We respectfully disagree with all your reductions. Mapfre’s licensed appraiser calculated the Actual Cash Value in accordance with Massachusetts regulation 211 CMR 133.05, utilizing a weighted average of the NADA clean retail book value (25%) and the CCC One market value (75%). These values were derived using the options and mileage entered by the appraiser, and the methodology accurately reflects the fair market value of the vehicle. Labeling part of the valuation as “undocumented” is not supported, as the supporting documentation and method are clearly outlined and meet regulatory requirements.

Mapfre asserts that the rental is fair and reasonable and should be fully reimbursed. You have reduced Mapfre’s rental duration to 3 days but have provided no valid supports for limiting the time. Mapfre is requesting 18 days of rental at $25.07 per day, which is fair and reasonable. Adequate time was needed to inspect the vehicle, assign a total loss appraiser, complete the evaluation, coordinate title settlement, issue payment, and arrange vehicle removal. The daily rate applied is appropriate, and you have not provided evidence that a shorter rental period was reasonable during the settlement of Mapfre’s vehicle.

However, in good faith of settlement, we are willing to accept a reduction of $50. I have updated the offer accordingly—please accept.
