The court also decided that the company was liable for damages to the families of deceased workers.

After the decision in Borel many asbestos victims and families sought compensation from the companies that used asbestos as a material. Unfortunately, the majority of claims were dismissed for different reasons. Some cases were permitted to proceed and the courts set up a series of guidelines that have governed the handling of asbestos-related lawsuits.

In the 1990s asbestos defendants were seeking legal rulings to limit their liability. They wanted to be able argue that asbestos materials were not part of their product and therefore they shouldn't be held liable for the injuries suffered by people who worked with asbestos. The claims were not successful, and the U.S. Supreme Court refused to accept the "asbestos product" defense.

Federal and state laws protect the rights of a mesothelioma patient to seek compensation for their condition from the responsible parties in a specific case. However insurance companies continue fight these claims with a hammer and a sledgehammer.
