The court also ruled the company liable for damages for the families of deceased employees.
After the decision in Borel many asbestos victims and families sought compensation from the companies that made use of the material. Most of these claims were rejected for a variety reasons. Some cases were permitted to proceed and the courts came up with up a set of guidelines that guide the handling of asbestos-related lawsuits.
In the 1990s asbestos defendants were still seeking legal rulings to limit their liability. For example, they wanted to be able to argue that asbestos materials were not part of their product, and therefore should not be held liable for injuries to people who worked with asbestos. These arguments were rejected and the U.S. Supreme Court refused to recognize the "asbestos product" defense.
