Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson
A man who is 24 years old and has pericardial mesothelioma has alleged Johnson & Johnson's baby powder caused his cancer. The Oakland mesothelioma trial is the first trial that has been held since J&J filed for bankruptcy and split off its talc division.
In the spring of this year, jury awards in New Jersey and California led to large settlements in talc lawsuits. Plaintiffs linked cancer to asbestos that was found in J&J products Shower to Shower and baby powder.
What is Mesothelioma?
Mesothelioma is a fatal form of cancer that affects the mesothelium the lining around organs and body cavities. It is most common in the lungs, but it can be found in the abdomen and chest cavity. Asbestos, the only known cause of this illness, is asbestos. People who have been exposed to asbestos are at chance of developing it.
The first trial following J&J declared bankruptcy on its talcum powder division opened in Oakland, California this week. Jurors were impressed by the story of the plaintiff. In 2022, the plaintiff who was just 24 years old at the time, old at the time, was diagnosed with malignant mesothelioma in the pericardium. He attributed the reason for his illness to his early use of Johnson & Johnson Baby Powder. The jury awarded him $25 million.
J&J is accused of obfuscating asbestos risks from consumers since many years. The company has a long history of withholding asbestos findings from regulators and funding asbestos tests to achieve the results it wanted. These lawsuits have named several of the talcum-powder suppliers for the company such as Whittaker Clark & Daniels, Imerys Talc America, and others.
Many women who used talcum powder to maintain feminine hygiene in the genital areas or on sanitary napkins, or condoms have been diagnosed with ovarian cancer, and some have been diagnosed with mesothelioma. The lawsuits allege that J&J knew for more than 40 years that using the powder could cause mesothelioma and ovarian cancer but failed to warn customers of this risk.
The symptoms of mesothelioma are abdominal pain as well as abdominal swelling, abdominal lumps and a persistent cough. Doctors can diagnose mesothelioma by an examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.
After a mesothelioma is diagnosed patients may undergo surgery, chemotherapy, or radiotherapy. Depending on the location of their tumors surgeons might be able to remove the affected tissue. Patients with mesothelioma are sometimes given a life expectancy less than five years, however aggressive treatments like extracorporeal membrane transplant and cytoreduction with hyperthermic intraperitoneal chemotherapy can prolong the life expectancy.
What causes Mesothelioma?
Like all cancers, mesothelioma develops when a cell's DNA experiences mutations. These mutations cause the cells to multiply rapidly, forming tumors in the tissues of the body. Asbestos is the most common cause of mesothelioma. Exposure to asbestos can occur at work in a variety of fields which include manufacturing, mining, construction and transportation. Asbestos exposure is typically seen 20 to 40 years prior to the time symptoms appear. Mesothelioma is more prevalent in men than women, and it is usually diagnosed in those in their 50s and 70s. The kind of mesothelioma involving asbestos that someone develops is usually determined by the place they were exposed. Most mesothelioma patients are diagnosed with pleural mesothelioma, which affects the lungs. Other patients are diagnosed with peritoneal mesothelioma. This type of mesothelioma is affecting the abdomen. Certain people are diagnosed with pericardial mesothelioma. This is a rare type of the disease which affects both the liner (pericardium), and the organ itself.
Shortness of breath as well as abdominal pain and fatigue are all symptoms of mesothelioma. In the latter stages of mesothelioma, the tumors can spread to other parts that cause severe discomfort and discomfort. Other symptoms of mesothelioma include fluid in the lung, a loss of appetite difficulties eating and swallowing. Mesothelioma can be fatal.
The talcum-powder case in Oakland involved a person who was 24 years old who developed pericardial msothelioma following the use of J&J baby powder. His lawyers argued that J&J knew that talc might contain asbestos and didn't warn consumers. They also cited a 1998 letter addressed to an J&J executive that revealed the possibility of asbestos being present in their products.
