pension up to PS32,000 regardless of whether they were single, divorced, or widowed. Contrary to this, civilians diagnosed with mesothelioma can receive up to PS600,000 in the Government's Diffuse Mesothelioma Scheme.

The new law will be applicable to all veterans of the armed forces diagnosed with mesothelioma and who wish to take up this option. It will also be accessible to those who were exposed to asbestos during their time in the armed forces and in other circumstances known as 'dual exposure'.

Mesothelioma UK is already helping former soldiers, sailors and other service members with their mesothelioma claim. We can help them to learn about the new law and what's involved. We can also assist them discover the best method of obtaining compensation. This could include tracing the companies that may be accountable for their exposure to asbestos.

The lump sum amount will be PS140,000

The level of compensation awarded to patients is determined by various factors, like age, the impact mesothelioma can have on the life expectancy and how much care is needed. It also takes into account the effect mesothelioma's cancer has had on family members and whether or not the patient can work.

Asbestos victims should seek compensation from those accountable for their exposure to asbestos. For those who are unable to find those responsible, a government-sponsored scheme pays lump sums to those suffering of mesothelioma. The average amount awarded is around PS144,000.

Former servicemen diagnosed with mesothelioma diffuse weren't able to claim the pension for war disabilities under the Diffuse Mesothelioma Scheme 2008 It is a monthly payment based on an individual's age and the degree of their disability. However, this is a significantly smaller sum than the mesothelioma settlement for civilians that can exceed six figures.

Fred Minall, 74 from Northampton Fred Minall, who worked as an engineer in the naval sector of the Royal Navy between 1957 and 1965, has now been informed that he'll be entitled to a lump sum of PS140,000 under the new law. He has mesothelioma - an incurable lung cancer caused by asbestos exposure.

Simpson Millar, a mesothelioma lawyer, believes this is a huge victory for veterans with mesothelioma. The majority of Navy personnel as well as a lot of civilians, docked at US ports throughout their careers where they were exposed to harmful asbestos fibres. This is due to the widespread use of asbestos in American ships during this time. The symptoms of mesothelioma may not be apparent for a long time leaving veterans with very only a few options for compensation.

The Ministry of Defence has confirmed that mesothelioma patients who have not been previously granted an army pension will receive a lump sum of up to PS140,000. This is a substantial improvement over the current amount that non-married veterans suffering from mesothelioma receive under the Diffuse Mesothelioma scheme.

The new payment will be taken out of the current war pension an individual receives. It is therefore important that anyone with mesothelioma who is considering applying for this type of payment seeks advice from an experienced mesothelioma lawyer to ensure that they get the best price.

It is a win for the Royal British Legion

The Royal British Legion has issued an abrasive critique of the government over failing to keep its promise to legislate the military covenant. The charity has asked the minister to explain why the government isn't honoring its pledge to veterans. It has also threatened to pull out of various forums in which it has been working with the Ministry of Defence.

The Legion's involvement with the MoD is important however, it must be more effective to ensure that the community is taken care of in a manner that can make a difference to their lives. It is essential that the feedback loop within forums is improved in order that all issues that are not being addressed are recognized and the reasons for this are clearly explained.

The Royal British Legion, as the UK's largest and oldest Armed Forces Charity, is situated at the heart of a national network of support for members of the Armed Forces. The Royal British Legion is the most effective organisation to understand the issues facing those who have served, their widows and orphans and their families.

One of the major concerns of mesothelioma sufferers is that they are frequently left without a financial security because of their illness. The amount of compensation available is usually not enough to cover the cost of treatment or living expenses, and it is usually not feasible to obtain a mortgage.

This is particularly applicable to Navy veterans who have been diagnosed with mesothelioma because asbestos was utilized in shipbuilding and other Naval activities. Many veterans are struggling with their symptoms and the impact of their condition on their financial situation.

There are numerous organizations that can help. For instance, mesothelioma lawyers can help to secure legal compensation for sufferers. This can be used to pay for treatment or to cover the essential expenses of living. mesothelioma compensation claim may also seek compensation from companies that supplied asbestos-containing products.

It will be a welcome sight for veterans

The Ministry of Defence announced that Navy veterans suffering from mesothelioma will be able to access a lump-sum payment of PS140,000. This will allow them to receive substantial financial support to ease the financial burden that mesothelioma has caused for their families.

This news will be greeted by the thousands of former military personnel who have been diagnosed with mesothelioma. The law has changed to allow them to receive a similar compensation amount like civilians with mesothelioma lawsuits.

The change is the result of the campaigning of the Royal British Legion and other groups, which resulted in the Prime Minister pledging to look at the issue. The change made by the MoD will allow many veterans who are dying, and could have qualified for a war-related pension to pick a lump amount. This will give them the peace of mind they need as well as the financial assistance they need to live out the rest of their lives.

Asbestos exposure can be linked to mesothelioma. Even though symptoms can take decades to develop, even one exposure could increase your risk. The vast majority of mesothelioma patients were exposed to asbestos at work, which includes Navy shipyards. Last year, the UK law was changed to allow employees who were exposed to asbestos while at work to sue their employers. However many veterans aren't aware that they may be entitled to compensation from the government.

Mesothelioma is a devastating illness that has had a devastating impact on many lives. The decision of the government to address the discrimination against military veterans is a major victory.

However, it's not enough to alleviate the suffering of veterans who have mesothelioma and their families. They will also have to seek compensation from the companies that supplied asbestos-related products to the armed forces. Based on the shipyards, bases and the ships they were employed on, veterans may be eligible to claim trust fund compensation against a variety of corporations. This could include multinational corporations with a long track record of selling asbestos products to the US Navy or other branches of the military.
