An Asbestos Defense Attorney Can Help Protect the Financial Security of Those Harmed by Exposure to This Harmful Mineral
A defense attorney for asbestos can help protect those whose financial security has been affected by exposure to the toxic mineral. Compensation can cover medical expenses funeral and burial costs, loss of quality of life, and suffering and pain.
Our lawyers are involved in mass toxic tort litigation at a national, regional and local level. As Lynn asbestos lawyers , we are familiar with the specific issues and complex science associated with asbestos cases.
New York Asbestos Lawsuits
Asbestos fibers are dangerous and can cause serious medical conditions, such as mesothelioma. A New York asbestos attorney is adept at handling lawsuits to seek financial compensation for victims of asbestos exposure and their families. These cases can be extremely complex and therefore it is essential to have a mesothelioma expert law firm by your side.
New York has a long history of asbestos litigation, and many residents have been exposed to this hazardous material. In recent years there have been more lawsuits against former asbestos manufacturers than ever before. These cases are a result of the recognition of a link between asbestos and certain diseases such as mesothelioma, lung cancer, and asbestosis. These companies knew of the dangers associated with this dangerous mineral, but they failed to warn their employees and consumers.
New York City is especially susceptible to diseases caused by asbestos due to its old structures and construction sites. The Brooklyn Navy Yard was a notoriously toxic site that continues to impact on the community surrounding it.
Mesothelioma is triggered by exposure to asbestos in direct contact and many workers were exposed to asbestos in the workplace. However, people also get diagnosed with mesothelioma after experiencing an exposure secondarily to the harmful substances. This includes spouses of asbestos-exposure workers who were wearing their husband's work clothes and came in contact with asbestos dust regularly.
The mesothelioma lawsuit can be costly for defendants. This is particularly the case if they were incorrectly identified as defendants. A study indicates that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could increase. Specialized asbestos law firms typically advertise on daytime TV and encourage victims to file claims, promising they will receive substantial settlements.
The defendants could be able to reduce some of the costs of these cases by arguing that their policies are in a lapse or that they only have to pay a small portion of the claim value. However, New York law has not set out a clear policy regarding how to allocate liabilities when the alleged exposure occurs in and out of the policy period of the insurer.
Asbestos-related Diseases
Exposure to asbestos can cause various illnesses. The condition known as mesothelioma is the most severe. Mesothelioma has caused the death of many people. Other asbestos-related diseases include lung cancer and asbestosis. Pleural plaques and effusion are also asbestos-related.
Mesothelioma, a rare, but fatal disease that is caused by asbestos fibers that are found in the lung. They then irritate the linings of the ribcage (the the pleura), chest cavity, and abdominal cavity. Inhaling these tiny fibers can cause scarring of the lungs known as asbestosis and, sometimes, the formation of thickened patches on the pleura, known as plaques of pleura or the more widespread fibrosis of the pleura known as diffused the fibrosis. Pleural plaques and diffused fibrisis reduce lung capacity, as measured by breathing tests. They can also cause pain and difficulty in breathing, but they are not the cause of cancer or mesothelioma.
Often, symptoms of asbestos-related illnesses don't show up until decades after the initial exposure. This is due to the fact that it can take between 20 to 50 years for inhalation of asbestos-containing fibers to cause lung damage. People who are at risk of developing mesothelioma or any other asbestos-related diseases include those who handled, laundered and removed asbestos-containing products from their workplaces and spouses and children of those exposed to asbestos.
Other asbestos-related diseases apart from mesothelioma, include lung cancer and laryngeal carcinoma as well as peritoneal, ovarian and peritoneal cancer. The most dangerous form of mesothelioma is called ovarian cancer, but it's less common than the general mesothelioma. It is diagnosed later than other types of mesothelioma, because it is found within the linings of reproductive organs. Symptoms can be similar to other diseases.
Many companies used asbestos in the 20th century, but they were aware that it was dangerous. When they did not remove it from their products, thousands of people were exposed. Now, those exposed have the right to seek financial compensation. Many asbestos-related companies are insolvent. This means that the victims are able to seek the compensation they are entitled to from trust funds established by the bankruptcy courts.
Asbestos Litigation in New York
Asbestos companies have put profit over the safety of their employees and customers for a long time making dangerous products, without warning about the risks. They are now confronting the consequences of their inattention. Victims of asbestos-related illnesses such as mesothelioma and lung cancer are seeking fair and complete compensation.

A panel composed of six Supreme Court Judges will review each case to determine whether it should be accepted or not. Judges will also evaluate the merits of each claim to determine how much a plaintiff should be awarded.
The panel is currently examining more than 3500 lawsuits. The panel is expected issue its final ruling before the end of the year.
