New York Asbestos Lawsuits
Asbestos is a harmful fiber that can lead to a variety of severe medical conditions, including mesothelioma. A New York asbestos attorney is experienced in handling lawsuits seeking financial compensation for victims of asbestos exposure and their families. These cases can be complicated, and it is critical to have a reputable mesothelioma law firm by your side.
New York has a long history of asbestos litigation and many residents have been exposed to this hazardous substance. In recent years, there have been more claims against former asbestos producers than ever before. These cases are the result of the realization that asbestos is associated with diseases such as mesothelioma and lung cancer. These companies were aware of asbestos' dangers however, they failed to inform their employees and customers.
The New York City area is particularly susceptible to asbestos-related illnesses due to its old structures and a myriad of construction sites. Brooklyn Navy Yard is a notoriously toxic area that continues impact the surrounding community.
Many workers were exposed to asbestos in the workplace. However, many people are diagnosed with mesothelioma as a result of an exposure secondarily to the harmful substances. This includes spouses of asbestos-exposure workers who wore their husband's work clothes and came into contact with asbestos dust on a regular basis.
The mesothelioma lawsuit can be costly for defendants. This is particularly the case if they were incorrectly identified as defendants. A study has revealed that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could rise. Specialized asbestos law firms often advertise on television during the day and encourage victims to submit claims under the premise that they will receive significant settlements.
The defendants could be able to reduce the cost of these cases by arguing that their policy periods are expired or that they are only responsible for only for a small proportion of the amount claimed. New York law does not provide a definitive rule on how to allocate liability when the alleged risk is within and part outside of the insurance policies.
Asbestos-related Illnesses
A variety of asbestos-related illnesses can be triggered because of exposure to the toxic mineral. The most serious condition is mesothelioma. Many have died from mesothelioma. Other asbestos-related diseases include lung cancer asbestosis, pleural plaques and pleural effusion.
Mesothelioma is a rare but fatal condition, is caused by asbestos fibers which collect in the lung. They then cause irritation to the linings of the ribcage (the the pleura), chest cavity, and abdominal cavity. The inhalation of these tiny fibers can cause scarring of the lungs, a condition known as asbestosis and occasionally, the development of thickened patches on the pleura called plaques on the pleura, or an enlargement of fibrosis in the pleura, referred to as diffused pleural fibrosis. Pleural plaques and diffused fibrosis reduce lung capacity as measured by breathing tests. They can also cause pain and discomfort in breathing, but they are not the cause of mesothelioma or cancer.
The majority of the time, signs of asbestos-related illnesses don't manifest until decades after initial exposure. It can take up to 50 years for asbestos fibers inhaled to cause lung damage. Workers who handled, cleaned and removed asbestos from their workplaces as well as children, spouses and other people who are exposed to asbestos are at risk for developing mesothelioma.
Other asbestos-related diseases, apart from mesothelioma, include laryngeal carcinoma and lung cancer as well as peritoneal, ovarian and peritoneal cancer. The most deadly mesothelioma type is ovarian cancer, but it's much less common than the general mesothelioma. It is usually diagnosed later than other kinds of mesothelioma due to the fact that it is a cancer that develops in the tissue of the reproductive organs, and the symptoms can be similar to those of other diseases.
Many companies employed asbestos in the 20th century, but they knew that it was a risk. When they did not remove asbestos from their products thousands of people were exposed. These people can now sue for financial compensation. Many asbestos-related manufacturers are bankrupt. The victims are now able to claim compensation from trust funds set up by bankruptcy courts.
