New York Asbestos Lawsuits

Asbestos is a dangerous fiber that can cause numerous serious medical conditions, including mesothelioma. A New York asbestos attorney is experienced in handling lawsuits seeking the financial compensation of those affected by asbestos exposure and their families. These cases can be a bit complicated and it's crucial to have a mesothelioma lawyer to assist you.

New York has a long history of asbestos litigation and many residents have been exposed to this hazardous substance. In recent years there have been more lawsuits against asbestos producers from the past than before. These cases stem from the recognition of a link between asbestos and diseases such as mesothelioma, lung cancer and asbestosis. These companies knew of the dangers of the asbestos-containing mineral, yet they didn't warn their employees and consumers.

The New York City area is particularly susceptible to asbestos-related illnesses due to its old structures and the numerous construction sites. Brooklyn Navy Yard is a notoriously hazardous area that continues to impact the surrounding community.

Many workers were exposed to asbestos in their work environments. However, people also get diagnosed with mesothelioma after experiencing an exposure secondarily to the harmful substances. This includes spouses of asbestos-exposure workers who wore their husband's work clothes and came into contact with asbestos dust regularly.

The mesothelioma lawsuit can be costly for defendants. This is especially true if they have been incorrectly identified as defendants. A study indicates that more than 3,600 lawsuits have been filed since 2014 in New York courts. This number could increase. This niche litigation is often fueled by specialized asbestos law firms, which advertise on television during the day and encourage victims to file claims, with the promise of huge settlements.

The defendants could be able to reduce some of the costs of these cases by arguing their policy periods are overdue or that they are only responsible only a small percentage of the amount claimed. New York law does not provide a definitive rule on how to allocate the liability if the alleged exposure is part of and outside the insurance policies.

Asbestos-related Illnesses

A variety of asbestos-related illnesses can be triggered because of exposure to the toxic mineral. The mesothelioma condition is the most severe. Many have died from mesothelioma. Other asbestos-related illnesses include lung cancer, asbestosis, pleural plaques, and the pleural effusion.

Mesothelioma is a rare, but fatal illness that is caused by asbestos fibers that accumulate in the lungs. They then irritate the linings of the ribcage (the Pleura) as well as the chest cavity and abdominal cavity. The inhalation of these small fibers can cause scarring to the lungs called asbestosis, and, sometimes, the development of thickened patches on the pleura referred to as plaques on the pleura, or the more widespread fibrosis of the pleura known as diffused the fibrosis. Pleural plaques and diffused fibrosis decrease lung capacity as measured by breathing tests. They can also cause pain and difficulty breathing however they do not cause mesothelioma or cancer.

The majority of the time, signs of asbestos-related diseases do not show up until decades after the initial exposure. It can take up to 50 years for asbestos fibers that are inhaled to cause lung damage. Workers who handled, cleaned and removed asbestos from the workplace as well as spouses, children and other people who are exposed to asbestos are at risk of developing mesothelioma.

Other asbestos-related diseases in addition to mesothelioma include laryngeal carcinoma and lung cancer, peritoneal, ovarian, and peritoneal cancer. The most dangerous form of mesothelioma is ovarian cancer, but it's much less common than the general mesothelioma. It is often diagnosed later than other types of mesothelioma because it is a cancer that develops in the lining of the reproductive organs and the symptoms may be similar to those of other diseases.

Many companies employed asbestos during the 20th century. address here were aware that it was dangerous. They exposed thousands of people to asbestos because they didn't eliminate it from their products. The affected people are now able to claim financial compensation. Many asbestos-related companies have filed for bankruptcy. In the aftermath, victims can seek the compensation they are entitled to from trust funds established by the bankruptcy courts.
