New York Court of Appeals made some major changes to the NYCAL docket in the last few days. In 2015 the political system in Albany was shaken to its core by the conviction of the former Assembly Speaker Sheldon Silver on federal corruption charges. Silver was accused of destroying every reasonable crafted tort reform bill in the legislature for more than a decade while working for the plaintiffs' firm Weitz & Luxenberg.

Justice Sherry Klein Heitler, the long-time head of the NYCAL docket, resigned in April 2014 amid reports that she had given the Weitz & Luxenberg law firm "red-carpet treatment." She was replaced by Justice Peter Moulton, who made a variety of changes to the docket.

Moulton introduced a new rule in the NYCAL docket that requires defendants to present evidence that their products aren't accountable for the plaintiffs' mesothelioma. In addition, he implemented a new practice in which he would not dismiss cases until expert witness testimony was complete. This new rule could have significant effects on the pace of discovery in cases on the NYCAL docket and could lead to an outcome that is more favorable to defendants.

In other New York asbestos news, an federal judge in the Eastern District of Virginia recently dismissed MDL 875 and ordered all future asbestos cases to be transferred to a different district. This should lead to more efficient and uniform handling of these cases, because the current MDL has developed a reputation for discovery abuse, unwarranted sanctions and minimal evidentiary requirements.

Central New York Asbestos Litigation Dockets

After years of corruption and mismanagement by the former Assembly Speaker Sheldon Silver, the scandals concerning his ties to asbestos lawyers have focused attention on the asbestos docket, which is rigged. This effectively eliminates the possibility that NYCAL defendants can obtain summary judgment.

In addition, Justice Moulton has ruled that a plaintiff must prove some damage to his or her health due to exposure to asbestos in order for a court to award compensatory damages. This ruling, in combination with a decision made in the beginning of 2016 that holds that medical monitoring is not a tort, makes it nearly impossible for asbestos defense lawyers to prevail on a NYCAL summary judgment motion.

The most recent case on which Judge Toal is presiding on, a mesothelioma suit filed against DOVER GREENS, claims that the company was in violation of asbestos work practice regulations when it renovated buildings on the Manhattan campus in October 2013 for an event for fundraising. The lawsuit asserts that DOVER GREENS did not follow CAA and NESHAP requirements for asbestos by failing to conduct an inspection of the Campus; notifying EPA prior to commencing renovations and to appropriately remove, store, and dispose of asbestos; and have a trained representative present during renovations.

Eastern New York Asbestos Litigation Dockets

At one time asbestos-related personal injury/death cases clogged federal and state courts and drained judges' judicial resources which prevented them from dealing with criminal matters or other important civil disputes.
