Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A 24-year-old man with mesothelioma pericardial has claimed that Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first to proceed since J&J has dissolved its Talc business and filed for bankruptcy.
In the beginning of the year, substantial settlements were made in talc cases in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower Baby and Shower Powder products.
What is Mesothelioma?
Mesothelioma is a lethal form of cancer is a disease of the mesothelium the lining that surrounds organs and cavities inside the body. It is most often found in the lungs but it can also be found in the abdomen, the heart and chest cavity as well as testicles. Asbestos is the only known mesothelioma-related cause and those who have been exposed to asbestos are at greater risk of developing this disease.
The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional as they heard the plaintiff's story. The plaintiff, who is only 24 years old was diagnosed with malignant pericardial mesothelioma in 2022. He attributed his illness to childhood use of Johnson & Johnson baby powder. The jury awarded him $26 million.
J&J has been accused of hiding asbestos risks from consumers for a number of years. The company has a long history of hiding asbestos-related findings from regulators and even funding asbestos tests to achieve the results it desired. Some of the company's Talcum powder suppliers have been named in these lawsuits which include Whittaker, Clark & Daniels and Imerys Talc America.
Women who used talcum for feminine hygiene on sanitary pads or condoms as well as in the genital region have developed ovarian and mesothelioma. The lawsuits allege that J&J knew for more than 40 years that the powder caused mesothelioma and ovarian cancer but failed to warn customers of the danger.
Mesothelioma symptoms may include breathing problems, chronic coughing abdominal pain, fatigue, and lumps or masses on the chest or abdomen. Doctors can diagnose the disease through a physical exam and imaging scans. They can include CT (computer tomography) scans, MRIs and PET or X-rays.
When mesothelioma is discovered patients may undergo surgery, chemotherapy and/or radiotherapy. The surgeons are able to remove the affected tissue, based on the location of the tumors. Patients with mesothelioma are sometimes given an expected life expectancy of less than five years, but aggressive treatments such as extracorporeal membrane transplant and cytoreduction by hyperthermic intraperitoneal chemotherapy can extend the duration of their survival.
What is the cause of Mesothelioma?
Like all cancers, mesothelioma develops when a cell's DNA experiences mutations. The mutations cause the cells to multiply in uncontrolled ways and develop tumors in tissues of the body. Asbestos is the most common cause mesothelioma. Asbestos exposure can occur at work in a variety of industries which include mining, manufacturing, construction and transportation. Asbestos exposure typically occurs 20 to 40 years before symptoms appear. Men are more likely to develop mesothelioma than females. It is also most often diagnosed in people between the ages 50 and 70. The type of mesothelioma that a person is usually determined by the area of their body in which they were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Some are diagnosed with peritoneal mesothelioma. This type of mesothelioma affects the abdomen. Finally, some people are diagnosed with pericardial melanoma, the most rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.
The symptoms of mesothelioma are shortness of breath, fatigue, abdominal pain and weight loss. In the latter stages of mesothelioma, tumors may grow to other areas, causing severe discomfort and discomfort. Other symptoms of mesothelioma include fluid in the lung, a loss of appetite difficulties eating and swallowing. Mesothelioma can be fatal.
The talcum-powder case in Oakland involved an individual of 24 years old who developed pericardial mesothelioma as a result of using J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos, but didn't warn customers. They also cited an 1998 letter addressed to a J&J executive, revealing the possibility of asbestos being in their products.
Gary mesothelioma lawsuits is the latest in a series of high-dollar verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma in one woman. In March, a jury in Missouri awarded $55 Million in the same case. Seven new cases have been added to the MDL talcum powder over the last month, bringing to 37,522 the number of lawsuits in the process. Most of these lawsuits are filed by women who used J&J talcum powder to maintain feminine hygiene.
How do I know whether I have mesothelioma or not?
The diagnosis of mesothelioma could be devastating. Patients should always see an expert to obtain the most accurate diagnosis possible and prevent misdiagnosis that could lead to unneeded treatment and let cancer grow.
A physical examination and a blood test could be an effective way to determine whether mesothelioma has caused symptoms. These tests can be used to determine the presence of asbestos fibers in blood or to look at the extent to which a patient's organs are functioning. The most accurate method to diagnose mesothelioma is a biopsy. Doctors take tissues or fluids from an affected area, and examine them under a microscope for mesothelioma cancerous cells.
The type of mesothelioma that a person has also affects the likelihood of a positive outcome. Pleural mesothelioma is by far the most commonly encountered type of disease, and accounts for the majority of cases diagnosed. Peritoneal mesothelioma is a type of cancer that develops in the lining of the abdomen is less prevalent. Lastly, pericardial msothelioma is a rare kind that occurs in the lining the heart. It's only 1% of all cases.
The breath is short, and becomes worse over time, and bloody coughing are some of the first symptoms. Asbestos sufferers may also experience fluid buildup in the chest cavity, a condition called pleural effusion. This can be drained by inserting a needle in the affected region of the chest cavity. In more serious cases, doctors may perform pleurodesis, a procedure which seals the area to stop the fluid from accumulating in the pleura.
A precise diagnosis of mesothelioma is crucial in determining a patient's survival rate and treatment options. Chemotherapy, surgery, and radiation are all options. Other options include immunotherapy, which increases the immune system to fight mesothelioma as well as treatment fields for tumors that utilize a magnetic field in order to kill cancerous cells.
A mesothelioma specialist who is specialized can help patients understand the various mesothelioma types, which determine how aggressive the cancer is and what the prognosis for the patient is. Patients should discuss their experience of exposure to asbestos with their doctor to determine if they are a mesothelioma candidate and discover what kinds of treatment are available to them.

Mesothelioma, an uncommon and fatal illness caused by asbestos exposure, is a rare condition. Asbestos was once widely used in a variety of consumer and industrial products including baby powder. In talcum powder cases, plaintiffs claim that exposure to asbestos through inhalation of the powder led to the development of mesothelioma and other health issues.
J&J was allegedly aware of the dangers of talcum powder and asbestos for a long time, but failed to warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. These lawsuits have been consolidated in federal and state multidistrict litigations, or MDLs.
In 2018, one of the first large talc trials resulted in a $4.7 billion settlement for the plaintiff. This was a major news story and set the tone for the remainder of the litigation. In the last month, a judge denied a request by J&J to dismiss the lawsuits filed by the state of Mississippi.
J&J however, attempted again to stall the litigation. The company established a new subsidiary entity to assume its talc liabilities, and LTL Management filed for bankruptcy. The bankruptcy stopped the talc lawsuits of thousands, however, the 3rd Circuit rejected this strategy.
The lawsuits filed by the state of Mississippi are based on the same allegations that were a part of the individual lawsuits against J&J that claim that the company's failure to warn consumers about the dangers of ovarian cancer from talcum powder was negligent and constituted violations of the law of the state.
J&J has submitted its motion to dismiss lawsuits to a different bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to proceed. If you or someone you know is diagnosed with mesothelioma or other disease that could have been caused by talcum powder you should seek legal assistance immediately. Our skilled lawyers can assist you in obtaining the compensation you're entitled to.
