www.youtube.com are involved in the mass litigation of toxic torts at a national, regional and local scale. As our lawyers are well-versed with the specific issues and the complex science that go along with asbestos cases.
New York Asbestos Lawsuits
Asbestos is a dangerous fiber that can lead to a variety of severe medical conditions, including mesothelioma. A New York asbestos attorney is skilled in handling lawsuits to seek financial compensation for victims of asbestos exposure and their families. These cases can be complicated and it's crucial to have a mesothelioma lawyer on your side.
New York has had a long-running history of asbestos litigation. Many residents were exposed to this dangerous substance. In recent years, there have been more lawsuits against former asbestos manufacturers than ever before. These cases are a result of the recognition that asbestos is associated with diseases such as mesothelioma and lung cancer. The companies were aware of the dangers that asbestos posed but did not take the time to warn employees and consumers.
The New York City area is particularly susceptible to asbestos-related ailments due to its older structures and a myriad of construction sites. The Brooklyn Navy Yard was a notoriously toxic location that continues to have an impact on the community around it.
Many workers were exposed to asbestos at work. In addition, exposure to asbestos through secondhand sources can lead to mesothelioma. This includes spouses of asbestos-exposed workers who wore their husband's work clothes and came into contact with asbestos dust regularly.
The mesothelioma lawsuit can be costly for defendants, particularly when they are mistakenly identified as a defendant. A study has revealed that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could increase. This kind of litigation is usually supported by asbestos law firms that advertise on television during the day and encourage victims to file claims with the promise of large settlements.
Defendants might be able to lower some of the costs arising from these cases by argument that their policy terms have expired or they're only responsible for a tiny percentage of the total value of the claim. New York law does not provide a definitive rule on how to divide liability when the alleged exposure is part of and outside the insurer's policies.
Asbestos-related diseases
A myriad of asbestos-related illnesses can develop due to exposure to the mineral that causes cancer. The most serious of these is mesothelioma. Mesothelioma is the cause of death of many people. Other asbestos-related illnesses include asbestosis and lung cancer. Pleural plaques and pleural effusion are also asbestos-related.
Mesothelioma is a rare, but fatal illness that is caused by exposure to asbestos fibers which accumulate in the lungs, and can cause irritation to the lining of the ribcage, chest cavity and abdominal cavity (the the pleura). The inhalation of these tiny fibers can cause scarring to the lungs called asbestosis, and sometimes the formation of thickened patches on the pleura referred to as plaques on the pleura, or an enlargement of fibrosis in the pleura known as diffused fibrisis. Pleural plaques and diffused fibrisis reduce lung capacity as determined by breathing tests. They can also cause breathing problems and pain however they do not lead to cancer or mesothelioma.
The signs of asbestos-related illness typically do not manifest until decades after initial exposure. This is because it could take between 20 and 50 years for the inhalation of asbestos fibers to damage the lungs. Workers who handled, cleaned and removed asbestos from their workplaces as well as children, spouses and other people who are exposed to asbestos are at risk for developing mesothelioma.
In addition to mesothelioma other asbestos-related diseases include lung cancer, laryngeal cancer, peritoneal mesothelioma, and ovarian mesothelioma. The most dangerous mesothelioma type is ovarian cancer, but it's less common than the general mesothelioma. It is diagnosed later than most other types of mesothelioma, because it develops in the linings of reproductive organs. Symptoms can be similar to other illnesses.
Many companies employed asbestos during the 20th century. They were aware that it was a risk. They exposed thousands of people to asbestos when they didn't remove it from their products. The affected people are now able to sue for financial compensation. Many of the asbestos-related manufacturers have filed for bankruptcy. The victims can now seek compensation from the trust funds set up by bankruptcy courts.
Asbestos Litigation in New York
For decades, asbestos-related companies have put profits ahead of the safety of their employees as well as consumers by producing dangerous products, without warning of the risks. They are now facing the consequences of their carelessness. People who have suffered from asbestos-related diseases like mesothelioma and lung cancer are seeking fair and complete compensation.

A number of states have established special asbestos courts in which claims can be filed and resolving more efficiently. Additionally judges have developed specific procedures for evaluating and resolving asbestos cases.
New York is one such state that has its own asbestos court, known as NYCAL. As asbestos victims continue to seek compensation from solvent asbestos defendants who have gone bankrupt, the caseload of this court has steadily increased. In order to ensure that the justice system isn't overloaded and overwhelmed, the New York Supreme Court has established an additional judicial panel that will supervise NYCAL.
A panel comprised of six Supreme Court Judges will review each case to determine if it should be accepted or not. Judges will also consider the merits of every claim to determine the amount of amount of money each plaintiff should receive.
The panel is currently looking at more than 3500 lawsuits. The panel is expected to make a final decision before the end of the year.