This is only the latest in a string of large verdicts against J&J. In Canton mesothelioma lawyer awarded $18.8 million to a woman who was diagnosed with ovarian mesothelioma from J&J's talcum powder. Last month the jury in Missouri awarded $55 million in another case that involved the same issue. In addition, seven cases were added to the talcum powder MDL over the last month and brought the number of pending lawsuits to 37,522. Most of these lawsuits were filed by women who have used J&J talcum powder to maintain feminine hygiene.
How Can I tell if I have mesothelioma or not?
The diagnosis of mesothelioma could be devastating. Patients should always seek out a specialist to get the most accurate diagnosis and to prevent misdiagnosis, which could result in unnecessary treatment and the spread of cancer.
A physical exam and blood sample can help identify mesothelioma-related symptoms. These tests can detect asbestos fibers in the blood or to determine the way in which the organs of a patient are functioning. The most reliable method of diagnosing mesothelioma involves a biopsy. Doctors remove tissues or fluids from the affected area, and examine them under a microscope to look for mesothelioma cancer cells.
The type of mesothelioma that a sufferer has also impacts his or her prognosis. Pleural mesothelioma that develops in the thin lining around the lung, is the most common form of mesothelioma and accounts for the vast majority of cases diagnosed. Peritoneal mesothelioma, which is a cancer that is found in the abdomen's lining is not as common. The pericardial mesothelioma, an uncommon type that develops in the heart's lining, is much less common and makes up about 1% of cases.
The breath is short, and gets worse with time, and bloody coughing are a few of the initial symptoms. Asbestos patients can also experience fluid accumulation in the chest cavity, a condition called pleural effusion. It can be removed by inserting a needle in the affected area of the chest cavity. In more serious cases, doctors can perform a procedure called pleurodesis to seal the space to prevent the reaccumulation in the pleura.
A precise mesothelioma diagnosis is the most reliable way to determine a patient's treatment options and the survival rate. There are a variety of options for treatment, including surgery, chemotherapy and radiation. Other options include immunotherapy, a form of treatment that enhances the immune system to fight mesothelioma cancer cells, and tumor treating fields, which use an electromagnetic field to destroy cancerous cells.
A specialized mesothelioma specialist can also help patients understand the different mesothelioma cells, which determine how aggressive the cancer is and what the prognosis for the patient is. Patients should discuss with their doctor their history of asbestos exposure to determine whether mesothelioma could be a possibility and what treatment options are available.

Mesothelioma is a rare and fatal disease caused by asbestos exposure is a rare disease. Asbestos was once used extensively in a wide range of consumer and industrial products, including baby powder. The plaintiffs in talcum powder cases claim that inhaling talcum powder contributed to their exposure to asbestos and subsequently mesothelioma and various other health issues.
J&J was allegedly aware of the risk of talcum powder and asbestos for decades but failed to warn consumers. Plaintiffs have filed lawsuits seeking punitive damages and compensatory damages against J&J. These claims have been consolidated in state and federal multidistrict lawsuits, also known as MDLs.
In 2018, one of the largest talc cases led to a $4.7 billion settlement in favor of the plaintiff. This was a major news story and set a tone for the remainder of the litigation. In the last month, a judge denied J&J's motion to dismiss the lawsuits brought by the state.
However, in an attempt to halt the litigation, J&J tried again. The company created a new subsidiary entity to take on its talc liability, and LTL Management filed for bankruptcy. The bankruptcy was able to halt thousands of talc lawsuits, but the 3rd Circuit rejected this strategy.
The lawsuits brought by the state of Mississippi are based on the same allegations that were a part of the individual lawsuits filed against J&J which allege that the company's inability to warn consumers about the dangers of ovarian cancer caused by talcum powder was negligent and constituted violations of the law of the state.
J&J has filed a motion to dismiss lawsuits to a different bankruptcy court. A hearing is scheduled for June to decide whether the lawsuits against J&J will be allowed to move forward. If you or someone you know is diagnosed with mesothelioma, or any other condition that could have been caused by talcum powder, you should seek legal assistance immediately.
